This approval allows you to: 1. Dredge a 53' x 121' area (to an average depth of 7.3' MLW) adjacent to the ICWW for the purpose of navigation and docking at existing fixed and floating dock, and place the 951 cubic yards of spoil material at the approved upland disposal site. This approval is only valid for the purpose and design that you described in your CAMA Major application received by the Division of Water Quality (DWQ) on August 9, 2004. After reviewing your application, we have determined that General Water Quality Certification Number 3400 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non Discharge and Water Supply Watershed regulations, NPDES and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your revised CAMA Major Permit application received by the Division of Coastal Management on June 25, 2004. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application fora new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with conditions hereinafter set forth. Conditions of Certification: 1. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. In accordance with 15A NCAC 21-1.0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required for a project, the mitigation plans must be approved by DWQ in writing before the impacts approved by the Certification occur. The mitigation plan must be implemented and/or constructed before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public; WQC #3400 The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity that requires written concurrence under this certification, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. PROJECT SUMMARY: The applicants propose to conduct dredging of basin within the AIWW to enhance navigation and docking adjacent to their properties. . Creech and Boyte Page 2 9.PROJECT DESCRIPTION The proposed project is located within the AIWW adjacent to the island of Holden Beach in Brunswick County. The site can be reached by traveling on NC HWY 17 south towards Holden Beach. Travel straight through the intersection of NC HWY 17 and NC HWY 211, and continue past Brunswick Community Hospital. Just past the hospital, look for Mt. Pisgah Road and prepare to make a left turn across the highway. This turn appears just about at a veterinary clinic. Travel Mt. Pisgah Road/NC HWY 130 south until the road turns sharply toward the left at a Citgo gas station. Continue along HWY 130 to the traffic signal, and make a right turn onto the causeway and cross the bridge to Holden Beach. At the bottom of the bridge, turn left onto Ocean Blvd East. Make an immediate left turn onto Quinton and go straight to South Shore Drive. 105 and 107 South Shore Drive (SSD) will be just to the left. The proposed dredging would take place in front of these two lots. The project is located near a, residential area in proximity to the Holden Beach Bridge. There are marina and seafood businesses in close proximity to the project area. There is an existing house on 107 SSD and a house under construction on 105 SSD. The area is served by the Brunswick County water system. On site septic systems currently handle wastewater treatment, although the Town of Holden Beach is currently installing a municipal sewer system. The high ground area is composed of sandy soils. The developed property (107 SSD) is maintained as lawn area; 105 SSD is largely devoid of vegetation due to construction of the house. What is left consists of primarily weeds and lawn grasses. An existing bulkhead runs along each property separating the high ground from the AIWW. Saltmeadow cordgrass (Spartina patens) extends from the bulkhead out 15 - 20 feet, and then a fringe of smooth cordgrass (Spartina alterniflora) extends another 30 feet to the water. The wetland substrate is sandy and contains bits of shell and vegetative matter. Within the waterway where the dredging is proposed, bottom sediments consist of silty sand '(70% sand, 30% silt). Just west and across from the project site are marina/seafood businesses that have recently dredged within the AIWW. There is an existing pier and dock facility at 107 South Shore Drive. The pier is 42' x 5' and terminates in a 8' x 14' fixed dock. A 8' x 14' floating dock is located adjacent to the fixed dock its west side. The width of the waterbody at this location is approximately 400 feet. The waters of the AIWW at this location are classified SA by the N.C. Division of Water Quality. The AIWW is closed to the taking of shellfish. The site is not located within a primary or special secondary nursery area. PROPOSED PROJECT The applicants propose to conduct new dredging in a 53' x 121' area of the AIWW adjacent to their properties to provide deeper water to enhance navigation and docking for their personal use. The area to be dredged is located within the 80 foot AIWW setback, and would be excavated to an average final depth of 7.3 MLW. After dredging the bottom would slope from the landward existing depth of 1.3' MLW to 13.8' MLW towards the AIWW channel. The current water depth near the channel is 11.4' MLW. From here depths continue to grade toward AIWW project depth. Approximately 951 cubic yards of sand (70%) and silt (30%) would be excavated by bucket and barge. The material would be hauled by dump truck and placed in an upland disposal area located on the mainland a short distance from the site (behind Fulfords on the causeway at 3461 Holden Beach Road/NC HWY 130). The disposal area has recently been approved and used for other dredging projects in the area. The disposal site has sufficient capacity for this project. Creech and Boyte Page 3 10. ANTICIPATED IMPACTS With this proposal, 6413 sf of estuarine bottom area would be converted from an average depth of 3.5' MLW to a depth of 7.3'MLW. Short term increases in turbidity in adjacent areas can be anticipated during dredging. Dredging should be timed to avoid periods of peak biological activity to minimize impacts on marine resources.
