Dear Mr. Deming
The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form, and additional information
which we received on November 5, 2019. The Division is unable to concur with your certification of no
exposure.
Based on an inspection of your facility, Washington Regional Office staff found that industrial activities or
materials on your site either are exposed or have the potential to be exposed. The Division cannot grant
your requested exemption from permit coverage when industrial activities or materials are exposed or
have the potential to be exposed.
Denial of this no exposure certification requires you to obtain coverage under a NPDES stormwater
permit (NCG06 - Food & Kindred products). It is our understanding that the application for this operation
is being currently processed. If this is not correct, please make sure to apply for the coverage under this
permit.
