Dear Mr. Ingram:
This correspondence is in reference to the Neu -Con Umbrella Mitigation Bank, Cedar Grove
Mitigation Site, located northwest of the intersection of Dade Store Road and Rick Road, north
of Hillsborough, in Orange County, North Carolina. The mitigation site is adjacent to the East
Fork of the Eno River within the Neuse River Basin, Hydrologic Unit Code (HUC) 03020201,
The purpose of this letter is to confirm the release of stream restoration credits associated with
Year 2 adaptive management report and Year 3 Monitoring activities for this project.
Pursuant to the Umbrella Mitigation Banking Instrument entitled, Neu -Con Umbrella
Wetland Mitigation and Stream Restoration Bank, approved April 2, 2001 and amended April
10, 2009 and February 2, 2017; and the site -specific Cedar Grove Mitigation Site Final
Mitigation Plan dated December 2013, ten percent (10%) of the mitigation site's total restoration
credits shall be available for sale provided the third year monitoring report demonstrates interim
performance standards are being met.
The Cedar Grove Mitigation Site Year 2 Monitoring Report was received in our office on
October 6, 2016. A review of the monitoring report and a site visit conducted on February 2,
2017 indicated low stem densities in vegetation plots 6, 8, 9, and 12; two small areas of sparse
vegetation adjacent to the East Fork Eno River (EFER) and UT 2-A; minor areas of bank erosion
along the EFER at its confluence with UT-1, minor bed erosion on UT-2A associated with a
grade control structure; and two areas of bed erosion on UT-1. Therefore, 3% of the anticipated
10% credit release for Year 2 constituting 205.86 SMUs was withheld in abeyance until the
sponsor submitted an adaptive management report demonstrating that all stream repairs are
complete and stable, and all areas of sparse/low density vegetation had been replanted. On April
24, 2017, the sponsor provided an adaptive management plan to our office indicating the work
had been completed.
The Cedar Grove Mitigation Site Year 3 Monitoring Report was received in our office on
October 10, 2017. A review of the monitoring report and a site visit conducted on November 14,
2017 indicated the upper 2 ponds of UT2-A (-614 SMUs) were not achieving or trending
towards their success criteria; this reach was observe to have more of a braided system rather
than a single thread. In addition, beaver activity was observed in the upper reach of UT3.
Therefore, 0.895% (or 61.4 SMUs) of the anticipated 10% (or 686.2 SMUs) credit release for
Year 3 will be held in abeyance until the sponsor submits an adaptive management report
demonstrating that all stream repairs are complete and stable.
By copy of this correspondence, we confirm that 3% (or 205.86 SMUs) from Year 2 and
624.8 SMUs (or 9.105%) from Year 3 are now available for sale; totaling 830.66 SMUs. To
date, 59.105% of the total credits (4055.8 SMUs) have been released. Our records indicate that
2,744.8 SMUs associated with this mitigation site have been debited as of December 8, 2017.
Therefore, the current total amount of credits available for sale is 1,311 SMUs. Please confirm
these totals on your mitigation bank ledger.
