FACILITY OVERVIEW:
This facility supports no industry and has no pretreatment program. The existing treatment system consists
of an activated -sludge, extended aeration basin with two floating mechanical aerators, a clarifier with sludge
return, two polishing ponds (in series with mechanical aerators), a gaseous chlorine contact chamber,
continuous -recording flow meter, two aerated sludge holding tanks, a sludge drying bed (backup), and an
emergency generator.
No modifications were noted or proposed in the current application.
COMPLIANCE:
The facility has had twelve (12) civil penalty assessment actions during the recent permit cycle with a total
penalty amount of just over $6,300. The main compliance issues have been fecal coliform and BOD limits
violations but have also ammonia nitrogen violations. The most recent enforcement action was related to
BOD limit violations in October 2017 (case in 2018). There have been an additional sixteen (16) NOV's and
one NOD issued to the facility over the permit term. BIMS data show fifty-five (55) months with violations
over the permit term but these included a large number of TRC violations when the reported data was below
the DWR compliance level.
TOXICITY TESTING:
Current Requirement:
Required for discharge under zero -flow condition,
Chronic P/F @ 90 %. No changes recommended.
The applicant has asked for removal of this monitoring requirement based on a Division memorandum that
generally associates toxicity testing with major facilities or ones discharging complex wastewaters. Under
15A NCAC 0213.0508 the Director can apply toxicity testing to other discharges as deemed necessary.
Discussions with WiRO staff have confirmed that regional staff feels that the condition should remain in the
permit. The facility has failed the toxicity test four times (3/16; 3/17; 12/17 and 12/18) in the past three
years and received five NOV's over the permit cycle. No other information is available to target the potential
cause of the failed test results. WET monitoring has been maintained in the draft permit.
INSTREAM MONITORING:
Current Requirement: Upstream and Downstream monitoring for dissolved oxygen (DO) and
Temperature.
The applicant has requested that these requirements be removed from the permit. The applicant's
justifications for the proposed change are that the discharge is to swamp waters that generally do not flow
in the direction of the river. The applicant questions the appropriateness of the instream monitoring
locations and the contribution of their discharge to any changes in DO. The applicant also questions
potential to impact temperature given there no industrial wastes that could have high temps.
Regional office staff verified the difficulty in selecting appropriate instream sampling locations for the
facility, especially for upstream. Data for the permit term indicate that for DO only 5 values out of 714 for
upstream and downstream were below 6 mg/L. The U and D DO values were in line and do not appear to
show an apparent impact from the discharge. Temperature values seem to be in line and show appropriate
variation associated with seasonal temperature changes. There is no current indication of negative
temperature impacts from the discharge.
Propose removing the upstream and downstream monitoring requirements from the permit. Effluent
monitoring for temperature and DO will remain at the same frequencies.

NOTIFICATION OF INTENT TO ISSUE AN AMENDED CONSENT ORDER
Public notice of intent to issue an amendment to a State Consent Order to the following:
The Town of Edenton (P.O. Box 300, Edenton, North Carolina 27932) has requested Special Order
by Consent WQ S17-001 Ad. I for its Town of Edenton WWTF, a 1,076,000 GPD wastewater
irrigation facility operating under the authority of Non -Discharge permit WQ0004332, to allow
modified yearly Non -Discharge application limits.
The Environmental Management Commission proposes to issue the amended Order per Article 21
of Chapter 143, N.C. General Statutes, and other regulations effective November 1, 2019.
Compliance with this amended Order requires installation of necessary treatment components to the
existing facility. The Town of Edenton shall comply with Non -Discharge permit limits with the
exception of the interim limitations identified in the amended Order. This amended Order will
expire on February 1, 2024.
A copy of the amended Order is available upon request by contacting Ashley Kabat of the Division
of Water Resources at 919-707-3658, or by email at: Ashley.Kabat(c�r�,ncdenr.gov. Comments on the
proposed amended Order received no later than October 21, 2019 will be considered in the final

Hey Guys,
Just found out that this permit is one that ran into a glitz with some of the notice process and has
had the comment period extended through Nov 25th. So, it won't be getting issued until sometime
in December at this point.

We are preparing to go to notice with this draft permit. It has been expired for a few months now so
I want to get it moving. Sorry we weren't able to discuss the issues I raised in the last email a few
weeks ago, but hopefully the draft is on the right track. I have attached the draft permit, transmittal
letter and the fact sheet for your review. The permit should appear in local papers on September
18th. Gordon Hargrove and Mike Prostinak will be getting hard copies of the letter and draft. I will
also email them to let them know the draft is on the way and going to notice.

Hey Guys,
Sorry it has been so long for me to get back to this one. I have been caught in the electronic
signature stuff and some other projects. I know this one is old and expired at this point but I hope to
have it out to notice soon. I did want to run a couple of things by you before the draft was finalized.
Let me know what you think about this:
• They asked to have tox testing removed, but with their failures in the past and what I got
from you guys it doesn't seem to me that there is reason to do this. Tox test will remain in
the permit.
• They also asked to have upstream and downstream DO and Temp monitoring removed.
Looking at the data there were only a few low DO values over the permit cycle and
downstream values were in line with upstream so removing DO seems reasonable to me.
For Temp the values seem to be in line and show appropriate fluctuation with the seasons so
I'm proposing removing this as well. I think you had also indicated that finding good U and D
monitoring locations for this site could be difficult. So in the draft right now we are
proposing to remove U/D Do and Temp monitoring. They will continue to have effluent
monitoring for both.

The Town of Lake Waccamaw is submitting the renewal application package for NPDES permit
#NC0021881. The permit expiration date is July 31, 2019. The permit application package
consists of:

The Town would like to request the following changes to the permit:
• The Town requests that quarterly monitoring for Chronic Toxicity be removed from the
permit. In your online guidance, there is an August 2, 1999 memorandum that states that
toxicity testing will be required at "major" facilities or those facilities discharging
"complex" wastewaters. The flow to the WWTP is a combination of domestic discharges
from residential and commercial sources with no industrial contributions and should not
be subject to the toxicity requirement.
It is requested that the upstream and downstream monitoring requirements for Dissolved
Oxygen and Temperature be removed from the permit. The discharge is into a swamp, not
into a defined water course. The swamp is generally not flowing in the direction of the
river. In fact, for the most part, the flow from the river will flood the swamp and push the
water away from the river. Because the discharge is into a swamp there is no definitive
upstream or downstream sampling sites. The testing of DO and Temperature at the two
monitoring sites has no correlation to the discharge from the wastewater plant. DO in the
stream is more likely to be affected by agricultural runoff, natural decay, rainfall, etc and
any increase or decrease in DO cannot be definitely attributed to the treatment plant.
Again, since the wastewater flow is domestic in nature with no industrial dischargers that
could potentially discharge high temperature waste it is improbable that the discharge will
affect stream temperature.
• The analytical results of the Total Mercury sample sent to the Lab for analysis have not yet
been received. A copy of the results will be forwarded to you as soon as it arrives.

APPLICATION OVERVIEW
Form 2A has been developed in a modular format and consists of a "Basic Application Information" packet
and a "Supplemental Application Information" packet. The Basic Application Information packet is divided
into two parts. All applicants must complete Parts A and C. Applicants with a design flow greater than or
equal to 0.1 mgd must also complete Part B. Some applicants must also complete the Supplemental
Application Information packet. The following items explain which parts of Form 2A you must complete.
BASIC APPLICATION INFORMATION:
A. Basic Application Information for all Applicants. All applicants must complete questions A.1 through A.8. A treatment works
that discharges effluent to surface waters of the United States must also answer questions A.9 through A.12.
B. Additional Application Information for Applicants with a Design Flow >_ 0.1 mgd. All treatment works that have design flows
greater than or equal to 0.1 million gallons per day must complete questions B.1 through 13.6.
C. Certification. All applicants must complete Part C (Certification).
SUPPLEMENTAL APPLICATION INFORMATION:
D. Expanded Effluent Testing Data. A treatment works that discharges effluent to surface waters of the United States and meets
one or more of the following criteria must complete Part D (Expanded Effluent Testing Data):
1. Has a design flow rate greater than or equal to 1 mgd,
2. Is required to have a pretreatment program (or has one in place), or
3. Is otherwise required by the permitting authority to provide the information.
E. Toxicity Testing Data. A treatment works that meets one or more of the following criteria must complete Part E (Toxicity Testing
Data):
1. Has a design flow rate greater than or equal to 1 mgd,
2. Is required to have a pretreatment program (or has one in place), or
3. Is otherwise required by the permitting authority to submit results of toxicity testing.
F. Industrial User Discharges and RCRA/CERCLA Wastes. A treatment works that accepts process wastewater from any
significant industrial users (SIUs) or receives RCRA or CERCLA wastes must complete Part F (Industrial User Discharges
and RCRA/CERCLA Wastes). SIUs are defined as:
1. All industrial users subject to Categorical Pretreatment Standards under 40 Code of Federal Regulations (CFR) 403.6 and
40 CFR Chapter I, Subchapter N (see instructions); and
2. Any other industrial user that:
a. Discharges an average of 25,000 gallons per day or more of process wastewater to the treatment works (with certain
exclusions); or
b. Contributes a process wastestream that makes up 5 percent or more of the average dry weather hydraulic or organic
capacity of the treatment plant; or
C. Is designated as an SIU by the control authority.
G. Combined Sewer Systems. A treatment works that has a combined sewer system must complete Part G (Combined Sewer
Systems).

Applicants that discharge to waters of the US must provide effluent testing data for the following parameters. Provide the indicated
effluent testing required by the permitting authority for each outfall through which effluent is discharged. Do not include information
on combine sewer overflows in this section. All information reported must be based on data collected through analysis conducted
using 40 CFR Part 136 methods. In addition, this data must comply with QA/QC requirements of 40 CFR Part 136 and other appropriate
QA/QC requirements for standard methods for analytes not addressed by 40 CFR Part 136. At a minimum effluent testing data must be

POTWs meeting one or more of the following criteria must provide the results of whole effluent toxicity tests for acute or chronic toxicity for each of the
facility's discharge points: 1) POTWs with a design flow rate greater than or equal to 1.0 mgd; 2) POTWs with a pretreatment program (or those that are
required to have one under 40 CFR Part 403), or 3) POTWs required by the permitting authority to submit data for these parameters.
• At a minimum, these results must include quarterly testing for a 12-month period within the past 1 year using multiple species (minimum of two
species), or the results from four tests performed at least annually in the four and one-half years prior to the application, provided the results
show no appreciable toxicity, and testing for acute and/or chronic toxicity, depending on the range of receiving water dilution. Do not include
information on combined sewer overflows in this section. All information reported must be based on data collected through analysis conducted
using 40 CFR Part 136 methods. In addition, this data must comply with QA/QC requirements of 40 CFR Part 136 and other appropriate QA/QC
requirements for standard methods for analytes not addressed by 40 CFR Part 136.
• In addition, submit the results of any other whole effluent toxicity tests from the past four and one-half years. If a whole effluent toxicity test
conducted during the past four and one-half years revealed toxicity, provide any information on the cause of the toxicity or any results of a
toxicity reduction evaluation, if one was conducted.
• If you have already submitted any of the information requested in Part E, you need not submit it again. Rather, provide the information
requested in question EA for previously submitted information. If EPA methods were not used, report the reasons for using alternate methods.
If test summaries are available that contain all of the information requested below, they may be submitted in place of Part E.
If no biomonitoring data is required, do not complete Part E. Refer to the Application Overview for directions on which other sections of the form to
complete.
