Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant has designed the proposed residential sub -division to avoid other impacts to streams and wetlands. The remaining roads, utility lines and lots/pads have been designed to avoid additional impacts to streams and wetlands. The applicant has designed the stream crossing in a relatively straight reach of the stream that does not contain adjacent wetlands. The portion of the stream being impacted is intermittent and has been dry during our site visits. The stream quality improves down -gradient of the proposed crossing location. The crossing was desinged in a reach of the stream that is of lower quality compared to other waters located on -site. The remaining 6,414 linear feet of stream and 0.902 acres of wetlands are being avoided. Additionally, the applicants engineers have tried several alternatives to cross the stream perpendicular or avoid it altogether. The owners have tried to aquire a small, triangular parcel of land directly east of the site so the road could be built in that location. The owner of this tract was not willing to sell, even with a very generous offer. The engineer looked at shifting the new road's intersection with Morgan road westward, to allow a more perpendicular stream crossing. Shifting the road this direction wouldn't allow the road to meet NCDOT's vertical sight distance, creating an unsafe intersection. Given the constraints, the engineer was able to design a crossing that includes a net loss of less than 150 linear feet of stream channel with culvert and sideslope fill. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and silt fence will be used. Temporary coffer dams (impervious dikes) will be installed up - gradient and down -gradient of the proposed culvert. During construction, water (if present) will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the stream bank crossing area. The rip rap is being keyed in to further minimize the impacts to the stream. The rip rap has been sized to minimize the length of stream impact. Upon completion of the culvert installation, the temporary coffer dams (impervious dikes) will be removed and flow will be diverted through the culvert. We consulted the USFWS Website to determine if federally protected endangered or threatened species inhabit Stanly County, NC. The Bald Eagle is listed as a federally protected species. There are no waterbodies located on the site or nearby properties that provide habitat for this species. The proposed project will not disturb the bald eagle. The Northern Long-eared Bat is listed as a federally protected threatened species. Hibemacula is not located in the vicinity of the project area. Additionally, the project area is not known to occur within 150 feet of a known summer roosting tree based on the most recent publically available information from the USFWS. Potential summer roosting habitat is present on the site, although msany of the trees had been recently cleared during our most recent site visit. At this time, it has not been determined if additional tree removal activities will be conducted during the summer. If tree removal activities do not occur between May 1 through August 31, then it's our opinion that the proposed project is not likely to adversely affect the NLEB. If tree removal activities, associated with site development, occur between May 1 and August 31, then the developer meets the criteria of the final 4(d) ruling for NLEB and any associated take would be considered exempt from Section 7 requirements of the ESA, assuming the associated take is not prohibited intentional take. Schweinitz's sunflower is listed as a federally protected endangered species. We did not observe this species or potential habitat for this species on the site. 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as essential fish habitat? ❑ Yes ® No 6b. What data sources did you use to determine whether your site would impact Essential Fish Habitat? Based on our knowledge of the site, the site is not located in or near an area designated as essential fish habitat. The stream that is being impacted is intermittent and was dry during our site visits. Fish habitat is not present.
