APPROVAL for the use of the "General" MAJOR VARIANCE; From the Neuse and Tar-Pamlico
Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the
Coastal Counties as defined by the Coastal Area Management Act with Additional Conditions
Dear Mr. Sadler:
You have our approval, in accordance with the conditions listed below, to impact approximately 1,616
square feet (ft2) of Zone 2 of the protected riparian buffers for c purpose of removing an existing single-
wide mobile home and shed and constructing a new residential'dwelling on the subject property as
described within your application dated August 13, 2004. This letter shall act as your approval for the use
of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the
Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the
Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality
Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In
addition, you should get any other required federal, state or local permits before you proceed with your
project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval
shall expire when the variance expires on April 11, 2006 unless the variance is renewed before that time
by the EMC.
This approval is for the purpose and design that you described in your variance request. If you change
your project, you must notify us and you may be required to send us a new request for approval. If the
property is sold, the new owner must be given a copy of this approval and is thereby responsible for
complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:
1. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality
Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is
required to return the attached certificate of completion to the 401Wetlands Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
2. Diffuse Flow - All new stormwater drainage shall be directed to vegetated areas as diffuse flow at
non-erosive velocities prior to entering the protected riparian buffers as identified within 15A
NCAC 2B .0233(5). No new ditching or piping of stormwater through the protected buffers is
allowed.

3. Protective Fencing - The construction corridor approved under this authorization shall be clearly
marked with orange warning fencing (or similar high visibility material) for the areas that have
been approved to infringe within the buffer prior to any land disturbing activities to ensure
compliance with 15A NCAC 2B .0233 and this variance approval.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer

Approval of 401 Water Quality Certification (GC3351) with Additional Conditions
Dear Messrs. Tuthill and Clements:
You have our approval, in accordance with the attached conditions, to shade 0.095 acres of
waters to construct a bridge to access a single-family residential lot as described in your
application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on June 28,
2004. After reviewing your application, we have determined that the Division of Water Quality
(DWQ) General Water Quality Certification Number 3351 covers these water impacts. This
Certification allows you to General Permit No. 198000291 when issued by the US Army Corps
of Engineers (USACE). In addition, you should get or otherwise comply with any other federal,
state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations and LAMA. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application
shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the

PROJECT SETTING
This proposal involves a request to authorize the construction of a 344-feet long, 12-feet wide,
wooden pile supported, elevated vehicular bridge to access an existing single-family residence
adjacent to the Pamlico, Sound. The existing home is located on a 4,760 square feet lot at the end
of Central Drive in Pamlico Sound Shores Subdivision, north of NC 12, in the village of Frisco, in
Dare County.
According to the permit application, the lot elevation ranges between the marsh elevation and 3
feet above the Mean High Water (MHW) Level. According to Dare County tax mapping
information, the lot is 56 feet wide along the Pamlico Sound and extends approximately 185 feet
northwest of the platted `paper-street' referenced as `Bay Street'.
The existing single-family residence is approximately 75 feet landward of the shoreline of the
Sound, and is approximately 400 feet northeast of the sand and gravel road intersection of Central
Drive and Myrtle Street. The area directly adjacent to the shoreline of the Pamlico Sound includes
some estuarine beach. The shoreline is vegetated with an approximately 15 to 30 feet wide
Spartina alterniflora fringe, while Spartina patens grows on the high ground estuarine beach dune
area between the house and the shoreline. The front-yard portion of the lot is almost entirely
surrounded by coastal marsh consisting of Spartina alterniflora, Spartina patens, Juncus
roemerianus, Myrica cerifera, Baccharis halimifolia, Borrichia frutescens, and Sabal palmetto.
Other than a few high ground `tuffs', this marsh area extends south toward the intersection of
Central Drive and Myrtle Street. The above referenced `Bay Street' is entirely vegetated in coastal
marsh. In addition, the end of Central Drive between Myrtle Street and Bay Street is also a `paper-
street' and is vegetated in coastal marsh. A mosquito ditch or small coastal creek is located
between the existing house and the completed end of Central Drive. This ditch intersects with a
man-made canal and basin to the west, which is adjacent to the existing Island Boat Works, Inc.,
facility. Island Boat Works, Inc., is located on the same basin and canal system that was recently
authorized for maintenance excavation.
The ditch currently is approximately 30 feet in width with no more than one foot of water depth at
the ditch's mid-point area. A footpath extends from Myrtle Street to the existing house. Currently
a small `board-type' footbridge crosses this ditch to allow pedestrian access to the existing house.
In the absence of a raised walkway, some boards and pallets are located and used along the
footpath.
This ditch crosses several properties to the northeast and the northwest. As mentioned above, the
ditch connects to the Estuarine Waters of the Pamlico Sound to the west. Small finfish and
crustaceans were observed within the ditch and wetland areas.

The waters of this ditch carry the same water classification as the Pamlico Sound. The waters of
this portion of the Pamlico Sound are designated by the Environmental Management Commission
as `SA' waters, but are currently closed to commercial shellfish harvests. These waters are
classified as Coastal Waters by the North Carolina Marine Fisheries and Wildlife Resources
Commissions. These waters also are designated by the Coastal Resources Commission as Public
Trust Area and Estuarine Waters.
No archeological sites were identified in the vicinity of the proposal site on the available Division
of Coastal Management District office mapping.
PROJECT DESCRIPTION
The permit applicant proposes to construct a 344-feet long by 12-feet wide, wooden-pile
supported, elevated bridge to allow for vehicular access to an existing single-family residence.
The proposed bridge will follow the platted subdivision `paper-street' footprint of Central Drive
until it reaches the applicants' property, where it will connect to the upland area adjacent to the
applicants' existing house on the property. The bridge will be elevated 3 feet above any wetland
areas, and will be elevated 6 feet above the MHW level of the proposed ditch crossing, as
measured from the center bents of the bridge. The bridge structure will utilize three, 12-inch
pilings across, placed on 8-foot centers with longitudinal bracing across each fourth bay of the
structure. The bridge will be surfaced with 4 by 12-inch decking, and will use 4 by 12-inch
stringers. The applicant proposes to use a small backhoe, track-hoe, or similar equipment, and
work off of construction mats to minimize impacts to the marsh area being crossed.
No upland development is proposed with this application.
ANTICIPATED IMPACTS
The proposed bridge structure will cross over 344 feet of coastal wetlands and 30 feet of Estuarine
Waters. This will result in the shading of 3,840 square feet of coastal wetlands, and 336 square
feet of shallow water habitat and Estuarine Waters that directly connect to the Pamlico Sound.
Although limited by depth, the existing ditch is navigable by canoe, kayak, and johnboat. The
proposed bridge will not limit or reduce existing drainage or tidal flows from or into this ditch.
The proposed bridge will not significantly impact Public Trust associated navigation access. This
project proposes no fill within any Public Trust Area, vegetated wetlands, or Estuarine Shoreline.
Some temporary sedimentation impacts may result from the use of construction mats and piling
installation.

Pamlico Sound Shores Subdivision Frisco, Dare County, North Carolina. ;
The construction of this bridge will allow access to the home of Mr. Bart Tuthill and
Ross.Clements. This home has been constructed and is presently occupied.
At the present time there is no access via vehicle to the home. It is the int6ntion of the
owner to build this bridge to gain access safely to and from his home while complying
with the regulations set forth by the agencies involved.
This bridge is to be constructed utilizing treated timber and hot dipped galvanized
hardware with minimal impact on the surrounding environment.

requirements and it must be sufficiently detailed to
