Dear Messrs. Guthrie and Grimes:
You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct the
following activity adjacent to your property at 527/535 Cedar Point Road (NC Highway 24) in Carteret
County. This approval allows you to:
1. Using the clam bucket to barge method, excavate a 18' wide by 365' long access channel to a
depth of -2.5' Mean Low Water, for the purpose of accessing White Oak River from your
private canal.
This approval is only valid for the purpose and design that you described in your completed CAMA
application received by the Division of Water Quality (DWQ) on August 20, 2004. After reviewing your
application, we have determined that General Water Quality Certification Number 3400 covers this
activity. This Certification can also be found on line at: http://h2o.enr.state.nc.us/ncwetlands/certs.btml.
This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management
issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable
to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water
Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your completed CAMA
Major Permit application received by the Division of Coastal Management on August 18, 2004. If you
change or modify your project, you must notify the Division (DWQ) in writing and you may be required to
send us a new application for a new certification. If the property is sold, the new owner must be given a
copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If
total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to this office and a copy to the 401 Oversight/Express Review Permitting Unit,

2. No excavation and no waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or
riparian areas beyond the footprint of the impacts depicted in the CAMA Major Application. All
construction activities, including the design, installation, operation, and maintenance of sediment
and erosion control Best Management Practices, shall be performed so that no violations of state
water quality standards, statutes, or rules occur.
Please notify this Office at the number listed below if any problem arises during the construction of
the project that may affect water quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the DWQ Permit #041374 under Section 401 of the Clean Water

9. NARRATIVE DESCRIPTION:
Project Setting
The project site is located at 527 Cedar Point Blvd. within Cedar Point located around 1 %4
miles west of the Swansboro bridge on the north side of Highway 24 (Cedar Point Blvd.). The
project site is located within the White Oak River, Carteret County. Lynwood Grimes and Austin
Guthrie collectively own 7.1 acres of land adjacent to a man altered canal running from Highway
24 to the White Oak River. The elevation of the land surrounding the basin is as high as 4' above
NHW (normal high water). Current man made features on the two properties include two single
family residences and three piers two accessing the canal while one accesses the White Oak
River. The vegetation west of the man-altered canal is overgrown with weeds and formerly
served as a farm field. The field currently has some spoils spread throughout, a result of
maintenance excavation earlier this year. The east side of the canal is vegetated with lawn grass
as you approach the Grimes residence. The surrounding land is currently zoned R20 which could
allow for future growth in the location of the farm field.
The canal has been most recently excavated earlier this year to remove spots of siltation.
The canal has been excavated several times before under older major permits in the 80's.
According to Mr. Guthrie the offshore channel that accesses the River was originally dug in the
60's. This has been confirmed by affidavit by two long time Cedar Point residents, Mr. John
Jones and Mr. James Guthrie. Mr. John Jones family formerly owned both sides of the road
along the entire stretch of Highway 24 through Cedar. Point. Mr. Austin Guthrie has also shared
an aerial photo of the project dated sometime in the early 70's. The picture does appear to show
an excavated channel running into the White Oak River.
The shoreline along the man made canal and along the entrance to the canal contains a
fringe of spartina alterniflora. This wetland fringe is as large as 30' wide and as narrow as 5'
wide. There does not appear to be any unexpected erosion along the shoreline. There are no
hard shoreline stabilization measures along the shoreline within or outside the mouth of the
basin. The manmade canal generally has a controlling depth of -2.5' just inside the mouth. It
appears that the canal has faired better than the access channel over the years in term of
holding its depth. The depth of the offshore channel varies from -0.5' to -1.5' below normal
low water. The channel runs through the White Oak River, which at this location is a
predominately muddy sandy bottom. The River at this location is not considered a primary or
secondary nursery area but appears to be open to shellfish harvesting. The water classification
by the Division of Water Quality is SA HQW.
Project Description
The co applicants are applying to conduct excavation in the old entrance channel leading
from the White Oak River into the man made canal at 527 Cedar Point Blvd. The proposed
excavation would be 365' long and 18' wide to a total depth of -2.5' during low water
conditions. As stated before the inside of the manmade canal already has on average 2.5' of
water during low tide. The proposed excavation would start at the mouth and extend 330' to

an existing offshore depth of -2.5' at low water. The top cut would be 18' wide and the
bottom cut would be 10' wide. For the entire distance of the proposed excavation the project
would generate approximately 487 cubic yards of material. The proposed method of
excavation will be a mud bucket style dredge, which is comprised of an excavator positioned
on a barge. The spoils are temporarily loaded onto the barge within a spoil containment vessel
and then offloaded onto highground. The application notes the offload site to be one of the
narrowest fringes of marsh and this will be protected by crossing the area with the aid of
logging mats to avoid soil disturbance. The spoils would be placed back into the farmfield,
which has an available disposal area of just over 19,000 square feet. The spoils would be
placed uphill of the marsh fringe and separated by silt fencing temporarily until the material
becomes stable and vegetated. On the back side or north side of Cedar Point, the White Oak
River water is more tanic and substrate darker therefore not lending itself to be conducive to
the presence of submerged aquatic vegetation. If the activity is conducted within winter months
finfish resources would be less likely impacted.
Anticipated Impacts
The project will involve the loss of 6,570 fe of formerly dredged shallow water
estuarine bottom through the public trust area within High Quality Waters designated by the
Division of Water Quality. The project would also temporarily impact 40 square feet of
Coastal Wetlands at the spoil offload site. The area designated for spoil appears to be more
than adequate to contain the proposed excavation. Short-term turbidity may be a concern
during construction. Biological activity may be minimized by timing the project during the
winter months.
