After reviewing your application, we have determined that the Divikion of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water iI acts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USAGE). In addition, you should get or otherwise comply with any other federal, state find local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire, upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h). Water Quality Certification The proposed project must comply with all of the conditions of General Water Quality Certification (GC) 3351. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. FIELD INVESTIGATION REPORT Rivers End Development Corporation Project Name: Rivers Bend Condominiums Page 2 PROJECT SETTING The site of the development proposal is located east of the intersection of Ward Street and Poindexter Street in Elizabeth City,_Pasquotank County, and adjacent to the Pasquotank River. The property was once part of a large grain elevator with rail and barge shipping capabilities. The railroad yard was removed and the grain elevator demolished and the property subdivided. The applicant's property is the site of a condominium complex under construction, authorized by CAMA Minor Permit #070102A. The property has an elevation of approximately 7 feet above the Normal Water Level (NWL), and is vegetated with indigenous grasses and weeds. The property has approximately 212 feet of shoreline protected by a bulkhead. The adjacent riparian property to the north is a ball field for a nearby college, and the property on the south is a condominium complex with docks. The waters of the Pasquotank River in this area are classified as SC and are closed to shellfish taking. DEVELOPMENT PROPOSAL In order to provide docking space for the condominiums currently under construction, the applicant proposes to construct a 10-slip docking facility. The structure will consist of a 59-feet -long and 6=feet wide pier with a 60-feet long and 6-feet wide T-head. A 10-feet wide and 24-feet long platform is proposed to be constructed at the right wing of the T. Eleven mooring pilings and four, 4-feet wide and 12=feet long finger piers- are proposed for the 10 slips. The water depths in the area of development range from -4 feet to -15 feet. Approximately 5 feet of the pier will be over land at the pier entrance. ANTICIPATED IMPACTS The development proposal will result in the shading of approximately 1,050 square feet of Public Trust Area and 30 square feet of Public Trust Shoreline Areas of Environmental Concern. Temporary water turbidity will occur during construction. The structure will be located approximately 140 feet from the edge of the channel of the Pasquotank River. Submitted by: Frank A. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit mist cease until the appeal is resolved.
