On August 23, 2004, Noelle Lutheran and Joanne Steenhuis of the Division of Water
Quality (DWQ) Wilmington Regional Office performed a site inspection of your property off
NC Highway 24 in Jacksonville, NC. The inspection and subsequent review of your activities
revealed that there are additional wetland and stream impacts within the Pine Forest Acres
Subdivision.
During the site visit, the investigators took photographs and made observations of stream
impacts that included widening an existing stream crossing without a permit and impacting
another stream without a 401 Water Quality Certification and required mitigation. Specifically,
additional impacts to streams were found and mitigation thresholds were exceeded.
A DWQ file review confirms that impacts to streams with the previously issued permits
reached 149' any additional impacts over 12" would require mitigation. Also, a review of the
Corps of Engineers records reveal that you have secured a 404 Permit from the Corps of
Engineers for Pine Acres Section VI (a 404 permit from the Corps of Engineers is not valid
without the State issued 401 certification). As a result of the site inspections and file review, the
following violations, detailed on the following pages, are noted:
1) Failure to secure a 401 Water Quality Certification prior to impacting wetlands
and a stream;
2) Wetland standards violations;
3) Failure to comply with additional conditions of General Water Quality
Certification No. 3404, Project No. 021877.

Item I. 401 Water Quality Certification
A DWQ site visit and file review confirmed that additional stream impacts occurred on
crossing # 1 in Pine Acres Section IV & V without a 401 Certification from the Division of
Water Quality. Wetland and stream impacts also occurred at a road crossing in Pine Acres
Section VI prior to the issuance of a 401 Water Quality Certification. 15A North Carolina
Administrative Code 2H.0501 requires certifications pursuant to Section 401 of the Clean Water
Act whenever construction or operation of facilities will result in a discharge into navigable
waters, including wetlands, as described in 33 CFR Part 323.
Item II. Wetland Standard Violation
Wetland disturbance corresponding to mechanized land clearing, grading, and fill was
observed. Since there is no State issued 401 Water Quality Certification for the additional
impacts, the respective placement of fill, grading, and grubbing in wetlands represents violations
of the following North Carolina wetland standard which states:
15A NCAC 2B .0231(b) (1) and (5)
1) Liquids, fill or other solids or dissolved gases may not be present in amounts which
may cause adverse impacts on existing wetland uses;
5) Hydrological conditions necessary to support the biological and physical
characteristics naturally present in wetlands shall be protected to prevent adverse
impacts on:
C) The chemical, nutrient and dissolved oxygen regime of the wetland;
D) The movement of aquatic fauna;
F) Water levels or elevations.
Item III. General Water Quality Certification Condition Violations
The project has been found in violation of General Water Quality Certification No. 3404,
and additional conditions issued pursuant to the requirements of 15A NCAC 2H .0500. The
violations found are:
Project No. 021877, Condition 4 - If at anytime during construction of the road crossings, it is
determined that an additional I' or more of stream impacts will be necessary, including
widening the existing road crossing #1 beyond its existing footprint with fill, pipe, or rip-rap, you
must submit a PCN application and appropriate fee for a new water quality certification prior to
doing the work. Stream mitigation will be required for all of the stream impacts on site;
Project No. 021877, General Water Certification No. 3404, Condition 9 - In accordance with
15A NCAC 2H.0506 (h) compensatory mitigation may be required for impacts to 150 linear feet
or more of streams andlor one acre or more of wetlands. For linear public transportation
projects, impacts equal to or exceeding 150 feet per stream may require mitigation. In addition,
buffer mitigation may be required for any project with Buffer Rules in effect at the time of

application for buffer impacts resulting from activities classified as "allowable with mitigation"
within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer
Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for
any Certification for this Nationwide Permit. The most current design and monitoring protocols
from DWQ shall be followed and written plans submitted for DWQ approval as required in those
protocols. When compensatory mitigation is required for a project, the mitigation plans must be
approved by DWQ in writing before the impacts approved by the Certification occur, unless
otherwise specified in the approval letter. The mitigation plan must be implemented and/or
constructed before any permanent building or structure on site is occupied. In the case of public
road projects, the mitigation plan must be implemented before the road is opened to the traveling
public. Projects may also be implemented once payment is made to a private mitigation bank or
other in-lieu fee program, as specified in the written concurrence of 401 Certification for a
project. Please note that if a stream relocation is conducted as a stream restoration as defined in
The Internal Technical Guide for Stream Work in North Carolina. April 2001, the restored
length can be used as compensatory mitigation for the impacts resulting from the relocation;
This Office also requests that you respond to this letter in writing within 20 days of
receipt of this Notice. Please note, these violations and any future violations are subject to civil
penalty assessment of up to $25,000.00 per day for each violation. Your response should be sent
to both this office at the letterhead address and to the attention of Mr. Danny Smith at the
Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh NC, 27604-2260. Your response should
address the following items:
1). How much impact has occurred to wetlands and in the streams (in linear feet) in
the project area, including the all the sections of the subdivision;
2). Why you expanded the road crossing #1 in Section IV and V without applying for
a permit, and an after-the fact application for additional impacts;
3). An explanation of why you did not wait for the 401 Water Quality Certification
prior to impacting the wetlands/stream in Section VI;
4). Proposed mitigation for all of the stream impacts in Pine Acres Subdivision;
5). Please provide a copy of the recorded deed notifications or similar mechanisms
placed on all jurisdictional wetlands, waters and streams for Pine Acres Section
IV and V as required by the 401 Water Quality Certification issued in April 2003;
6). A schedule with dates clearly depicting your efforts to become compliant.
By copy of this letter to the Onslow County Building Inspector, this Office is
requesting that the Building Inspector consider withholding building permits and
Certificates of Occupancy for this project until this matter is satisfactorily resolved.
In addition this Office is placing your 401 Water Quality Certification Pre Construction
Application (DWQ Project No. 040998) on hold until the violation is rectified.

1. Please clearly show a cross section of the proposed road crossing and culvert and include the
slope protection;
2. Please send a copy of the signed wetland jurisdictional determination for the property;
3. Please show on the plan the 404 wetland line (cannot identify the wetlands line in Section VI
of the plan);
4. Please send a copy of the Corps of Engineers permit.
5. Please include a copy of the restrictive covenants or deed restrictions that will protect the
remaining wetlands in the subdivision from additional impacts.
Please respond within three weeks of the date of this letter by sending a copy of the information
to Joanne Steenhuis and to Cyndi Karoly, 401 Wetlands Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-

Description of Activity: The excavation and placement of fill material into 0.03 acres of jurisdictional wetlands

Your work is authorized by this Regional General (RGP) or Nationwide Permit (NWP) provided it is accomplished in
strict accordance with the attached conditions and your submitted plans. If your activity is subject to Section 404 (if
Section 404 block above is checked), before beginning work you must also receive a Section 401 water quality
certification from the N.C. Department of Environment and Natural Resources, Division of Water Quality, telephone
(919) 733-1786. For any activity within the twenty coastal counties, before beginning work you must contact the N.C.
Division of Coastal Management, telephone (919) 733-2293.
Please read and carefully comply with the attached conditions of the RGP or NWP. Any violation of the conditions of
the RGP or the NWP referenced above may subject the pennittee to a stop work order, a restoration order, and/or
appropriate legal action. This Department of the Army RGP or NWP verification does not relieve the permittee of the
responsibility to obtain any other required Federal, State, or local approvals/permits. The permittee may need to contact
appropriate State and local agencies before beginning work.
This verification will be valid for two years from the date of this letter unless the nationwide authorization is
modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the
nationwide permit authorization is reissued without modification or the activity complies with any subsequent
modification of the nationwide permit authorization. If during the two years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide pernut, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization.

ARTICLE XVII
PROVISIONS-RE TING TO Y1JLA%M- All of the properties subject to these Restrictive and
Protective Covenants shall also be subject to the following Special Provisions Relating to Wetlands. In
developing the subject real property, the Declarant has agreed with the Department of the Army Corps
of Engineers (pursuant to a permit issued by the Corps of Engineers, Action I.D. number 200400809) to
restrict and prohibit any future filling or other detrimental activities In the wetland areas, which presently
exist within the identified areas of the property. Accordingly, all wetlands shown and delineated an the
recorded plat of this subdivision set forth in Article I hereof, which have been verified by the Corps of
Engineers, under Action I.D. number 200400809, shall be maintained In perpetuity in their natural or
mitigated condition. No person or entity shall perform any of the following activities on such
conservation area: (a) fill, grade, excavate or perform any other land disturbing activities; (b) cut, mow,
burn, remove or harm any vegetation; (c) construct or place any roads, trails, walkways, buildings, mobile
homes, signs, utility poles or towers or any other permanent or temporary structures, (d) drain or
othewlse disrupt or alter the hydrology or drainage ways of the conservation area; (e) dump or store soil,
trash, or other waste; (f) allow animal grazing or watering or use for any other agricutural or horticultural
purpose on such conservation areas. This covenant Is Intended to ensure continued compliance with the
mitigation condition of authorization issued by the United States of America, U.S. Army Corps of
Engineers, Wilmington District, Action I.D. number 200400809 and therefore may be enforced by the
United States of America. This covenant is to run with the land and shall be binding on the Declarant,
the owner of any lot in the subdivision and all persons or entities claiming under them.
This Article XVII cannot be amended or modified without the express written consent of the U.S.
Army Corps of Engineers, Wilmington District, or Its authorized successor.
ARTICLE XVIII
COMPLIANCE WITH DEPARTMENT OF TRANSpr1RATION TRAFGlr MAINTEN8KE STANDARDS:
Driveway headwalls, fences, mailboxes, newspaper delivery boxes or other roadside obstructions,
constructed within the right of way of any street as shown on the recorded plat of the subdivision In a
location or out of materials determined to be a traffic safety hazard by the North Carolina Department
of Transportation or the Declarant, shall not be permitted. It shall be the duty of the Owner of any Lot
to remove such obstruction, at the Owner's sole expense, within thirty (30) days following written
notification of such objection by the North Carol InaDepartment of Transportation or Declarant. In the
event any Owner fails to remove an obstruction within the thirty (30) day period following receipt of
notice of the objection, Declarant shall be entitled, but not obligated, to remove the obstruction and
recover the expense and cost, Including reasonable attorney's fees, Incurred In the removal.
ARTICLE XIX
STREET LIGHTING AGREEMENT: The Declarant reserves the right to subject the real property in this
subdivision to a contract with an electric utility company for the Installation of underground electric
cables and/or the installation of street lighting, and/or entrance sign lighting, either or all of which may
require an initial payment and/or a continuing monthly payment to an electric company by the owner
of each dwelling.
ARTICLE XX
ENFORCEMENT: Enforcement shall be by proceedings at law or in equity against any person or
person violating or attempting to violate any covenant, either to restrain violations or to recover
damages.
ARTICLE XXI
MODIFICATION: These restrictions are subject to being altered, modified, canceled or changed
at any time as to said subdivision as a whole or as to any subdivided lot or part thereof by written
document executed by the Declarant or their successors in title and by the owner of not less than sixty
percent ( 60 %) of the subdivided lots or parts of said subdivision to which these restrictions apply, and
recorded in the Office of the Register of Deeds of Onslow County, North Carolina. If the Declarant owns
sixty (60%) percent or more of the subdivided lots, the Declarant may alter or amend these covenants
without consent of anyone. Provided, however, the provisions of Article XVI cannot be amended or
modified without the express written consent of the State of North Carolina and the provisions of Article
XVII cannot be amended or modified without the express written consent of the United States Army Corps
of Engineers, Wilmington District.

ARTICLE XI
No lot shall be used or maintained as a dumping ground for
rubbish. Trash, garbage or other waste shall not be kept except in sanitary containers. All incinerators
or other equipment for the storage or disposal of such material shall be kept In a clean and sanitary
condition.
ARTICLE XII
SIGHT DISTAN _ AT INTERSECTION: No fences, wall, hedge or shrub planting which obstructs
sight lines at elevations between 2 and 6 feet above the roadways shall be placed or permitted to remain
on any corner lot within the triangular area formed by the street property lines and a line connecting
them at points 25 feet from the Intersection of the street lines, or in the case of a rounded property
corner, from the Intersection of the street property lines extended. The same slght line limitations shall
apply upon any lot within 10 feet from the intersection of a street property line with the edge of a
driveway or alley pavement. No tree shall be permitted to remain within such distance of such
intersection unless the foliage line is maintained at sufficient height to prevent obstruction of such sight
lines.
ARTICLE XIII
IEMPORARY STRUCTURES: No structure of a temporary character, trailer, basement, tent, shack,
garage, barn or other outbuilding temporarily or permanently. No trailer, mobile home, camper or line
vehicle shall be parked on any lot at any time for any purpose nor shall any vehicle be allowed to remain
on any lot at any time for any purposes unless it is parked behind the main dwelling structure or placed
Inside the carport or garage.
ARTICLE XIV
DRAINAGE: All driveways shall have drainage the In the street ditches installed and sized in
accordance with the North Carolina Department of Transportation recommendations.
ARTICLE XV
TERM: These Covenants are to run with the land and shall be binding on all parties and all persons
claiming under them for a period of twenty-five (25) years from the date these Covenants are recorded,
after which such time such Covenants shall be automatically extended for successive periods of ten (10)
years unless an instrument signed by a majority of the then owners of the lots has been recorded,
agreeing to change said Covenants In whole or In part, with the exception of Article XVI.
ARTICLE XVI
STORMWATER MANAGEMENT: (A) The allowable built-upon area per lot Is as follows:
(1) Lots 5, 9, 10, 11, 12, 17 and 18, are limited to a maximum of 6,000 square feet per lot;'
00 Lots 4, 6, 7 and 14, are limited to a maximum of 9,500 square feet per lot; and
(III) Lots 1, 2, 3, 8, 13, 15, and 16, are limited to a maximum of 15,200 square feet per lot.
These allotted amounts Include any built-upon area constructed within the lot property boundaries, and
that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area
Includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate and coquina, but
does not Include raised, open wood decking or the water surface of swimming pools.
(B) Filling In or piping of any vegetative conveyances (such as ditches, swales, etc.) associated with
the development, except for the minimum amount necessary under driveways to provide access to lots
and the minimum amount necessary to direct runoff beneath an impervious surface such as a road, is
strictly prohibited by any person.
(C) Lots within CAMA's Area of Environmental Concern ("AEC") may have the permitted built-upon
area reduced due to CAMA jurisdiction within the AEC.
(D) All permitted runoff from any outparcels or future development shall be directed into the
permitted stormwater control systems. The connections to the stormwater control system shall be
performed in a manner that maintains the integrity and performance of the system as permitted.
(E) Each lot will maintain a thirty (30) foot wide vegetated buffer between all Impervious areas and
surface waters.
(F) All roof drains shall terminate at least thirty (30) feet from the mean high water mark of any
navigable stream.
The covenants and restrictions set forth In this Article XVI Is Intended to ensure continued
compliance with state stormwater management permit number SW8 021118 as Issued by the Division
of Water Quality and may not be changed or deleted without the consent of the State of North Carolina.

DWELLING QUALITY AND SiU: The ground floor area of the main structure, exclusive of one-story
porches and garages, shall be not less than 1,000 square feet for a one-story dwelling, nor less than 750
square feet for a dwelling of more than one story.
ARTICLE V
BUILDING LOCATION: No building shall be located on any comer lot nearer to the front line or any
side street line than as shown on the recorded plat. No building shall be located with respect to interior
side lot lines so as to be nearer than 8 feet to either such line. No dwelling shall be located on any
Interior lot nearer to the front lot line than as shown on the recorded plat nor nearer than 10 feet to the
rear lot line, and no garage or other permitted access or building shall be located nearer than 10 feet
to the rear lot line For the purposes of this covenant, eaves, steps, open porches, and carports shall not
be considered as part of a building provided, however, that this shall not be construed to permit any
portion of a building on a lot to encroach upon another lot. An error of not more than 10 percent In the
location of a building on the lot with respect to the minimum set back lines shall not be considered a
violation of this covenant.
ARTICLE VI
NUISANCES: No noxious or offensive activity shall be carried on upon any lot nor shall anything
be done thereon which may be or may become an annoyance or nuisance to the neighborhood. Each
owner shall maintain their lawn in a well manicured manner and their lawn shall not become overgrown,
unsightly or be offensive to other lot owners.
ARTICLE VII
EA M NTS: Easements for installation and maintenance of utilities, Including water and sewer
services, drainage facilities and access are reserved as shown on the recorded plat and over the rear ten
feet of each lot. Within these easements, no structure, planting or other materials shall be placed or
permitted to remain which may damage or Interfere with the Installation and maintenance of utilities, or
which may obstruct or retard the flow of water through drainage channels in the easements. The
easement area of each lot and all Improvements In it shall be maintained continuously by the owner of
the lot, except for those Improvements for which a public authority or utility company is responsible.
The Declarant reserves for itself, its successors and assigns, an easement and right at any time
in the future to grant a right of way under, over and along the side, rear and front property lines of each
and every lot In the subdivision described herein, for the installation and maintenance of poles, lines,
conduits, pipes, and other equipment necessary to or useful for furnishing electric power, gas, telephone
service, drainage or other utilities Including water and sewer services.
ARTICLE VIII
LIVESTOCK AND POUT TRY: No animals, livestock or poultry of any kind shall be raised, bred or
kept on any lot, except that dogs, cats or other household pets may be kept provided that they are not
kept, bred or maintained for commercial purposes. Any and all pets shall not be allowed on the premises
unless same are under the direct control of the owner at all times and are not creating a nuisance to the
other owners within the property.
ARTICLE IX
BUILDING PLANS AND SPECIFICATIONS: No dwelling or other building shall be erected upon any
lot unless the plans and specification thereof meet or exceed the requirements of "minimum property
standards for one and two living units". (FHA. No.300), Federal Housing Administration.
ARTICLE X
ERECTION OF FENCES: No fences over six (6) feet in height shall be constructed between the front
of the primary dwelling and the back lot line. No fence shall be erected between the front of the primary
dwelling and the street right of way unless such fence shall be of an ornamental nature. Brick and
split-rail shall be deemed to meet the requirements of this restriction.

Coastal Area Management Act (CAMA) Coordination - If the project occurs in any of North Carolina's
twenty coastal counties (listed on page 4) the applicant should contact the North Carolina Division of
Coastal Management (DCM). DCM will determine whether or not the project is within a designated
Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such
cases, DCM will require a CAMA Permit and will coordinate the 404/401 Permits.
The applicant may also choose to coordinate with the United States Fish and Wildlife Service to ensure
that the proposed project will have no impact upon any endangered or threatened species or critical
habitat as regulated by the Endangered Species Act, and the State Historic Preservation Office, North
Carolina Department of Cultural Resources to ensure that the proposed project will have no impact upon
any properties listed or eligible for listing on the National Register of Historic Places. Compliance with
these regulations is required to be eligible for any Department of the Army permit. The addresses for
both agencies are listed on page 3 of this application.
USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms,
photos, etc. to the applicable USACE Regulatory Field Office. Upon receipt of an application, the
USACE will determine if the application is complete as soon as possible, not to exceed 30 days. This
PCN form is designed for the convenience of the applicant to address information needs for all USACE
Nationwide, Regional or General permits, as well as information required for State authorizations,
certifications, and coordination. Fully providing the information requested on this form will result in a
complete application for any of the USACE Nationwide, Regional or General permits. To review the
minimum amount of information that must be provided for a complete PCN for each USACE
Nationwide permit, see Condition 13, 65 Fed. Reg. 12893 (March 9, 2000), available at
http://www.saw.usace.army mil/wetlands/nwpfinalFedReg pdf. Processing times vary by permit and
begin once the application has been determined to be complete. Please contact the appropriate
regulatory field office for specific answers to permit processing periods.
401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated
as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE
Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center,
Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401
Certification, then a non-refundable application fee is required. In brief, if project impacts include less
than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to
streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is
required. A check made out to the North Carolina Division of Water Quality, with the specific name of
the project or applicant identified, should be stapled to the front of the application package. For more
information, see the DWQ website at http://l12o.ehnr.state.nc.us/ncwetiands/fees htn11. The fee must be
attached with the application unless the applicant is a federal agency in which case the check may be
issued from a separate office. In such cases, the project must be identifiable on the U.S. Treasury check
so that it can be credited to the appropriate project. If written approval is sought solely for Buffer Rules,
the application fee does not apply, and the applicant should clearly state (in a cover letter) that only
Buffer Rule approval is sought in writing. Wetlands or waters of the U.S. may not be impacted prior to
issuance or waiver of a Section 401 Water Quality Certification. Upon receipt of a complete application
for a 401 Certification, the Division of Water Quality has 60 days to prepare a written response to the
applicant. This may include a 401 Certification, an on-hold letter pending receipt of additional
requested information, or denial.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
