Dear Sirs:
The attached information is furnished to secure a permit for the proposed replacement of a retaining wall
and seawall at the Abbott lake home located at 173 Tryon Bay Circle in Lake Lure, N.C. '['lie retaining
wall has recently been described as "in a hazardous condition" by the Senior Inspector of the Rutherford
County Inspections and Planning Department. In addition, the inspector noted that "tic only practical
solution I see is complete removal and reconstruction under the design and supervision of a licensed
engineer" (Copy enclosed). The attached plans provide an engineered solution on essentially the same
footprint as the existing stricture. The seawall must also be removed and replaced because it has tailed as
well and will not provide adequate support for the new retaining wall in its present condition.
In addition to the information provided as requested in section 11 of the application, there are several
photographs of the existing structure included in the package.
"Chc Town of Lake Lure has given notice that the lake level will be lowered from early December until
late January'. Mr. and Mrs. Abbott would like to take advantage of this opportunity and undertake this
difficult project during this time period. Approval of this application as soon as possible would be
appreciated

Certification to impact FERC (Federal Energy Regulatory Commission) regulated lake shore or
bottom under the U.S. Army Corps of Engineers Permit GP30. This Application cannot be used
for wetland or stream impacts. Please provide five (5) copies of this application and supporting
information as well as a non-refundable application fee to the Division of Water Quality of $240.00
for impacts to lake bottom of less than I acre and $570.00 for impacts to lake bottom of greater or
equal to 1 acre.

Dear Sheila,
As per your request, I have examined the retaining wail at 173 Tryon Bay
Circle. It is, indeed, in a hazardous condition. it has sagged, leaned, and
bulged until it appears in danger of total failure. Failure would likely
damage the boathouse below it and would expose the house foundation to
erosive undermining.
The only practical solution I see is complete removal and reconstruction
under the design and supervision of a licensed engineer.
