Egret Road), adjacent to Currituck Sound Dear Mr. Ladd: Your application for a 401 Water Quality Certification to impact 0.36 acre of estuarine waters and shoreline in order to maintenance dredge a man-made canal and construct a bulkhead on your property was received in the Division of Water Quality's Central Office on June 16, 2004. According to our rules [15A NCAC 2H.0507 (A)], if final action is not taken within 60 days, the Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact waters as described in your June 16, 2004 application materials. However, if additional impact occurs or your development plans change, this waiver is no longer valid and a 401 Water Quality Certification will be required. PROJECT SUMMARY: Maintenance dredge access channel and man-made canal off Currituck Sound, backfill 3401 SF of waters at head of canal, create spoil area, and construct 583 linear ft of bulkhead. PROJECT SETTING Robert A. Ladd III owns the property located at Egret Lane in Harbinger, Currituck County, North Carolina. To access the site, from NC 158 turn onto State Road 1106 in Harbinger. Proceed approximately .5 miles and turn onto Egret Lane. Site is approximately 1000 ft on the east side of Egret Lane. There is a man-made canal extending from the Currituck Sound, measuring approximately 320 ft long and 35 ft wide. Sediment has collected in the canal such that the bottom contour ranges from 0.5 ft to 5.2 ft. A sand bar, approximately 10 ft in width, exists above normal water level (NWL) approximately 260 ft from the landward end of the canal. No other man-made features are present, and no previous permits have been issued at this site. Vegetation identified at the site includes Wax Myrtle (Myrica cerifera), Sweet Gum (Liquidambar styraciflua), and Loblolly Pine (Pinus taeda). No coastal or Section 404 wetlands are present in the proposed area of development. The waters of Currituck Sound in the vicinity of the project are classified as SC by the NC Environmental Management Commission, as Joint Waters by the NC Marine Fisheries Commission and the NC Wildlife Resources Commission, and as Estuarine and Public Trust Waters by the NC Coastal Resources Commission. The presence of submerged aquatic vegetation, Eurasian Millfoil, was noted in the vicinity of the project. No evidence of shellfish or finfish resources was observed during the site inspection. Review of available information suggests there are no known archeological sites or geologic formations associated with the site. PROJECT DESCRIPTION Use a hydraulic dredge to excavate 780 CY of silt/sand from 410 linear feet of canal bottom, approximately 35 ft wide, to a design depth of -3.5 ft, reaching a depth of 3.5 ft in the Currituck Sound. Includes the filling of approximately 7000 SF of water bottom ranging from -4 to -5 ft, to the design depth of 3.5 ft. Create a 190 ft by 75 ft spoil material disposal area. Spoil material will be dewatered at least 24 hours prior to its use as backfill. Disposal area will be seeded and restored within 30 days upon completion of project. Backfill 3401 SF of Section 10 waters at the head of the canal Robert A. Ladd, III Page 3 Y - Construct 538 LF of bulkhead along existing NWL and two 10 ft return walls for shoreline stabilization. Dewatered spoil material will be used to backfill bulkhead, and backfill will extend approximately 15 ft landward of the bulkhead. Bulkhead construction will not require excavation and will be located landward of all wetlands. Dredging includes removal of approximately 1000 SF of submerged aquatic vegetation (Eurasian Milfoil) ANTICIPATED IMPACTS • The filling at the head of the canal will result in the loss of 3401 SF of Estuarine/Shallow Water Habitat. • High ground/upland disturbance associated with the construction of the proposed bulkhead will require sedimentation and erosion control measures to limit possible prolonged turbidity from runoff. • Installation of the bulkhead will result in some short-term turbidity. • Dredging will disturb approximately 11982 SF of sandy bottom shallow water habitat and remove approximately 1000 SF of submerged aquatic vegetation. • Spoil retention area is designed for 82% capacity, with a dewatering return to dredged area. • Turbidity associated with dredging and spoil dewatering will be a concern if conducted during the dredging moratorium period, but could probably be controlled with a turbidity curtain. Dredging during crab-shedding times should be limited if such operations are in progress on adjoining shorelines. • The filling of the canal area where depths exceed the 3.5 ft connecting depth of the Currituck Sound should eliminate the potential for these waters to become anoxic during times of low water column mixing energy. Ladd, III Currituck County, NC In order to stabilize the shoreline, improve water quality, the applicant proposes the following activities 1. Create spoil area 2. Backfill 82 SF behind rest of bulkhead 7. Restore reseed disturbed area %Ocl yen APR 2 6 =paSrAL i FlfZgBF-rH ?MENr The parcel is a 1.12 acre waterfront property in Harbinger, NC, adjacent to the Currituck Sound. The water depths were confirmed and the public trust resources were identified by Ed Harrell (NCDCM) and Kendall Turnage (EPI) in an on site meeting on March 24, 2004. This application is a reflection of the constraints associated with the onsite conditions and the applicant's development request. SAV's were not observed in the canal or access channel during the pre application meeting. A man made canal exists on the property (original date of excavation unknown by applicant). The canal extends far into the property and the applicant desires to shorten the canal length to produce an easily maintained canal and basin on the property. The reduction in length will also aid in improving water quality, as the present canal length does not promote adequate flushing. A total of 3401 SF of fill in Section 10 waters will be required to complete this activity. The remainder of the canal will be dredged to a depth of -3.5 feet NWL and will connect to the access channel. Approximately 569 CY of sand /silt will be excavated below the NWL for this activity The access channel is proposed to access navigable waters and to aid in flushing qualities of the canal. This channel will be excavated to -3.5 feet to the corresponding connecting depth. Approximately 211 CY of material will be excavated below the NWL for this activity. Hydraulic dredging will be required to complete this activity. The spoil area will be designed as to accommodate this activity. The 583 LF bulkhead request is to stabilize the shoreline and backfill the area, which will be accomplished with spoil derived from the dredging activities. The spoil. material will be dewatered at least 24 hours prior to its use as backfill. The actual spoil containment area is 8569 SF with capacity of 952 CY. This area will be surrounded by a silt fence and will be constructed as to maintain its integrity from the dredging operations. Less than one acre of land will be disturbed in the dredging activities.
