Dear Permittee:
The North Carolina Division of Water Resources issued a sewer extension permit for the construction of the
project's system on December 5, 2018 pursuant to the application received on November 9, 2018. An engineering
certification using the incorrect form was submitted to and received by our Central Office in Raleigh on October 30,
2019 which was subsequently forwarded to our office on November 22, 2019. The submittal package was
reviewed for completeness that same day and found to be lacking more than one required item. An attempt to
contact the design and certifying engineer was attempted via email on that same day, as well as, via a voicemail
around the same timeframe but was never heard from.
The Onslow County building inspections department was contacted on November 26th to determined what the
status of the store's completion was and was notified that a Certificate of Occupancy had been granted on
September 30, 2019 and that the store was likely in operation.
Standard Permit Condition II.7 in the issued permit requires submittal of a complete engineering certification prior
to placement of the system into operation. The status of receipt of the certification and its processing is available
via a report obtained online through the Division's website. Obviously your company and the certifying engineer
failed to submit the certification prior to seeking a Certificate of Occupancy and to follow through with the process
of verification of receipt by the Division prior to doing so and placement into operation. Thus, Circle K Stores Inc
is in violation of its permit and to date the system's complete certification package has yet to be received and
processed by our office.

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's permit. Pursuant to G.S. 143-215.6A, a civil penalty of not more
than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act
in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
If you wish to provide additional information regarding the noted violation, please respond in writing within ten (10I
business days after receipt of this Notice. A review of your response will be considered along with any additional
information provided. You will then be notified of any civil penalties that may be assessed regarding the violation.
If no response is received in this Office within the 10-day period, a civil penalty assessment will likely
be prepared.
