Raleigh, NC 27615 RE: Nationwide Permit 39 Creedmor Crossing Creedmor, Granville County, North Carolina Dear Mr. Yates: On behalf of Barnett Properties, Henderson, NC (property owner), we hereby request authorization from the US Army Corps of Engineers (USACE) to use Nationwide Permit 39 for proposed permanent impacts to a tributary of Robertson Creek resulting from an access road crossing. The impact site is not located on a buffered stream channel and stream impacts are less than 150 linear feet, therefore, written .401 Certification is not required. A Pre-construction Notification Application (PCN) is attached, which includes an Agent Authorization Form. The site is 19.1 acres in size and is located north of N.C.. Highway 56, east of the town of Creedmor; Granville County, North Carolina. The site is an undeveloped, wooded area located in the Neuse River Basin.. Please refer to the attached Figure 1 for the project's location on a USGS topographic quadrangle. The proposed project is a shopping center complex with access drives, parking areas, and typical utilities (sanitary sewer, water, electric, etc.) One stream crossing is proposed in order to construct an access drive, which will be -used to access the property from NC Highway 56. No previously issued permits are known to exist for the site. Nationwide Permit 39 In order to comply with focal ordinances, it will be necessary to provide an access road that lines up with an existing intersection, thereby impacting 149 linear feet of stream.. It has been determined by the USACE that 108 feet of that impact is classified as an important stream, while the DWQ has determined the entire length of impact to be intermittent. This project will comply with the general and regional conditions of NWP 39. No wetlands will be impacted by the proposed road crossings. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the thresholds for notification (0.10 acre) or if a discharge causes the loss of any open waters. S&EC does not believe mitigation should be required by the USACE for this project since impacts to channels are less than 150 feet. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. If full-size plans are reduced to a small scale such that the final version is illegible, the applicant will be informed that the project has been placed on hold until decipherable maps are provided. 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The entire site plan was redesigned so that only one road crossing is required. The original plan required almost 400 ft of stream impact for the parking lot. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Page 10 of 13 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Impacts are below DWQ thresholds. so they should not require mitigation (<150 ft impact and channel is DWQ intermittent). Because impacts have been minimized and avoided to the greatest extent practical and because remaining jurisdictional areas will be preserved we do not believe the Corps should require mitigation. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. This project consists of the construction of a new 62,674 square foot shopping center, located along Hwy 56 in Creedmoor. The site will disturb 17.0 acres for the construction of the buildings, parking and the widening of Hwy 56. The property is located in the Neuse River Basin. As shown on the attached plans, there will be two stream impacts associated with the proposed development. Stream impact one, which is approximately 107.85 linear feet, is necessary to accommodate a new driveway from the eastern side of the site. This driveway is needed to allow both fire trucks and 18-wheel trucks access to the rear of the building, without mixing with pedestrian and shopper traffic along the front. This additional access point will allow 18-wheel trucks to have one way in and one way out. This one-way access will avoid the need for a turnaround area at the rear of the building and additional wetland impacts associated with it. NCDOT regulates the spacing of commercial driveways and requires a minimum of 600 ft between two driveways. In this instance, NCDOT is allowing a slightly shorter distance to align the proposed eastern entrance with an existing driveway across the street. As a result, we have provided approximately 558 linear feet between the two driveways. Stream impact two, which is approximately 41.15 linear feet, will occur as a result of widening of NC Highway 56. NCDOT will require a continuous three-lane section across the frontage of the property. This widening will involve a pipe extension and subsequent fill material in the stream.
