Mitigation 0WQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Impact Justification The single house has been placed on two lots, both of which contain wetlands, which reduces the impact compared to building two houses, one on each lot. Subdivision covenants require that garage doors not face subdivision streets. The setback requirements are 30 feet from the street for both lots. In order to comply with both these requirements, the southeast corner of the garage has been placed on the setback line and the driveway that allows the garage to function for its intended purpose, parking of vehicles, requires a turning radius which consumes non-wetland area. The non-wetland area is further limited by the 50' x 50' utility area that is not part of the property, but protrudes into lot #41. The home that is to be constructed is similar in size to the homes immediately to the west of lot #41 and to the homes across the street to both the south and east. Because of the curve of the street and the resulting curved setback lines plus the shape of the wetlands, moving the house and driveway to the north or south would place more of the house in the wetlands which would increase the impact to the wetlands. The placement as proposed on the attached site plan appears to be the best to keep the wetland impact to a minimum.
