Approval of 401 Water Quality Certification (GC3351) with Additional Conditions
Dear Mr. Pletenberg:
You have our approval, in accordance with the attached conditions, to dredge, fill and/or shade
0.15 acres of wetlands to conduct maintenance excavation in a manmade canal, enlarge an
existing basin, bulkhead common areas and construct a launch pier by an existing boat ramp as
described in your application received by the Division of Water Quality (DWQ) Wetlands/401
Unit on May 27, 2004. After reviewing your application, we have determined that the Division
of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water
impacts. This Certification allows you to General Permit No. 198000291 when issued by the US
Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any
other federal, state and local requirements before you go ahead with your project including (but
not limited to) erosion and sediment control regulations and LAMA. Also, this approval to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 21-1.0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

2. Certificate of Completion

applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401/Wetlands Unit, North Carolina

3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3351.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification, shall expire upon expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
water impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the
date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings,
6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Project Setting
Wide Waters Subdivision is a 22 lot development covering ±54 acres that was originally
permitted under CAMA Major Permit No. 140-90 issued to Sunbelco Realty Company on 5 October
1990. The project site is located at the end of SR 1783 on the Pamlico River and manmade canals
near the Town of Bath in Beaufort County, North Carolina. The major permit was issued for
maintenance excavation of existing manmade canals, installation of two groins into the Pamlico
River, construction of a boat ramp, and the creation of common areas. The existing canal system is
±40' wide by ±1,500' long with an average depth of --4' below the normal water level (NWL). The
entrance to the canal system is bordered by Coastal Wetlands dominated by Spartina cynosuroides
and Juncus roemerianus. The average elevation of the site is 4 to 5 feet above the NWL.
There are two common areas in the Subdivision adjacent to existing manmade canals. The
first is listed as site #2 in the application and is located at the east end of the canal system and
terminates in a small basin with an existing boat ramp. The adjacent area is vegetated with upland
lawn grasses with the exception of a small fringe (f2' wide) of S. cynosuroides at the water line. A
small community boat ramp exists in the southeast corner of the basin. The common area is
bordered by a gravel road on two sides and by a developed lot on the other two sides. The
developed property has a large upland area immediately adjacent to the common area on the north
side and is vegetated with upland lawn grass.
The second common area is identified as site #3 in the application and is located along the
east side of the northern most section of the canal system and this area is currently undeveloped.
The adjacent land is an old spoil pile that is vegetated with a± 15' wide fringe of mixed hardwoods
and upland grasses. The adjacent property is developed with a house and a gravel drive runs along
the property line with the common area.
Pamlico River and the connecting unnamed canal system in the project area are classified as
SA-NSW by the Environmental Management Commission. Pamlico River and the connecting
unnamed canal system in the project area are a Public Trust Area and are not open to shell fishing.
The area is within the DWQ Tar/Pamlico river basin.
Project description
The applicant proposes to undertake development in three areas: the entrance canal area
identified as site #1, the common area identified as site #2, and the common area identified as site
#3.
1) At the entrance canal, the applicant proposes to undertake maintenance excavation in
an area ±20' wide by ±200' long with an average existing depth of -2' to a finished depth of -4'
below the NWL. A dragline will be walked on the adjacent Coastal Wetlands using mats to protect
the marsh substrate. The excavated material will be trucked out using closed body dump trucks and
carried to an offsite upland site to be determined by the contractor.

2) At the common area identified as site #2, the applicant proposes to enlarge the
existing basin to ±30' by ±40' with a finished depth of --4' below the NAIL. The existing basin will
be maintained to a finished depth of-4' belowthe NWL. The spoil will be placed on adjacent high
ground owned by Heidi and Raymond Souza and silt fence is proposed to contain the spoil until it is
dry. After the material has dried, it will be spread on the Souza's property to level the area and
seeded to stabilize it. The perimeter of the expanded basin will be bulkheaded (±110') and
backfilled. A ±3' wide by ±I 10' long dock is proposed adjacent the new bulkhead. The applicant
proposes to construct a±3' wide by ±20' long launch pier beside the existing boat ramp.
3) At the common area identified as site #3, the applicant proposes to construct ±120'
of bulkhead 2' waterward of the NWL and backfill. A ±3' wide by ±120' long dock is proposed
adjacent the new bulkhead.
Anticipated impacts
The project as proposed will result in the filling of ±460 ft2 of canal bottom associated with
construction of the bulkheads. The excavation to enlarge the basin as well as the maintenance
excavation activity of the existing manmade canals will result in the excavation of ±5,200 ft 2. The
pier and dock construction will result in the shading of ±750 ft' of manmade canal bottom. The
project as proposed will result in localized turbidity as a result of the construction activities.

existing canal system at Wide Waters. The project we are
proposing is totally located on property held by the Wide Waters
Advisory Association Inc. for the common use of its residents
It consists of three (3) separate sites.
#1 The purpose of site #1 construction is to remove sediment
washed into the mouth of the canal by various storms over
the past decade. This area is used as the only path of
access between the existing canal system and the Pamlico
River. We are proposing the use of a drag line to excavate
the area and place spoils in closed body dump trucks which
will haul the material to the contractors location off of
the project site. Log mats will be required in the wetland
areas.
#2 The purpose of site #2 construction is to enlarge the basin
by the boat ramp and provide more stable conditions for
access to boats with the addition ofa finger pier at the
ramp and bulk heading and dockage on the perimeter of the
basin. This area is used exclusively for residents to
launch and temporarily moor their boats for weekend
use. We are proposing the use of a drag line to excavate
the area and place the spoils on the private property
adjacent to the basin on the north which is presently owned
by Heidi & Raymond Souza, located at 846 Wide Waters Drive.
The spoils will be contained by necessary silt fencing.
#3 The purpose of site #3 construction is to provide more stable
conditions for access to boats with the addition of bulk
head and dockage. This area is used exclusively for resi-
dence to moor boats temporarily on weekends.
All bulk head, docks and piers mentioned in items 2 & 3
will be of pressure treated wood.

containing details and drawings for their approval, by certified
mail, and will send the return cards to your office upon our

This letter authorizes the Wide Waters Advisory Association to use the
SW corner of our property (the area closest to the area being excavated and
- the r$ad j, lecaWd at 84fi Wide Waters Dr., for the placement-of of spoils from
the excavation of the boat dock area for drying. After-the drying time is
complete the spoils will be spread over the yard with the help of the
Association's equipment.
