Fill/impact 0.03 acre of "Waters of the U.S." on a 4.75 acre tract of land for the purpose of constructing condominiums, amenities and associated parking. This approval is only valid for the purpose and design that you described in your completed 401 Express application received by the Division of Water Quality (DWQ) on July 7, 2004 and CAMA Express application dated complete as of July 14, 2004. After reviewing your application, we have determined that General Water Quality Certification Number 3400 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your completed CAMA Major Permit application received by the Division of Coastal Management on June 17, 2004 (complete as July 14, 2004). If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland impacts for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. Mr. Tom Farrell of the USACE approved the wetland survey on June 10, 2004 In 1998, Island Investments obtained a CAMA Major Permit to construct a residential boat docking and water access facility_(No 69-98• issued 5/27/98) No wetland impacts were proposed Island Investments is currently in the process of obtaining a CAMA Major Permit (express review) for the work described in this application. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No additional permit requests are anticipated on this tract. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Because impacts to Waters of the U.S. will be minimal no mitigation is proposed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. PROJECT DESCRIPTION: The proposed Regency Condominium complex is located at the intersection of Bonaparte Road and Beach Drive, adjacent to the Atlantic Intracoastal Waterway (AIWW), in the town of Sunset Beach, Brunswick County. To get to the proposed site from Wilmington, head south on US Hwy 17. At the intersection of US Hwy 17 and NC Hwy 179, turn left onto NC Hwy 179 towards Sunset Beach. Travel along NC Hwy 179 (Beach Drive) until it intersects Bonaparte Road, adjacent to the AIWW. The property will be located at the terminal end of Bonaparte Road, on the left hand side of the street (dead end). The property is approximately 540' wide x 310' long (as measured from Beach Drive). Elevation at the property varies from 5'-15' above Mean Sea Level. Commercial properties border the subject site to the west and north, while residential/commercial properties border the site to the east. The AIWW borders the property to the south. The property consists of approximately 4.75 acres and contains a small strip of maritime forest (live oaks) along the northern section of the tract. The highground portion of the tract (going from Beach Drive towards the sound) has vegetation that consists of. Live Oaks (Quercus virginiana), Catbriar (Smilax sp.), Red Cedars (Juniperus virginiana), Wax myrtles (Myrica cerifera), Long-leaf Pines (Pinus palustris), Hickory (Carya sp.) and Yaupons (11ex vomitoria). A section of coastal marsh exists along the southern shoreline (approximately 350' wide by 500' long) and consists primarily of Smooth Cordgrass Marsh (Spartina alterniora) and Black Needle Rush (Juncus roemarianus). Upper coastal wetlands species such as Salt Grass (Distichlis spicata), interspersed with Sea Lavender (Limoium carolinanum), Salt Meadow Hay (Spartina patens) and Sea Ox-eye (Borrichia frutescens) complete the transitional area to the high ground. The waters of the AIWW, adjacent to the proposed project area, are classified "SA" by the Division of Water Quality. This section of the AIWW is designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to develop the 4.75 acre tract by constructing a condominium complex with amenities such as a swimming pool and two (2) pier/docking systems. The new condominium complex would include a total of sixty (60) units and would average fourteen (14) units per acre. Condominium/building unit 1 would contain thirty (30) individual units, and would be located on the northern side of the property. Building 1 would run slightly parallel to Beach Drive. Condominium unit 2 would also contain thirty (30) individual units. Building 2 would be located on the southern side of the property, between Bonaparte Road and Beach Drive. The proposed swimming pool would be constructed along the eastern side of the property between the two condominiums/buildings. The swimming pool facility would consists of an in ground pool, concrete decking around the pool, three (3) wood decks, a hot tub and clubhouse/bath house. The parking areas for the condominium complex would be located along western side of the two condominiums/buildings. Two (2) entrances would be installed on the property to provide access in and out of the establishment. One of the drives would be located along Bonaparte Road and the other would be located adjacent to Beach Drive. In addition to the upland development, the applicant is also proposing to construct a retaining wall and two (2) community piers and one (1) docking system to accommodate the residents of the condominium complex. The retaining wall, as proposed, would be located on the high ground portion of the property landward of the "404" wetlands line. The retaining wall would extend approximately 740' in a northeast to southwest direction. Most of the retaining wall is located outside of the 75' Estuarine Shoreline AEC, however, there is a small portion (approximately 120') along the northeast corner that is within the AEC. The northern most section of the retaining wall would dog leg around the northeast corner of the high ground and run back towards Ocean Drive. George A. Sloan, III Page Three The two (2) proposed piers will be referred to as "pier 1" and "pier 2". "Pier 1" would be located on the southern most portion of the property and would extend in an easterly direction, approximately 253' from the landward edge of the "404 type" wetlands line, towards the AIWW. "Pier 1" (6'x 253') would terminate into an elevated 16' x 24' ("t-head") platform. A 12' x 16' section of the platform would be covered and the remaining section left open. "Pier 1" would be used as a fishing/recreation pier only. "Pier 2" would be located approximately 120' north of "Pier 1". "Pier 2" (6' x 266') would begin on the landward side of the "404 type" wetlands and would also extend in an easterly direction towards the AIWW. "Pier 2" would also terminate into an elevated 16' x 24' ("t-head") platform, part of which would be covered (12' x 16'). Two (2) 4' x 4' step out platform sections would be located on both the western and eastern sides of the proposed platform. The 4' x 4' platforms would be used to access the two (2) floating docks/spines. A 6' x 63' section of floating dock (spine) would be located on the western side of the platform. This section of floating dock would run perpendicular to the pier and would provide access to two (2) 6' x 18'finger docks. The finger docks would run parallel to the pier and would extend in a southerly direction towards the AIWW. Another floating dock (spine) would be located on the eastern side of the platform. This section of dock (6' x 80), would also run perpendicular to the pier and would provide access to three (3) 6' x 18' finger docks. The finger docks would also run parallel to the pier and would extend in a southerly direction towards the A1WW. Both piers and/or docking systems would be located on the landward side of the U.S. Army Corp of Engineers 80' setback line. 10. ANTICIPATED IMPACTS The construction of the proposed access road into the subdivision, driveway access, and the grading of the property for lot preparation, would result in the disturbance of approximately 167,400 sq ft (3.84 acres) of high ground. The proposed piers and docks would incorporate approximately 4,386 sq ft of estuarine waters and public trust area. The area of disturbance resulting from the construction of the bulkhead would be the same as the lot grading and preparation. These two areas overlap, and as such, no calculations were included for bulkhead disturbance. Total impervious surface coverage within the 75' Estuarine Shoreline AEC would be 0.0%. The applicant has received a State Stormwater Permit from the Division of Water Quality (Permit No.SW8040424). The applicant has also obtained a Sedimentation and Erosion Control Plan from the Land Quality Section (Permit No. Bruns 2004-300) for all land disturbance activities. A silt fence or berm must be installed and inspected by Division of Coastal Management personnel prior to commencing any dredging work. The permitee must install and maintain, at his expense, any signal lights and signals prescribed by the US Coast Guard through regulations or otherwise, on authorized activities. 4. The alignment of the proposed bulkhead and/or placement of rip-rap, must be staked by a representative of the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather conditions will require the alignment to be re-staked by DCM within a maximum of thirty (30) days prior to the new expected start of construction. All unconsolidated material resulting from associated grading shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover 6. The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) working days of project completion. 7. Future development on the permittee's property may require a modification of this permit. Contact a representative of this Division at (910) 395-3900 prior to commencement of any such activity for this determination. 8. The Regency consists of two (2) condominium buildings and a large pool. Each building will consists of 30 condominium units. Parking lots are provided adjacent to the buildings and under the buildings. The condominium buildings will be built on steel piles. Development of The Regency will be accompanied with curb and guttered parking areas with catch basins/drop inlets and piping. Three (3) infiltration basins and four (4) infiltration trenches have been engineered for treatment. Each of the engineered BMP's is designed to store the required one and a half (1.5) inches of runoff: The site is adjacent to the Intracoastal Waterway and will require up to six (6) feet of pill in some areas. A bulkhead /retaining wall is proposed around the southern and eastern project building limits. The bottoms of all the proposed engineered infiltration BMP's are at or below the project areas existing grade elevations. The seasonal high water table is at a minimum two (2) feet below the bottoms of each of the infiltration devices. The infiltration devices are designed as off-line BMP's. A vegetative filter, with flow spreader is provided for each of the proposed BMP's. The vegetative' filter carries the overflow from the infiltration basins /trenches at a non-erosive velocity for a minimum of fifty (50) feet. All runoff from roof tops will be directed into gutters and into junction boxes at the front of the buildings. The design of each BMP was done according to the examples provided in the Express Permitting Training Manual, and the NCDENR Stormwater BMP Design Manual. A soils analysis was performed (Edwin Andrews & Associates, P.C.) at three locations on the site. The analysis was performed on January 12, 2004 and it confirmed that the seasonal high water table surface was greater than two (2) feet at each analysis site based on soil chromatography. The soil profiles classified the soils as Wando fine sand. The underlying horizons, which will be used to drain the infiltration devices. were analyzed using a Compact Constant Head Permeameter. The conductivity of the most restrictive horizon found at the analyzed sites was 1.05 inches per hour. The Regency consists of two (2) condominium buildings, a large pool and two (2) docks. The upland development is split into two sections, the building and site development. There is an attached narrative by the respective professionals detailing each of these sections. The riparian part of this permit consists of two (2) docks. The major dock extends 266 ft. beyond mean high water. There is a 24 x 16 stationary dock with half of it covered and nine (9) day slips. The water depth is -1.1 ft. below mean low water at the outer edge of the dock. The second dock extends 153 ft. beyond mean high water. There is a 16 x 24 ft. stationary observation dock with no slips. Shellfish Production. No discharge of dredged or fill material may occur in areas of concentrated shellfish pro unless the discharge is directly related to a shellfish harvest activity authorized by nationwide permit. 15. Suitable Material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash, de bodies, etc.) and material discharged must be free from toxic pollutants in toxic amounts. 16. Mitigation. Discharges of dredged or fill material into waters of the United States must be minimized or avoid( maximum extent practicable at the project site (i.e., on-site), unless the District Engineer has approved a comp mitigation plan for the specific regulated activity. 17. Spawning Areas. Discharges in spawning areas during spawning seasons must be avoided to the maximui practicable. 18. Obstructions of High Flows. To the maximum extent practicable, discharges must not permanently restrict of the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of thi impound waters). 19. Adverse Impacts from Impoundments. If the discharge creates an impoundment of water, adverse impact aquatic system caused by the accelerated passage of water and/or the restriction of its flow shall be minimized to the n extent practicable. 20. The piers, docks, boathouses and boat shelters will be pile- supported or floating structures. Mooring piles, dolphins, jetties and breakwater structures may be constructed of wood, metal or precast concrete. Breakwater structures will be designed to provide for adequate water circulation landward of the structures. Other construction activities, including excavation or the discharge of excavated or fill material, are not authorized by this general permit. b. No structure authorized by this general permit, in or over the water, will extend closer to the near edge of any Federally-maintained channel than the sum of three times the project depth plus two feet over depth, plus ten feet [Example: 6-foot project depth + 2-foot over depth = (8 feet x three) plus 10 feet = 34-foot setback from the near edge of channel]. This general permit does not authorize any structure closer than 80 feet to the near bottom edge of the Federally maintained, 12-foot-deep, 90-foot-wide channel of the Atlantic Intracoastal Waterway (AIWW) except where an official, Corps of Engineers' approved "NO WAKE ZONE" is present. In areas of approved "NO WAKE" on the AIWW, no pier, dock or other waterfront structure will extend closer than fifty (50) feet to the near edge of the channel. c. This general permit does not authorize construction across or into any natural or manmade channel or water body so as to adversely affect navigation, or general access and perceptions thereof, by the general public. No structure may be placed within 15 feet of a property line extended perpendicular to a channel without the concurrence of the adjoining property owner. d. Piers, docks, boathouses, boat shelters and mooring piles authorized by this general permit may be extended or be located up to 400 feet waterward of the mean high water (MHW) elevation contour (tidal areas) or the normal water level (NWL) elevation contour (non-tidal areas) or one third (1/3) the width of a natural water body, whichever is closer to the shoreline, except as otherwise governed by the presence of a Federally maintained channel. The width of a pier will not exceed six (6) feet, except if a greater width is necessary for safer use, to improve public access, or is necessary to support a water dependent use that cannot otherwise occur. Any portion of a dock or pier, fixed or floating, extending from the main structure and six (6) feet or less in width, is a "T" or "L" section or a finger pier. Any portion of a dock or pier, fixed or floating, greater than six (6) feet wide is a platform or deck. Adjoining platforms, decks, boathouses, boat shelters, docks and "L" and "T" sections will not have a cumulative maximum floor area larger than 400 square feet, except if a greater area is necessary for safer use, to improve public access, or is necessary to support a water dependent use that cannot otherwise occur. Docks and piers extending over vegetated wetlands will be elevated at least four (4) feet over the wetland substrate. e. Boathouses and boat shelters will be open on all sides and will not be constructed over vegetated wetlands. f. Wooden jetties will not extend farther than 25 feet waterward of the MHW or the NWL elevation contours. g. This general permit does not authorize the installation of fueling facilities on authorized structures. r. This general permit does not authorize any dredging. s. This general permit does not apply to structures within existing or proposed marinas as defined by North Carolina Administrative Code, Title 15, Subchapter 711.0208(b)(5). t. This general permit is not applicable to any work on Atlantic Ocean beaches. 2. General Conditions. a. There will be no unreasonable interference with navigation or the right of the public to riparian access by the existence or use of activities authorized by this general permit. b. A permittee, upon receipt of written notice from the Wilmington District Engineer of failure to comply with the terms or conditions of this general permit, will, within 60 days, without expense to the U.S. Government, and in such manner as the Wilmington District Engineer may direct, affect compliance with the terms and conditions or return the worksite to a pre-work condition. c. The permittee must make every reasonable effort to perform the work authorized herein in a manner so as to minimize any adverse impact on fish, wildlife and natural environmental values. d. The permittee must perform the work authorized herein in a manner so as to minimize any degradation of water quality. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the water body is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's.or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. e. The permittee will permit the Wilmington District Engineer or his representative, or other Federal resource agency personnel having compliance or monitoring issues to address, to make periodic inspections at any time deemed necessary in order to assure that the activity is being performed or maintained in strict accordance with the Special and General Conditions of this permit. f. This general permit does not convey any rights, either in real estate or material, or any exclusive privileges; and it does not authorize any injury to property or invasion of rights or any infringement of Federal, State or local laws or regulations, nor does it obviate the requirement to obtain State or local assent required by law for the activity authorized herein. These may include, but are not necessarily limited to, a Dredge and/or Fill Permit (N.C.G.S. 113-229), a Coastal Area Management Act (CAMA) Permit (N.C.G..S. 113A-118), an Easement to Fill (N.C.G.S. 146-12) and a Water Quality Certification pursuant to 4 h. Decking for piers, docks, boathouses and boat shelters will accommodate loads not less than 50 pounds per square foot. i. Wood will be pressure-treated except in areas of boathouses or boat shelters protected from the weather. Metal or pre-cast concrete pilings are acceptable. j. Metal pilings or beams will have a minimum section thickness of 3/16 inch. k. Floating structures will be designed to not break away and will be supported by material that will not become waterlogged or sink when punctured. Floating structures will be installed to provide for fluctuations of water elevation, and they will be designed so that the structure will not rest on the bottom at any time. 1. Breakwater structures will be no longer than 500 feet. They will have a minimum of one inch openings between standard width (6 to 12-inch) sheathing boards and at least one, five-foot wide opening for each 100 linear feet of structure. Breakwater structures may not be constructed so as to prohibit access to estuarine waters or public trust areas. m. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. n. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. o. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. p. This general permit does not authorize any structure or associated facility for nonwater-related use. q. Structures and their attendant utilities, authorized by this general permit, located on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIWW), will be removed at the expense of the permittee, in the event that, in the judgment of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed within the easement. Section 401 of the Clean Water Act. g. Authorization provided by this general permit may be either modified, suspended or revoked in whole or in part if the Wilmington District Engineer, acting on behalf of the Secretary of the Army, determines that such action would be in the best public interest. Unless subject to modification, suspension or revocation, the term of this general permit shall be five years. Any modification, suspension or revocation of this authorization will not be the basis for any claim for damages against the U.S. Government. h. This general permit does not authorize the interference with any existing or proposed Federal project and the permittee will not be entitled to compensation for damages or injury to the structures or work authorized herein which may be caused by or result from existing or future operations undertaken by the United States in the public interest. i. This general permit will not be applicable to proposed construction when the Wilmington District Engineer determines that the proposed activity would significantly affect the quality of the human environment and determines that an Environmental Impact Statement (EIS) must be prepared. j. This general permit will not be applicable to proposed construction when the -Wilmington District Engineer determines, after any necessary investigations, that the proposed activity would adversely affect areas which possess historic, cultural, scenic, conservation or recreational values. Application of this exemption applies to: (1) Rivers named in Section 3 of the Wild and Scenic Rivers Act (15 U.S.C. 1273), those proposed for inclusion as provided by Sections 4 and 5 of the Act and wild, scenic and recreational rivers established by State and local entities. (2) Historic, cultural or archeological sites listed in or eligible for inclusion in the National Register of Historic Places as defined in the National Historic Preservation Act of 1966 and its codified regulations, the National Historic Preservation Amendment Acts of 1980 and 1992, the Abandoned Shipwreck Act of 1987 and the Native American Graves Protection and Repatriation Act. (3) Sites included in or determined eligible for listing in the National Registry of Natural Landmarks.
