S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated June 29, 2004. The applicant, Pirate's Den Homeowners Association (HOA), has applied for a Department of the Army (DA) permit to reconfigure the dockage of an existing marina. The proposed work is being considered under Regional General Permit #198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Proposed Activities The applicant proposes to remove existing fixed finger piers and replace them with eight floating docks. The new docks would create 14 slips, an increase of four slips. The dock is adjacent to a man-made canal which is a tributary to Bogue Sound. Water depths at normal low water at the project site range from two and a half feet at the bulkhead to eight feet at the waterward tie poles. The application for the North Carolina Division of Coastal Management (NCDCM) permit notes that "basic marine construction principles" would be employed. The NCDCM Field Investigation Report (FIR) states that the new dock configuration would usurp 3,200 square feet (ft) of open water, 950 ft2 more than the existing facility. The new configuration would shade 1,080 ft2 of high ground and 800 ft2 of open water. 2 Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Carteret County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is located in the Beaufort quad. The occurrence data of special status species within this quad can be obtained on the internet at < http://www.ncsparks.net/nhp/quad.html >. Our review indicates that the only federally listed species likely to occur in the project area is the West Indian manatee (Trichechus manaeus), a federally-endangered mammal. The species is known to occur in Carteret County and the NCNHP database indicates three manatee occurrences in the estuarine water of Bogue Sound, the area north of Morehead City, and the ocean off Atlantic Beach. The shallow, estuarine waters in the project area may provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees feed in water one to two meters (3.3 -6.6 feet) deep that may support submerged aquatic vegetation. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < http://nc-es.fws.gov/mammal/manatee guidelines.pdf>. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. Service Recommendations With the inclusion of our manatee guidelines, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. Based on the available information, we do not believe that the proposed activity will have significant adverse and/or irreversible effects on general fish and wildlife resources under our jurisdiction. Therefore, with prudent measures to protect manatees the Service has no 3 objection, from the standpoint of fish and wildlife, to the issuance of a DA permit for the proposed work. NARRATIVE DESCRIPTION: Project Setting Pirates Den Condominiums are located at 127 Old Causeway Road in Atlantic Beach, Carteret County. You can access Old Causeway Road by turning west off the Atlantic Beach Causeway at the Scotchman gas station and Pirates Den Condos is located just to the west of the Seascape Condos and to the east of Pond Drive. Pirates Den is a residential condominium complex located on approximately 0.6 acres consisting of two (2) buildings, each accommodating sixteen (16) units. The complex tract is 3-4 feet above NHW (Normal High Water) and is directly adjacent to a manmade canal, ultimately a tributary to Bogue Sound. The majority of the tract is impervious with buildings and parking areas. The only area currently pervious is a small strip of lawn grass directly landward of the recently completed seawall. The adjacent property to the south is occupied by Seascape Condos who was issued a major permit within the last year for a similar docking structure. The property to the north is a single-family residence with several boatlifts. The property is bulkheaded 180' along the manmade canal with an extra wide bulkhead cap approximately V over water and l' over highground running the same orientation. Specifically the existing docking structure consists of eight (8) fixed finger piers spaced somewhat evenly down the face of the bulkhead. The space between finger piers is intended to serve as the available docking spaces currently advertised to the owners as ten slips. There are several pilings between fixed piers that have been broken off and lie just below the water level. The finger piers, which define the waterward footprint of the current configuration, extend approximately 15' into the canal from the face of the bulkhead. There is a sitting area over the water, which measures 35' by 12' located at the center of the property. The manmade canal, which appears to be unnamed, runs south to north ultimately connecting to Bogue Sound. Although classified SA-HQW, therefore suitable for commercial shellfishing and other tidal saltwater uses, the canal is closed to shellfishing. The area does not serve as a primary or secondary nursery area. The water depths within the footprint of the facility range from two and a half feet (2.5') at the face of the bulkhead to eight (8) feet at the outer tie poles taken at normal low water. The bottom substrate appears to be sand with no signs of submerged aquatic vegetation present. Project Description The project involves the reconfiguration of the existing marina facility to accommodate four additional vessels. The project is being reviewed under the major permit process because it will require development outside the existing footprint and increase the number of slips by four (4). The fixed finger piers are proposed to be replaced with eight (8) new floating finger piers spaced in a manner to provide fourteen (14) slips within the existing property boundary. The proposed floaters will be attached to pivoting ramps (10' by 2.5') from the high ground to allow for safe access. The floating finger piers would measure sixteen (16) by four (4) feet and would extend offshore a maximum distance of twenty (20) feet. The center sitting area would be downsized to a 20' by 12' platform, this reduction would allow for the four-slip expansion. FIELD INVESTIGATION REPORT: PIRATES DEN CONDO OWNERS ASSOCIATION / CARTERET COUNTY PAGE ##3 The distance across the canal has been measured to be one hundred three (103) feet with the quarter distance across the canal being twenty-five (25) feet. The water depths as noted earlier drop significantly from the bulkhead to the ends of the proposed floating finger piers. The average depth at the bulkhead is two and half (2.5) feet while the average depth at the ends of the proposed floaters averages eight (8) feet at normal low water. The proposal appears to be consistent with the adjacent pier lengths within the same area. The agent has secured the fifteen (15) foot setback waivers from the adjacent riparian property owners and made them a part of this package. The last aspect of this project is to convert a portion of the existing grassed area landward of the bulkhead to a 6' wide shore parallel wooden slated boardwalk. Anticipated Impacts The proposal will usurp 3,200 ft' of open water, this amount being 950 fe additional impact over the existing configuration. The proposed structure would shade 880 ftz of shallow water habitat, an increase of 100 W. Short-term turbidity would be expected through the installation of the new pilings to hold the floaters yet long-term turbidity would not be expected based on the adequate water depth offshore along with the sandy substrate. Improved boating dockage would occur as a result of the proposal. The proposal if approved would increase the number of slips from 10 to 14 technically creating a new marina. The project is not being reviewed through the SEPA process due to its location in a highground manmade canal system. Brad E.
