Raleigh, NC 27614 Subject Property: David Phillips 1102 Meadowbrook Dr. Garner Wake County DWO # 04-0876 Wake County Page 1 of 2 On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B .0233) Dear Mr. Philips: On June 1, 2004, at your request Danny Smith of the Central Office of the Division of Water Quality conducted an on-site determination to review a stream features located on the subject property, for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The Stream features are labeled as "A and B" and are depicted on the attached map. Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (RRO) had previously conducted an on-site determination of the streams. In your letter to the John Dorney received dated May 27, 2004, you requested an appeal of their determination as provided within 15A NCAC 02B.0233(3)(a). At your request, Danny Smith conducted an appeal of the determination as stated above. During his review he evaluated two streams. The stream feature "A", the focus of your appeal request, is located along the eastern property boundary edge and the stream reach labeled "B" (the stream that crosses the back of the lot). Both features ("A" and "B") were found to be a stream and are subject to the Neuse Riparian Buffer Rules. With respect to stream feature "A", the site visit revealed that stream is a modified natural stream. That is, in the past it had been relocated to its present day location. The stream origin of feature "A" is located 50 feet upslope from the confluence with steam feature B (see attached map). Further, a 50 foot riparian buffer applies up-slope from the origin location and along the stream bank on both stream features (both A and B). In addition to the stream origin determination, it was noted during the site visit that on going construction efforts on the subject lot have resulted in the stream channel being excavated, the stream banks were observed to be sloughing, the stream-side(riparian) vegetation has been graded and largely removed. Further, Mr. Smith observed that large amounts of sediment were being conveyed from the subject lot (land disturbaces) and into the stream feature "A" and "B". In response to your request and your efforts with Mr. Smith to resolve the compliance issues at this site, the following items are listed such that you may clearly understand what is required to bring this site back in to compliance with state regulations: 1) The streamside, stream bank and the construction areas must be permanently stabilized such that sediment is not reaching either of the stream segments ("A" and `B"). 2) A planting plan must be developed and implemented in order to ensure that at least two native tree species are planted at a density sufficient to provide 320 trees per acre at maturity within the Neuse River Buffer zone. This density is usually achieved by planting approximately 436 trees/acre on a 10 x 10 ft. grid (or about 50 trees/100 linear feet of streamside buffer impact). Please see the Guidelines for Riparian Buffer Restoration (January 2001) for assistance in developing your plan (available on the web site at htip:Hh2o.enr.state.nc.us/wM//pdf/buffers.Ddf). The DWQ has determined that the streams labeled as "A and B" on the attached map are at least "intermittent" and are subject to the Neuse Buffer Rule, as described above. This determination shall replace the determination originally performed by the Regional Office. This stream and it's associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This on- site determination shall expire five (5) years from the date of this letter. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Steve Mitchell and I have discussed this at length and he recommended I write to you. I requested, paid for and received a building permit for the lot from the Town of Garner. I have constructed a single family detached home on this lot within the prescribed building envelope. I asked the Town of Garner (specifically Tony Chalk) if they had any problems with me continuing the pipe now existing in the ditch for 150 feet. This would bring the outlet of the pipe to within 65 feet of what we all agree is a blue line stream running across the rear third of the property. He said he did not. That day I entered into a real estate contract to sell the home with the provision of piping the ditch as described and authorized above. A day later I received a call from Bridget, in that same Town of Garner office, saying I needed to contact Steve Mitchell for guidance in this matter. That contact has brought us to this point. I do not believe this is a stream subject to the buffer rule and I request that I be allowed to continue the existing pipe south 150 feet to a termination point using reinforced concrete pipe.
