Conditions of Certification: 1. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 3. In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required for a project, the mitigation plans must be approved by DWQ in writing before the impacts approved by the Certification occur. The mitigation plan must be implemented and/or constructed before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public; WQC #3400 The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity that requires written concurrence under this certification, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. PROJECT SUMMARY: The applicants propose to excavate a portion of a branch of Spooner's Creek into their high ground to create a boat basin with dockage for 4 boats. John Kerr/Steve Stephan Page 02 --------------------------- 9. Narrative Description: The project site is a residential development known as Spooner's Creek. This subdivision is located in Carteret County off of Highway 24 west of the intersection with Highway 70. The subject property consists of two single-family residential lots, each with an existing residence. The properties average 1.3 acres together, and are approximately 5' above msl in elevation. The lots are stabilized with timber bulkheads, as are the adjoining properties to the south. At the-nrthern terminus of the creek the bulkhead ends as the creek becomes a wetland ditch. The opposite side of the creek is coastal marsh. The properties are serviced by municipal sewer services and private wells. The branch of Spooner's Creek that the subject property abuts is approximately 30-40' in width, and approximately 600' in length. Soundings in the creek average 0' to -2' nlw. According to Tides and Currents, Version 2.2 by Nautical Software, the mean tidal range in the creek is 1.2'. The Morehead City Land Use Plan classifies this area as Developed, with all AEC's classified as Conservation. Spooner's Creek is not designated as Primary Nursery Area, nor is it open to the taking of shellfish. The Water Quality Classification is SA. The applicants propose to excavate a boat basin, stabilize it with a vertical bulkhead, and connect to the existing creek. Four slips will be created within the new basin, with 3 having boatlifts. The basin will begin at the existing bulkhead along the shoreline of the two properties, and extend inland in a semi-triangular configuration. Approximately 3000 cubic yards of material will be removed from this 8700 sf area to create a basin and the high ground portion of the channel to a bottom depth of 4' nlw. The channel, 108' x 32' will be necessary to connect the new basin to the existing 4' water contour of the creek. Approximately 2/3 of this channel will be within the open water of the creek, disturbing approximately 3456 sf of shallow bottom habitat. Excavation will occur from high ground with all spoil removed from the site to an approved spoil area. Approximately 321' of new bulkhead will be required to stabilize the shoreline created by the excavation. Fifty-four feet of the existing bulkhead will be reinforced with new pilings and some board replacement. Approximately 3800 sf of high ground will be disturbed for the installation of the cables and dead men. Within the basin, there are 2 docks proposed at the landward end. A 5' x 3' dock and a 3' x 18' dock each will have a 12' x 12' boatlift. To the east along the bulkhead there is another 12' x 12' boatlift proposed with no dock. Three additional mooring pilings are proposed to create a 4" mooring space with a width of 18'. All four spaces are for the use of the individual property owners. 10. Anticipated Impacts: Excavation of the basin and channel will require the disturbance of 3456 sf of shallow bottom and 8788 sf of high ground. Appr. 3810 sf of high ground will be disturbed for bulkhead installation. The docks and lifts will incorporate appr. 529 sf of newly created open water entirely within the new basin. Turbidity can be expected during excavation and piling installation, but can be minimized through the use of a turbidity curtain across the creek.
