Thank you for contacting me today via telephone, to discuss this project. During our conversation, we specifically
discussed the information you provided below, on December 9, 2019. The application is still incomplete and we will
need additional information. Please provide:
1. A plan view map showing the specific wetland area you propose to impact. Impact area should be shown with some
form a cross hatching pattern. We need to have the exact area you plan to impact (approximately 0.98 acre or 610' x 7')
clearly marked on a plan view map. You may be able to contact the consultants who originally delineated the wetlands
and ask if they can provide the digital files for this wetland.
2. Mark the location where the relocated soils will be deposited on the wetland map (attached).
3. Regarding the pond that appeared to be previously located adjacent to wetland EE: During our telephone
conversation today, you provided a detailed history of the site. Please provide that in your response to this email.
Please provide the requested information within 30 days, or your application will be withdrawn. Feel free to contact me

NOTIFICATION
Mr. Martin:
The Pre -construction notification (PCN) for the proposed Annex Storm Water Drainage Repairs Project (SAW-2019-
01996), received on November 19, 2019 is incomplete. You were notified on November 24, 2019 that the Corps file
number was SAW-2019-02249. However, due to our previous involvement with the project, it was assigned the Corps
file number SAW-2019-01996 in October 2019.
In order for us to continue evaluating the proposed project, please provide the following information:
1. A plan view map showing the specific wetland area you propose to impact. Impact area should be shown with some
form a cross hatching pattern.
I have attached the wetland map which areas are shaded. We have water backing up causing ponding on driveway in
all areas marked EE. I have also included a screen shot of satellite view with areas shown with blue trace. This has all
been submitted in prior correspondence so if not satisfactory will need further clarification on requirement.
2. Condition #23 (a) of Nationwide Permit #39 states, 'The activity must be designed and constructed to avoid and
minimize adverse effects, both temporary and permanent, to waters of the United States to the maximum extent
practicable at the project site'. As such, please indicate why all 0.18 acres of Wetland EE must be impacted in order to
meet the purpose of the project (direct water under existing driveway).
The full area will not be, and submission was drafted on worst case impact. Total linear footage is roughly 610 and
disturbed soil can be kept to <= 7' width.
The exact area at 7279 Liberty Park Avenue, Liberty, NC where the relocated soil will be deposited.
There are several areas at our adjacent vacant site [7280 Liberty Park Ave] where dirt can be used as fill. I have place
red marks to indicate
I areas.
3. Based on your plans, rip rap will be placed within 0.18 acre of wetlands. Condition #23(c) of Nationwide Permit #39
states, "Compensatory mitigation at a minimum one -for -one ratio will be required for all wetland losses that exceed
1/10 acre and require pre -construction notification. As such, please submit a compensatory mitigation plan for the loss
of 0.18 acre of wetlands. Typically, for forested wetlands, the Corps requires compensatory mitigation at a 2 for 1 ratio,
unless the applicant provides a completed North Carolina Wetland Assessment Method (NCWAM) for the wetland
proposed for impacts, indicating the wetland has overall low function.
I feel we can back the estimate down to 1/10 acre based on the above comment. We are only interested in clearing
enough area to promote flow in existing man-made drainage system, and should have no problem keeping disturbed
width <=7' and 610 linear ft.
33 CFR part 332.3(b) Type and location of compensatory mitigation states, "When considering options for successfully
providing the required compensatory mitigation, the district engineer shall consider the type and location options in the
order presented in paragraphs (b)(2) through (b)(6). This order is as follows:
1. Mitigation bank credits
2. In -lieu fee program credits
3. Permittee-responsible mitigation under a watershed approach 4. Permittee-responsible mitigation through on -site
and in -kind mitigation 5. Permittee-responsible mitigation through off -site and/or out -of -kind mitigation
4. The 2017 Wilmington District Regional Condition 4.11 states, discharges in perennial streams, intermittent streams
and wetlands for stormwater management facilities are prohibited under Nationwide permit #39. Please verify whether
or not the impacted wetlands will be utilized as a stormwater management facility.
This will not serve as storm water management facility. There is no intent on redirecting or adding discharge points.
Scope is only to restore flow as it was originally designed based on visual appearance with existing culverts placed by
previous owners.
5. Based on a review of aerial photographs, it appears a pond was previously located adjacent to wetland EE. Aerial
photographs indicate the pond was either drained or filled sometime between 1999 and 2005. Please provide
information regarding specific impacts that occurred to the pond during that time in order to help us establish if there
were any previous impacts to waters of the United States at this site.
This site was purchased in 2010, so I unfortunately have no history nor knowledge of impact of the pond backfill work
you referenced
