S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated July 13, 2004. The applicant, Doug Smith, has applied for a Department of the Army (DA) permit to construct an 8-slip docking system, excavate a basin, and replace existing riprap with a bulkhead. The proposed work is being considered under Regional General Permit #198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Proposed Activities and Anticipated Impacts The proposed work is described in the Field Investigation Report (FIR), dated June 11, 2004, of the North Carolina Division of Coastal Management (NCDCM). The project site is located on the waterfront of Beaufort. The shoreline is stabilized with large rocks and concrete debris and has no docking facilities. The area of Taylor's Creek is not designated as a Primary Nursery Area. The applicant proposes to dredge 2,730 square feet (ft) of shallow bottoms. The FIR states that water depths in the area to be excavated are two feet at normal low water (NLW). However, Sheet 4 of 4 in the permit application indicates that the waterward third of the excavation area drops from -3 to -5 feet of water depth at NLW. The permit application states that no submerged aquatic vegetation is present in the excavation area. A vinyl bulkhead would be installed 2.5 to 5.0 feet waterward of the existing riprap which would be removed. The work would fill 31.5 ft2 of shallow bottoms. The docking facility would incorporate 8,360 ft2 and shade 1,098 ft2 of shallow bottoms. 2 Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Carteret County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project- specific information on species which should be considered in permitting this project. The project area is located in the Beaufort quad. The occurrence data of special status species within this quad can be obtained on the internet at < http://www.nesparks.net/nhp/quad.html >. Our review indicates that the only federally listed species likely to occur in the project area is the West Indian manatee (Trichechus manatus), a federally-endangered mammal. The species is known to occur in Carteret County and the NCNHP database indicates several manatee occurrences in the estuarine water of near Morehead City, Beaufort, and Bogue Sound. The shallow, estuarine waters of near the project site may provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. There is one reported occurrence in Taylor's Creek just southeast of the project site. Manatees feed in water one to two meters (3.3 -6.6 feet) deep that may support submerged aquatic vegetation. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. The permit application states that dredging would be done by a hydraulic clamshell dredge or dragline and the material placed on a barge. Such dredging poses a risk to manatees which could occur at the project site. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < http://nc- es.fws.gov/mammal/manatee guidelines.pdf>. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. Service Recommendations With the inclusion of our manatee guidelines, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. The Corps' requirements of section 7 of the Endangered Species Act would be fulfilled. However, the Corps must reconsider its obligations under section 7 of the ESA if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Based on the information given in the FIR and permit application, we do not believe the proposed activities would create irreversible or significant adverse impacts on fish and wildlife resources under our jurisdiction. Therefore, with prudent measures to protect manatees we have no objections to issuance of the issuance of a DA permit for the proposed work. This approval allows you to: Dredge an approximate footprint of 105' X 26' in Taylor's Creek using a clamshell to barge and dredged material carried to a high ground disposal site; 2. PROJECT SUMMARY: The applicant has an offer to purchase the condominium complex on the north side of Front Street and a 10' strip of land on the south side of Front Street adjacent to Taylor's Creek. Both are currently owned by Duke University. The applicant plans to construct an 8-slip docking system, excavate the basin, and replace the existing riprap with a bulkhead. Seven slips will be sold and one will be deeded with the residence that will remain in Duke University ownership. Field Investigation Report: Doug Smith Page 02 --------------------------- 9. Narrative Description: The project site is located on Front Street in the Town of Beaufort, Carteret County, adjacent to Taylor's Creek at the west end of the town. This is within the historic district of the Beaufort, and is owned by Duke University, having been used for student and guest housing. There are apartments on the north side of Front Street and a residence on the south side of the street. The shoreline is stabilized with large rock and concrete debris, and there is, no docking facility. The tract is approximately 6>T7 sf in size, averaging +5.25' in elevation, with existing Iavvn ;'. vegetation. The house and condos are serviced by municipal water and sewer services. This area of Beaufort carries a LUP Classification of Developed, with all AEC's classified as Conservation. The Division of Water Quality classifies the waters of the creek as SC. Taylor's Creek is closed to the taking of shellfish, and is not designated as Primary Nursery Area. Taylor's Creek has an established Corps of Engineers Harbor Line for permanent structure setback purposes. Within this area of the creek, there is also a defined Turning Basin. The northern boundary of both run almost concurrently at the project location. The water body at the location of the proposed project is in excess of 700' across. The narrowest distance across the water body at this site would be in the distance across the creek westward to Piver's Island, which is approximately 500'. At the terminus of the proposed project, Taylor's Creek is in excess of -14' deep. The applicant is proposing to construct a 4' walkway along the high ground for the width of the property, or 104'. This structure will be constructed of drip-through timbers, and will provide access to the proposed docking system. The docking system will begin along the western property line (waiver included) with a 15' ramp leading to a 55' x 6' floating pier. The pier will terminate with an L-head floating dock extending eastward for a distance of 81.5' and a width of 6'. Extending from this main dock will be three finger piers, 20' x 3' in size. Landward of the main dock a finger pier, 20' x 3', will extend eastward of the pier. Mooring pilings (13 total) will be placed waterward of the finger piers, providing for a total of 8 slips. The five slips at the waterward end of the structure will be 15' x 40' in size, and the three extending from the pier will be 13' x 30'. The finger piers extending from the main dock at the waterward end of the structure will continue past the COE Harbor line for distance of 7', with the mooring pilings continuing for another 20' for a total distance of 27' waterward of the COE Harbor Line. The applicant recognizes this conflict, but is proposing the structure in a floating design, and in line with adjacent docks. The applicant proposes to construct a vinyl bulkhead wall 25-5' waterward of the existing riprap, for a total length of 1221. The area in front of this structure will be used for docking, and will consequently need to be excavated. Field Investigation Report: Doug Smith Page 03 While some of the adjacent shorelines have been excavated, and the COE channel waterward has been excavated, there is no evidence that this immediate area has been prior excavated. The substrate in the area is debris filled sand, heavily disturbed, and receiving a high level of boat wake. Current soundings indicate approximately -2' nlw in the area proposed for excavation, rapidly dropping to the connecting waters of -14' and greater. The applicant proposes to excavate an area of approximately 105' x 26' from the existing depth of -2' nlw . to a finished.depth of -8' nlw. This will require the removal of approximately 607 cubit yards of sand and debris. Anticipated Impacts: As proposed, the bulkhead will disturb approximately 1140 sf of high ground presently filled with riprap, and 315 sf of shallow bottom. The excavation will disturb 2730 sf of disturbed shallow bottom area, and will cause temporary turbidity impacts. The docking facility will incorporate 8360 sf of open water area, and shade 1098 sf of the same. The boardwalk will shade 416 sf of high ground, but will remain pervious. The proposal will add slips for 8 vessels to a system with a high level of boating use.
