Dear Mr. Stone:
On August 11, 2004 at your request, I conducted an on-site determination to review a channel located on
the subject property for applicability to the Neuse Buffer Rules`?15A NCAC 2B .0233). The channel is
labeled as "A" on the attached map initialed by me on August 12, 2004. Division of Water Quality
(DWQ) Staff from the Central Regional Office (Bob Zarzecki) had previously conducted an on-site
determination of the stream. In your letter to the Director dated June 25, 2004, you requested an appeal of
their determination as provided within 15A NCAC 02B .0233(3)(a).
At your request, I conducted an appeal of their determination as stated above. During my review I
evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach "A" and
determined the channel to be subject to the buffer rules since at this location it is at least intermittent".
The DWQ has determined that the stream labeled as "A" on the attached map is at least
"intermittent" and is subject to the Neuse Buffer Rule. This determination shall replace the
determination originally performed by DWQ. This stream and its associatedbuffers should be identified
on any future plans for this property. The owner (or future owners) should notify the DWQ (and other
relevant agencies) of this decision in any future correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. If you have any additional questions or require additional information regarding possible
permitting of this site, please call Bob Zarzecki or me at [phone]. This determination is subject to
review as provided in Articles 3 & 4 of G.S. 150B.

Glenaire, a continuing care retirement community, is located close to downtown Cary at the intersection of
Kildaire Farm and Cornwall Roads. We propose a building expansion to include a Wellness Center and
swimming pool to better care for our residents. It is critical that these expanded services be accessible to all
the residents, those in Health Care (assisted living and skilled nursing) as well as the more independent
residents in the apartments and cottages. The therapeutic benefits of fitness programs, especially aquatic
exercise, for older adults are well known. The location chosen for the expansion is between the two resident
populations -- ideal for our purposes but, practically speaking, the only realistic option.
This proposed expansion will impact a drainageway which has several tributaries around several of our
existing buildings. Unfortunately, there is no other site within the development that meets the above
criterion. On Friday, June 25, 2004, Mr. Bob Zarzecki with the Wetlands/401 Unit met with us on the site to
review and classify the drainageway. He concluded that the drainageway is an intermittent stream and
therefore requires a fifty foot Neuse Buffer. This buffer would significantly impact our proposed, building
expansion. Mr. Zarzecki was very thorough and helpful, butl?e of the importance of his jugment and
its impact on the proposed expansion, we wish to appeal his on-site derisim and request another review and
determination as soon as possible.
