Explain the purpose of the proposed project: The purpose of the proposed project is to provide access and construct Phase 2 of the Cambridge Park residential subdivision. 3e. Describe the overall project in detail, including the type of equipment to be used: The overall project consists of the development of Phase 2 of the Cambridge Park residential subdivision. At this time, Phases I A and 1 B have been constructed and Phase 2 has been fully designed. With the exception of Phase 7, the remainder of the residential subdivision has been conceptually designed. At this time, Phase 7 has not been conceptually designed. With the exception of Phase 7, it appears the remainder of residential subdivision can be developed without future impact to WoUS outside of those proposed in this application. The applicant understands that additional impacts associated with the remaining phases of the proposed subdivision will be cumulative for purposes of permitting and mitigation requirements. Phase 2 of the site consists of developing the site with residential lots, one stormwater retention pond and associated roads. Access roads and residential lots will result in impact to streams and wetlands. To facilitate development of the site, clearing and grading the site is necessary. The applicant is aware that impacts are cumulative for permitting and mitigation thresholds for potential future impact to WoUS. However, the applicant is not ready to proceed with Phase 7 of the subdivision or permit potential impacts associated with Phase 7 at this time. Establishment of a timeline for future phases of development will be dictated by market conditions at that time. We request the NCDEQ-DWR conditional 401 approval without receipt of the buffer authorization. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The road crossing location was selected in an area of stream that is relatively straight with few meanders and will cross as near to perpendicular as possible given field and design constraints. The applicant has further demonstrated avoidance and minimization of stream impacts by proposing to construct approximately 5.5 feet tall culvert head/end walls. Furthermore, the Applicant has designed rip -rap stabilization measures to be keyed into existing grades of stream bed and banks, thus reducing the net loss of stream. There are approximately 9,020 linear feet of stream channel and 0.22 acres of wetlands located on the site. Phase 2 has been designed to avoid the remaining 8,896 linear feet of stream channel and 0.13 acres of wetlands. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and silt fence will be used. A Temporary coffer dam will be installed up -gradient of the proposed road crossing. During construction, water will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the stream bank crossing area. Upon installation of the culvert, the temporary sand bag coffer dams will be removed and flow will be diverted through the culvert. Disturbed banks will be restored to similar pre -construction conditions, matted and seeded/live staked. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. SIGNIFICANT NEXUS DETERMINATION A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and biological integrity of a TNW. For each of the following situations, a significant nexus exists if the tributary, in combination with all of its adjacent wetlands, has more than a speculative or insubstantial effect on the chemical, physical and/or biological integrity of a TNW. Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow of water in the tributary and its proximity to a TNW, and the functions performed by the tributary and all its adjacent wetlands. It is not appropriate to determine significant nexus based solely on any specific threshold of distance (e.g. between a tributary and its adjacent wetland or between a tributary and the TNW). Similarly, the fact an adjacent wetland lies within or outside of a floodplain is not solely determinative of significant nexus. Draw connections between the features documented and the effects on the TNW, as identified in the Rapanos Guidance and discussed in the Instructional Guidebook. Factors to consider include, for example: • Does the tributary, in combination with its adjacent wetlands (if any), have the capacity to carry pollutants or flood waters to TNWs, or to reduce the amount of pollutants or flood waters reaching a TNW? • Does the tributary, in combination with its adjacent wetlands (if any), provide habitat and lifecycle support functions for fish and other species, such as feeding, nesting, spawning, or rearing young for species that are present in the TNW? • Does the tributary, in combination with its adjacent wetlands (if any), have the capacity to transfer nutrients and organic carbon that support downstream foodwebs? • Does the tributary, in combination with its adjacent wetlands (if any), have other relationships to the physical, chemical, or biological integrity of the TNW? On November 7, 2017, at your request, Sue Homewood conducted an on -site determination to review features located on the subject project for stream determinations with regards to the above noted state regulations. David Bailey with the US Army Corps of Engineers was also present during the site visit. The Division acknowledges the areas and boundaries identified as jurisdictional wetlands by the USAGE. The attached sketch accurately depicts all stream determinations conducted during the site visit.
