After reviewing your application, we have determined that the Divisidn of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: Construct 657 linear feet of replacement dock, place 8-feet wide section of stone riprap along 265 feet of shoreline, replace 92-feet long bulkhead adjacent to Atlantic Intracoastal Waterway (AIWW). FIELD INVESTIGATION REPORT New Coinjock Investors, LLC Page 2 PROJECT SETTING New Coinjock Investors, LLC, owns a 2.4-acre restaurant/marina complex on the east side of the AIWW, Coinjock, Currituck County. To access the property, turn off US Highway 158 onto Waterlily Road. Then travel one mile and turn left (west) onto the subject's property, which is designated by the Coinjock Marina Restaurant sign. The shoreline of the property extends 1,087 linear feet along the eastern shoreline of the AIWW. Elevation of the site ranges from Normal Water Level (NWL) to 4 feet above NWL. The presence of wetlands was not noted in the project area. Man-made features on the site include a restaurant, bathhouse facility, ships store, residence, graveled parking, concrete riprap, 100 feet of deteriorated wood bulkhead, and 1,087 linear feet of dock. The AIWW is approximately 300 feet wide and is maintained to a depth of 16 feet. The waters in the vicinity of the project area are classified as SC by the NC Environmental Management Commission. These waters are classified as Joint Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission and as Estuarine Waters and Public Trust Waters by the NC Coastal Resources Commission. Water depths in the project area (out to 10 feet in the canal) measure 0.5 feet to 10 feet below NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of the project. Review of available information suggests that there are no known archeological sites or geologic formations associated with the applicant's property. PROJECT DESCRIPTION The northernmost 430 linear feet of dock and shoreline was improved in early 2002 in accordance with CAMA General Permit #31225A. At that time, the existing section of riprap was widened to 5 feet and 430 linear feet of the dock was replaced. The applicants seek authorization to provide improvements to the remaining 657 linear feet of shoreline. For descriptive purposes, the 657-feet long project area will be separated into four areas (from north to south) as follows: • Area I: The 200 linear feet of old 13-feet wide dock lying immediately south of the new dock will be removed and replaced within same footprint. • Area II: The 92 linear feet of deteriorated timber bulkhead located 4 feet waterward of the west wall of the ships store will be replaced. The applicant proposes to place corrugated vinyl sheet piles 3 feet waterward of the wood bulkhead and to widen the dock within this area from 4 feet to 7 feet wide. t• FIELD INVESTIGATION REPORT New Coinjock Investors, LLC Page 3 • Area III: Within this next 100-feet long segment, the applicant proposes to replace a section of 8-feet wide dock with a 10-feet wide dock (widened 2 feet landward) and remove 144 square feet of existing platform, which lies landward of the new dock alignment. • Area IV: This last section of 6-feet wide by 265-feet long dock is to be replaced with a 10- feet wide dock, which will extend 6 feet waterward of the old dock alignment, but no farther waterward than the old dock alignment within Area III above. Within this area, an 8-feet wide section of riprap consisting of Class 1A stone would line the bank at 3:2 (H:V) slope. ANTICIPATED IMPACTS • The construction of the 92-feet long vinyl sheet pile bulkhead 3 feet waterward of the existing wood bulkhead will eliminate 276 square feet of Estuarine/Public Trust Waters Shallow Water Habitat. • The placement of an 8-feet wide section of stone riprap along 265 linear feet of shoreline will eliminate 2,120 square feet of Shallow Water Habitat. • The construction of the 657 linear feet of new dock will shade 5,520 square feet of Estuarine/Public Trust Waters. • Short-term localized turbidity will occur during installation of the vinyl sheet pilings and pier pilings. • No increase in the linear footage of commercial dockage is proposed. No additional navigational impacts are anticipated as a result of the project. • The dock is proposed a maximum distance of 13 feet waterward of NWL along the 300- feet wide canal. The docks meet and exceed the NC Coastal Resources Commission's rules, which limit the maximum distance to one-third of the width of the water body. • The proposed dock would lie only 4 feet from the southern riparian line. A waiver from the required 15-feet setback was submitted with the application. • No additional docking spaces are proposed as part of this project. The proposed work is a continuation of similar improvements recently completed under General Permit No. 31225A, issued on January 14, 2002. The current application entails the improvements generally described above along approximately 657 ft. of shoreline immediately south of the newly renovated dock. In addition to protecting the shoreline against erosion caused by strong tides and heavy boat traffic, the dock improvements are necessary for the safety and convenience of the marina clientele. The existing dock is aged, too narrow to adequately accommodate the increasing numbers of vessels and their passengers and problematic due to the shift in alignment existing near the south end. The proposed improvements will result in a new dock, located with the same waterward alignment as the existing dock, with the exception of the most southerly 265 ft., which currently jogs toward the shoreline and narrows. The irregular outboard alignment creates difficulty for mariners attempting to moor alongside the existing dock and the narrow existing dock and the narrowness of the existing dock inhibits the marina patrons ability to safely transport stores and equipment on and off their vessels. The section of new dock immediately in front of the ship's store/ dockmaster's office will be upgraded with a new corrugated vinyl bulkhead to replace the existing, deteriorated timber bulkhead. This segment of shoreline cannot be readily accessed to install rip-rap, as proposed for the majority of the shoreline. The new dock will be located such that, with the additional shoreline armament, the outboard edge of the dock will not be in excess of 8 ft. from the new normal water level. This configuration is illustrated on Exhibit 2, a supplemental detail sheet included in the application package. The dock construction will consist of installing driven or jetted pilings followed by conventional framing of stringers, joists and decking. Shoreline rip-rap installation will be accomplished by placing the material with a long reach excavator to the design lines and grades.
