After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. PROJECT SUMMARY: The applicant proposes to construct a 2,525 lineal feet, 10-inch maximum diameter force main pipeline from the Waste Water Treatment Plant to the Perquimans River. FIELD INVESTIGATION REPORT: Town of Hertford, Waste Water Treatment Plant Improvements Page 2 PROJECT SETTING The site of the development proposal is the existing Waste Water Treatment Plant for the Town of Hertford, located off SR 1110, approximately one-third of a mile north of SR 1109 in the northwest section of the town limits and adjacent to the Perquimans River. The Plant is located on a one and one-half acre lot that has an elevation of approximately 13 feet above Normal Water Level (NWL); vegetation was indigenous grasses; and has Altavista soils. The property, by way of an utility easement, has a 25-feet wide, -2 feet deep, and approximately 2,300 feet long outfall ditch that was cut through an existing maple, gum, and cypress swamp that borders the Perquimans River. The ditch connects with the Perquimans River in an area that has a maximum water depth of approximately -19 feet below NWL and a width of approximately 500 feet. The adjacent riparian properties consist of a continuation of the wooded swamp. A railroad track and trestle across the Perquimans River is located approximately 2,000 feet toward the east. The waters of the Perquimans River in this area are classified as C SW by the Division of Environmental Management and as closed to shellfish taking. DEVELOPMENT PROPOSAL The applicant proposes to make improvements to the existing Waste Water Treatment Plant that consists of construction of an effluent force main pipeline to a discharge point approximately -16 feet below NWL in the Channel of the Perquimans River. Construction will include the extension of 400 lineal feet of 8-inch PVC (open-cut) and 2,125 lineal feet of 10-inch HDPE (directional-bore) force main from the Town of Hertford Wastewater Treatment Facility to the channel of the Perquimans River. All construction, with the exception of force main buried beneath the Perquimans River, will take place on property owned by the Town of Hertford. The majority of force main will be installed beneath wetlands. However, all force main installed beneath wetlands will be by directional-bore only. The remaining portion of force main in upland areas will be installed by open-cut method. A minimum of 3-feet depth cover will be maintained throughout the entire wetlands and partial river crossing. The total area that will be disturbed during construction of the effluent force main is approximately 0.18 acres of upland area (400 feet by 20 feet) by open cut. All areas where directional-bore will take place will remain completely undisturbed, with the exception of the location of the effluent pipe end, which is estimated to be approximately 16 square feet. PLANNED EROSION AND SEDIMENTATION CONTROL MEASURES Silt Fencing - Silt fence will be installed as shown on the construction plans or as deemed necessary by visual inspection. This will be done by the contractor and inspected by the engineer to ensure all sediment is properly contained. Rock Check Dams - Rock check dams will be installed as a temporary measure throughout the project to restrict the velocity within the disturbed roadside ditches or channels affected thereby reducing the potential of erosion. These check dams will also serve as temporary sediment traps and will be placed wherever necessary as shown on the construction plans. 3. Temporary Inlet Protection - Inlet protection will be provided on all existing drainage pipes and inlets on the project to ensure proper sediment containment. ANTICIPATED IMPACTS The development proposal will disturb approximately 16 square feet of Public Trust Area, Area of Environmental Concern, river bottom and approximately 8,000 square feet of upland area by open cut installation of the pipeline. The existing train trestle is fixed and limits navigation of vessels other than small boats upstream of the trestle. The project does not appear to present a hazard to navigation in this area because of the significant water depths. A 20.0 ft. wide construction corridor was used in estimation of area to be disturbed by installation of effluent force main by open-cut method.
