Atlas Environmental is submitting the enclosed package on behalf of Cambridge-FV,
LLC, Mr. Barrett Blackburn, for approval of a Nationwide Permit 3/29 application. A 404
and 401 were approved for this project in the first half of 2019. These approvals
included 82 linear feet of permanent intermittent stream impact and 36 linear feet of
temporary intermittent stream impact for a road crossing to gain access across the
project site as well as permanent impacts to 0.353 acre and temporary impacts to 0.113
acre of wetlands. The permanent wetland impacts were for infrastructure road
construction and fill for one lot. The temporary wetland impacts were necessary during
site construction for access. The project also required 8,173 square feet of zone 1
buffer impacts and 7,689 square feet of zone 2 buffer impacts for the one stream road
crossing and three storm water pond outlets. Payment for the stream buffer mitigation
and wetland mitigation for the original permit approval was completed through
Restoration Systems and RES.
After further engineer planning it has become apparent that additional wetland impacts
are necessary. One previously approved permanent wetland impact has decreased
from 0.185 acre to 0.172 acre (Impact #6). The temporary wetland impact at this
location increased slightly from 0.04 to 0.046 acre. Additional wetland impacts are
necessary for parking lot construction, temporary construction access, and rehabilitation
of an existing dam. An additional 0.007 acre of permanent and 0.077 acre of temporary
wetland impacts are required. No additional stream or buffer impacts are required.
Only the new requested impacts are included in the enclosed PCN and impact table.
Enclosed is a Statement of Availability for 2:1 wetland mitigation credit from Restoration
Systems at the Pancho mitigation bank. Wetland impacts are limited to those
necessary for road construction, the development of one lot, parking lot construction
that includes the use of retaining walls to minimized impacts, and rehabilitation of an
existing degraded dam. Almost 94% of the wetlands on site have been avoided. A

Wetland impacts have been minimized by intentionally designing the development to avoid the largest areas of wetland as
open space and only impacting areas necessary for road construction, one lot preparation, and minor parking lot fills. Almost
94% of the wetlands have been avoided.

Construction techniques have been used to minimize and avoid impacts by the placment of roads and the steepness of the
side slopes. Many of the roads and lots abut wetlands areas but do not impact wetland areas. By controling the steepness of
the side slopes permanent wetland impacts have been greatly reduced. Construction of retaining walls have minimized
wetland impacts.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD .before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following

and the conditions listed below. This certification is associated with the use of Nationwide
Permit Number 29 once it is issued to you by the U.S. Army Corps of Engineers. Please note
that you should get any other federal, state or local permits before proceeding with your

2. Stormwater Management Plan (SMP} Approval from Local Community Reguired
The stormwater management plan (SMP) must be approved by the Town of Fuquay-Varina
and meet the requirements of this Certification. The SMP may not be modified without
prior written authorization from the Town of Fuquay-Varina. [15A NCAC 02H .0506(b)(3))
3. Visual monitoring of the unnamed tributary at Buffer Impact #1, 5 and 7 (61, B2 and 133)
shall be conducted immediately following installation of the culvert and quarterly
thereafter. Monitoring shall occur at least once a year during a rain event that results in
precipitation amounts of % inch or greater. Pictures shall be taken of the stream and
streambank conditions immediately upstream of the impactarea and downstream of the
impact area during each monitoring event. If visual monitoring indicates that banks of the
unnamed tributary are exhibiting erosion or that the channel is significantly flooded during

recipitation events, the DWR Raleigh Regional Office (RRO) shall be notified in writing.

If visual,monitoring conducted pursuant to the condition above indicates that the unnamed
tributary is overwhelmed, unstable, or that the banks of the unnamed tributary are
unstable, then the Permittee shall conduct a detailed analysis of the cause and propose a
resolution to DWR RRO. Upon approval by DWR RRO, the Permittee shall implement the
resolution accordingly.
4. Compensatory Mitigation Using a Private Mitigation Bank
Mitigation must be provided for the proposed impacts as specified in the table below. The
Division has received a Statement of Availability letter from EBX-Neuse 1, LLC Neuse Riparian
Buffer Umbrella Mitigation Bank (EBX-Neuse 1), RES Neuse Buffer and Nutrient Offset
Umbrella Mitigation Bank (RES) or EBX Upper Neuse Riparian Buffer Umbrella Mitigation
Bank (EBX) to meet this mitigation requirement. The specific bank site to be debited will be
Arrington Bridge I, Buffalo Branch, Selma Mill, Cedar Grove, Hatley, Ezell, Polecat, Hannah
Bridge, Meadow Spring, and Stone Creek all located in HUC 03020201. Also, The Division
has received a Statement of Availability letter from Restoration Systems, LLC. The specific
bank site to be debited will be Weaver Farm, Pancho, and Half Mile all located in HUC
03020201. Until the EBX-Neuse I, RES, EBX or Restoration Systems, LLC receives and clears
your payment, and proof of payment has been provided to this Office, no impacts specified

but not limited to sediment impacts, and any violation of state regulated riparian buffer

6. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under this authorization shall be clearly marked with orange
warning fencing (or similar high. visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15 NCAC 02H .0500. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A NCAC
02H .0507' (c)]
7. This approval is for the purpose and design described in your application. The plans and
specifications for.this project are incorporated by reference as part of the Certification and

Explanation: The stream(s) listed above has been located on the most recent published NRCS Soil
Survey of Wake County, North Carolina and/or the most recent copy of the USGS Topographic map at a
1:24,000 scale. Each stream that is checked "Not Subject' has been determined to not be at least
intermittent or is not present. Streams that are checked "Subject' have been located on the property and
possess characteristics that qualify it to be at least an intermittent stream. There may be other streams
located on the property that do not show up on the maps referenced above but may be considered
jurisdictional according to the US Army Corps of Engineers.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or
affected parties that dispute a determination made by the DWR may request a determination by
the Director. An appeal request must be made within sixty (60) days of date of this letter. A
request for a determination by the Director shall be referred to the Director in writing. Ifsending

Re: Availability of Compensatory Wetland Credits
Project: Royal Creek
We are providing this letter in accordance with 33 CFR §332.8(r), to confirm that 2.83 Riparian Wetland Credits
(Credits) from the Pancho Mitigation Bank (Bank) are currently available and all or a portion may be used, once
transferred, for compensatory mitigation relative to the Royal Creek project, and as proposed by Cambridge-FV, LLC
(Applicant).
The Applicant may ultimately purchase the Credits, if they are available, following Permit issuance. Should the
Applicant purchase the Credits at that time, we will complete and execute the Compensatory Mitigation
Responsibility Transfer Form (Transfer Form) within five (5) days of receipt of the full purchase price.
We will additionally provide copies of the completed and executed Transfer Form to the Applicant, the Bank's US
Army Corps (USACE) Project Manager and, if needed, other regulatory agencies. In addition, we will provide USACE
with an updated copy of the Bank's Ledger, reflecting the transaction. Transaction information in the updated Bank
Ledger will include relevant Permit and Applicant information as well as the number and resource type of the debited
Credits.
