I agree that as long as you follow the trout moratorium this would qualify under NWP 3 as a non -notifying project. As
such, the activity is authorized to proceed under non -notifying NWP-3 without further correspondence from this
office. No need to do anything with the permits already issued. This email will be filed in our record to document that
the impacts authorized by the NWP 3 verification letter dated 9/16/2019 will no longer be conducted and instead the
impacts described below in this email will.

Good Morning Crystal/Kevin,
Originally our project maintenance crews were going to replace the existing deteriorated 75' pipe with a 75' x 60"
corrugated metal pipe, without any wetland impacts or the need to remove any trees, which would have qualified for
non -notification permitting. However, this would have involved closing Hwy. 106 for a 24 hour period to replace existing
culvert. At that point NCDOT had funding to contract a directional bore of 2 - 48" pipes to fix the deteriorating culvert
and our office applied for permitting due to the boring operations would need to temporary impact wetlands and we
would need to remove several trees. Our office was notified Monday that NCDOT does not have the funds to complete
the bore and the existing culvert will need to be replaced much sooner that budget issues will be resolved. Mr. Mark Hill
with Macon County Maintenance would like to replace the existing 75' CMP with a 75' x 60" CMP as originally
determined, prior to permitting, and HWY. 106 will be closed for a 24 hour period while replacement takes place. We
understand there will be a full trout moratorium and replacement work cannot commence until April 16, but there will
be no temporary wetland impacts nor any trees removed and the pipe will be embedded 1 ft. What are your thoughts as
far as permitting, since going with the initial plan to replace would have met the non -notification requirements?
Maintenance crews plan to replace pipe on or around April 16t", 2020. 1 have attached the 404 and 401 permits we
received and I have attached the hydro report showing a 54" CMP would be sufficient, however, due to the 1ft.
embedment a 60" CMP will be needed. Do we need to complete a permit modification? Or cancel the current permits
and adhere to the non -notification guidance? Your thoughts please.
