"•yryy�..F.'�s..��i.11�.�ss 1 2 To Whom It May Concern: My name is Cheryl Magee D'Antonio and I am the owner and manager of Magee Mountain Cove, LLC which is the owner of record of a 9.57 acre parcel contiguous with Mill Creek Falls. As a matter of record, I also own the 2 parcels on the opposite side of Mill Creek Falls where our homes are situated and a parcel above the falls with approximately 280 ft frontage on Mill Creek. My father purchased the original parcel around 1989 and we have enjoyed being part time residents since that time. My goal is to preserve the property. As the years have progressed with more and more traffic on the lake, many speeding close to the shoreline, we have noticed increased erosion. As you know, Mill Creek Falls is a major attraction on the lake which means heavy boat traffic. We want all to enjoy the view, but as you can see from the attached photos, we are losing land as the water is pushed to the shore and undercutting the shoreline. The number of trees that fall into the lake because they lose the land support are increasing, noticeable and quite often a hazard to boating. Along lake frontage of this unimproved acreage, we are only seeking permission for rip rap stabilization, not a stone seawall. Our most recent 9.57 acre purchase has approximately 1200 feet of shoreline. Duke granted a permit to build stabilization on a portion of the property at the same time we had installed stabilization on the side opposite the falls, which are two separate parcels from the 9.57 acre parcel subject of this permit request. Duke established the point away from the falls that would be permissible to begin the stabilization. We have complied with Duke's regulations. Even though building a seawall of any sort is very costly, we are so concerned with stopping the erosion that we are willing to invest more money in this very expensive unimproved parcel to preserve it for our children and grandchildren. In attached photos 6 — (H) — (1), you can see the completed rip rap stabilization on the subject property and note that the plantings and trees were undisturbed. This is a natural, wooded, unimproved parcel with scrub growth meeting the shoreline. We have no intention of disturbing the natural habitat and undergrowth. It is my understanding that a permit allows 500 feet of stabilization without requiring a waiver. This would be our second permit as 300 feet of rip rap was installed previously on this parcel. We would appreciate your consideration in approving the permit for an additional 500 feet. In the alternative, an additional 200 feet would meet the 500 feet per parcel limitation.
