Division of Water Quality (DWQ) on August 17, 2004. After reviewing your application, we have decided that the proposed impacts are covered by General Water Quality Certification Number GC3402. The Certification(s) allows you to use Nationwide Permit 39 when issued by the US Army Corps of Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and water supply watershed regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification (or Isolated Wetland Permit) are met. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities,.including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures within Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 6. Mitigation As indicated in your application, these wetland impacts will be mitigated by restoration of 0.25 acres of previously filled wetlands on the site (existing unauthorized fill); as well as the purchase. of one acre of wetland restoration credit from the NC Ecosystem Enhancement Program (NCEEP). The on- site restoration efforts must be initiated prior to resumption of work on the site. For the first year, monitoring of the restoration site must be conducted semi-annually and the appropriate reports submitted to DWQ and the USACE. Subsequent monitoring reports must be submitted annually. It has been determined by this Division that mitigation through the NCEEP is acceptable for the balance of the mitigation requirement. Until the NCEEP receives and clears your check (made payable to: DENR, Ecosystem Enhancement Program Office), no impacts specified in this Authorization Certificate shall occur. The NCEEP should be contacted at (919) 733-5208 if you have any questions concerning payment into this restoration fund. You have one month from the date of this authorization to make this payment. This Authorization Certificate authorizes payment in to the Wetlands Restoration Fund to meet the following compensatory mitigation requirement: Compensatory Wetland Mitigation Required 1.0 Acre River and Sub-basin Number 030616 Please provide a copy of the invoice/receipt you receive from the NCEEP as proof of payment. Violation of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. The Naylors wish to keep a portion of wetland fill on site and are in the process of applying for an after-the- fact Nationwide 39 Permit and 401 Water Quality Certification for these impacts. The Tarheel Campground site is approximately 1.29 acres in size and is located off of White Lake Drive in White Lake, MC (Figures 1 and 2). The Naylors propose to-restore-10,880 f 2 (0.25 ac) of wetlands on site by removing fill material and matching elevations to surrounding wetland grade. This area will then be planted with an annual grass seed to stabilize the soil. 2.0 Site Description Prior to the violation, almost half of this site had previously been developed and contained a small circular road and several trailer sites on the western half of the property. The remainder of the site consisted entirely of 404 wetlands, which now contains several feet of fill material. Soils within the site are classified as Kureb sand in the uplands and Croatan muck in the wetlands (Figure 3). Vegetated wetlands adjacent to the site contain species typical of a pocosin, such as pond pine (Pinus serotina), loblolly bay (Gordonia lasianthus), and red bay (Persea borbonia). 3.0 Restoration Within the site, approximately 10,880 f' of wetlands will be restored by removing fill material from the eastern section of the site (Figures 4 and 5). This material will be placed on top of the fill that the Naylors wish to keep in place. These restored areas will be graded to the elevation of adjacent undisturbed wetlands and then planted with an annual grass seed. Woody vegetation will be allowed to recruit naturally onto the site from adjacent areas. r' To mitigate for the remainder of the wetland impacts (0.47 acre), the Naylors plan to buy into the Environmental Enhancement Program. With the consent of the EEP, the Naylors will make a payment of $12,276 to restore one acre of non riparian wetlands within the Cape Fear River Watershed (Hydrologic Unit #03030005). This is a 2:1 mitigation to impact ratio. 4.0 Monitoring Monitoring will occur annually for up to five years (if the agencies determine the site to be successful prior to five years, monitoring will discontinue). Each monitoring event will include taking photographs of the restored wetlands and preparing a short narrative that describes site conditions. (Because of the small size of the wetland restoration area, hydrological monitoring will not occur.) This information will be submitted to the Corps and DWQ no later than April l' of each year. If it is determined that the area has not successfully been restored to wetlands, appropriate contingency measures agreed upon by the applicant and the agencies will be implemented. 5.0 Implementation Schedule Wetland restoration will commence as soon as the ACOE and DWQ have an opportunity to review and approve this document. 4 OF \ NA r?? The property currently has several trailer homes on it and fill material within the remaining undeveloped section (404 wetlands). To rectify this violation, the applicant plans to remove 0.25 acre of this fill using a backhoe. This material will be placed on top of the fill that he proposes to keep in place. Restored areas will be planted with an annual grass for temporM stabilization. 11. Explain the purpose of the proposed work: To build several pads for trailer homes and to mitigate for wetland fill. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. The 404 wetland line was not delineated prior to fill placement. A meeting with Jennifer Frye of the U.S. AM Corps of Engineers and Ken Averitte of the Division of Water Quality on 8/4/04 resulted in the establishment of an approximate wetland boundary that will be used to determine overall wetland impacts. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No additional permit requests are anticipated for this site. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water,- and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, 'mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. The Naylors wish to keep a portion of wetland fill on site and are in the process of applying for an after-the- fact Nationwide 39 Permit and 401 Water Quality Certification for these impacts. The Tarheel Campground site is approximately 1.29 acres in size and is located off of White Lake Drive in White Lake, NC (Figures 1 and 2). The Naylors propose to restore 10,880 ft2 (0.25 ac) of wetlands on-site by removing fill material and matching elevations to surrounding wetland grade. This area will then be planted with an annual grass seed to stabilize the soil. 2.0 Site Description Prior to the violation, almost half of this site had previously been developed, and contained a small circular road and several trailer sites on the western half of the property. The remainder of the site consisted entirely of 404 wetlands, which now contains several feet of fill material. Soils within the site are classified as Kureb sand in the uplands and Croatan muck in the wetlands (Figure 3). Vegetated wetlands adjacent to the site contain species typical of a pocosin, such as pond pine (Pinus serotina), loblolly bay (Gordonia lasianthus), and red bay (Persea borbonia). 3.0 Restoration Within the site, approximately 10,880 ft2 of wetlands will be restored by removing fill material from the eastern section of the site (Figures 4 and 5). This material will be placed on top of the fill that the Naylors wish to keep in place. These restored areas will be graded to the elevation of adjacent undisturbed wetlands and then planted with an annual grass seed. Woody 3 To mitigate for the remainder of the wetland impacts (0.47 acre), the Naylors plan to buy into the Environmental Enhancement Program. With the consent of the EEP, the Naylors will make a payment of $12,276 to restore one acre of non riparian wetlands within the Cape Fear River Watershed (Hydrologic Unit #03030005). This is a 2:1 mitigation to impact ratio. 4.0 Monitoring Monitoring will occur annually for up to three years (if the agencies determine the site to be successful prior to three years, monitoring will discontinue). Each monitoring event will include taking photographs of the restored wetlands and preparing a short narrative that describes site conditions. (Because of the small size of the wetland restoration area, hydrological monitoring will not occur.) This information will be submitted to the Corps and DWQ.
