Road, Harkers Island , as requested in the permittee's application dated 4/2/04 (MP-1, MP-2, MP-
3) and 6/28/04 (MP-5), including the attached workplan drawings labeled 4-6 of 6, all dated 3/31/04
This permit, issued on January 25, 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Subdivision Development
1) Unless specifically altered herein, this permit authorizes only the subdivision development, including
roads, culverts, underground utilities, a three-acre pond, an irrigation system and stormwater
conveyance swales, that are specifically depicted in the attached permit application and workplan
drawings. Any future subdivision development, including but not limited to the construction of
single-family residences, may require additional authorization. Contact the Division of Coastal
Management at (252) 808-2808 prior to the commencement of any such activity for this
determination. The permittee is further advised that many non-water dependent activities are not
authorized within 30 feet of the normal high water level.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2008

ADDITIONAL CONDITIONS
2) All material utilized for filling and grading purposes shall be clean and free of any pollutants except in
trace quantities.
Shoreline Stabilization
3) The bulkhead alignment shall approximate the normal high water level at the time of construction.
4) The alignment of the authorized bulkhead shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
8) The back fill material shall be clean and free of any pollutants except in trace quantities.
Stormwater Management
9) The Division of Water Quality approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SW8040409.
Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
10) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that materials do not enter adjacent wetlands, watercourses or properties (e.g. silt fence, diversion
swales or berms, etc.).

12) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing(s).
13) The construction of the authorized subdivision shall not directly result in any closure of any waters that
are open to the taking of shellfish. Any such closure directly attributable to the subdivision shall require
that the permittee undertake remedial actions to remedy the situation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 041212), which was issued on 11/8/04.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit
No. 18 (COE Action Id. No. 200401029), with a special condition that all remaining wetlands on
site be preserved.
NOTE: The permittee is advised that lots 20, 21, 22, and 28 contain a significant amount of wetlands.
Future development of these lots should be designed in such a manner as to minimize or avoid
impacts to these wetland areas.

Dear Mr. Edwards:
You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct the
following activity at your property off of Old Ferry Dock Road (SR 1336) in Carteret County. This
approval allows you to:
1. Fill 0.04 acres of 404/401 wetlands for the purpose of a road crossing and build an elevated
wooden walkway approximately 6' X 246'across wetlands.
This approval is only valid for the purpose and design that you described in your completed CAMA
application received by the Division of Water Quality (DWQ) on July 23, 2004 with additional
information received on October 13, 2004 and November 5, 2004. After reviewing your application, we
have determined that General Water Quality Certification Number 3400 covers this activity. This
Certification can also be found on line at: http://h2o.enr.state.nc.us/ncwettands/certs.html. This
Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues
it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your
project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your completed CAMA
Major Permit application received by the Division of Coastal Management on July 13, 2004. If you change
or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us
a new application for a new certification. If the property is sold, the new owner must be given a copy of the
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to this office and a copy to the 401 Oversight/Express Review Permitting Unit,

2. No excavation and no waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or
riparian areas beyond the footprint of the impacts depicted in the CAMA Major Application. All
construction activities, including the design, installation, operation, and maintenance of sediment
and erosion control Best Management Practices, shall be performed so that no violations of state
water quality standards, statutes, or rules occur.
Please notify this Office at the number listed below if any problem arises during the construction of
the project that may affect water quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the DWQ Permit #041212 under Section 401 of the Clean Water

Dear Ms. Steenhuis:
The enclosed information is submitted in response to your letter of August 3, 2004 regarding the referenced
project.
Your comments are addressed as follows:
1. A signed jurisdictional wetlands map for the property signed by Corps of Engineers representative is
enclosed (2 copies).
2. A project site plan (titled Site Plan) is attached showing potential buildable areas for lots 20, 21, 22
and 28. These lots include significant wetlands coverage. The potential buildable areas are outlined
taking into consideration Carteret County building setback requirements of 10 feet from side property
lines, 20 feet from front property lines, and 30 feet from rear property lines as well as some setback
from existing wetlands. The potential buildable areas exceed the impervious surfaces limitations of
the stormwater permit and restrictive covenants of 6,400 square feet per lot for all 28 lots. The lots in
question have the following potential buildable areas as shown on the attached site plan.
Lot 20 12,570 s.f.
Lot 21 9,460 s.f.
Lot 22 8,200 s.f.
Lot 28 8,680 s.f.
3. Groundwater at the site is controlled by tidal water elevations. Excavation of the pond will expose
the groundwater in the location of the pond. Since there will not be a structure or pipe for discharge
of water from the pond, drawing down the water level in the pond below groundwater levels will not
occur and a net groundwater flow towards the pond would not be expected. Excavation of1he pond
will not result in a drawdown of groundwater and subsequent draining of surrounding wetlands.
4. No pipe will pass through wetlands. There are three cross drainage pipe locations in the project. Two
of the pipes will drain to grass lined swales which outfall to Westmouth Bay. The ditches discharge
across areas designated as wetlands on the Corps of Engineers Wetlands maps but are not claimed. as
jurisdictional coastal wetlands by the Division of Coastal Management. The coastal wetlands claimed
by Division of Coastal Management are shown on the attached site plan. These are the coastal
wetlands areas indicated in the CAMA Major Permit Documents.

5. A copy of the draft restrictive covenants pertaining to stormwater management and wetlands
encroachment are enclosed. The wetlands covenants are based on guidelines provided by the Corps
of Engineers.
This information should permit you to issue the 401 Water Quality Certification for the project.

DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS FOR
STORMWATER MANAGEMENT AND
WETLANDS CONSERVATION
FOR WEST BAY SUBDIVISION
THIS DECLARATION, made on the date hereinafter set forth by BLE,
DEVELOPMENT, LLC, a North Carolina limited liability company, hereinafter referred to
as "Declarant."
WITNESSETH:
WHEREAS, Declarant is the owner of certain property in the Carteret County,
North Carolina, which is more particularly described as follows:
All of that certain parcel of land shown on the plat prepared by TrueLine
Surveying, P.C., and entitled "Preliminary Plat of Westbay Subdivision,
Harkers Island Township, Carteret County, North Carolina" dated
3/31/2004, and being the same land described in a deed recorded in Book
738, Page 176, Carteret County Public Registry (The "Property")
WHEREAS, it is the intent of the Declarant to develop all or a portion of the
Property into residential lots; and,
WHEREAS, the Declarant desires to satisfy the requirements of the North
Carolina Department of Environment and Natural Resources in conjunction with the
stormwater management permit for West Bay Subdivision, and has prepared the
following covenants to meet the requirements of the state agencies;

WHEREAS, the Declarant desires to satisfy the requirements of the U.S. Army
Corps of Engineers in conjunction with a wetlands impact permit for West Bay
Subdivision, and has prepared the following covenants to meet the requirements of the
U.S. Army Corp of Engineers;
NOW, THEREFORE, Declarant hereby declares that the Property, shall be held,
sold and conveyed subject to the following easements, restrictions, covenants and
conditions, which are for the purpose of protecting the wetlands and other natural
features of the Property, and which shall run with the real property and be binding on all
parties having any right, title or interest in the described property or any part thereof,
their heirs, successors and assigns, and shall inure to the benefit of each owner thereof.
Wetlands Provisions. All of the Properties subject to these Declarations,
Conditions, Covenants and Restrictions shall also be subject to the
following Special Provisions Relating to Wetlands. In developing the
Property, the Declarant has agreed with the State of North Carolina and
the Department of the Army Corps of Engineers (pursuant to a permit
issued by the State of North Carolina and the Corps of Engineers0 to
restrict and prohibit any future filling or other detrimental activities in the
wetland areas which presently exist within the identified area of the
property. Accordingly, all wetlands shown and delineated on the wetland
survey plated dated March 31, 2004, as depicted verified by the Corps of
Engineers on shall be maintained in perpetuity in their
natural or mitigated condition (other that the permitted wetlands filled for
the road crossing). No person or entity shall fill, grade, excavate, or
perform any other land disturbing activities; nor cut, remove, or harm any
vegetation; nor construct any structures, nor allow animal grazing or
watering or any other agricultural use on such conservation area. Benign
structures, such as pile supported walkways, may be permissible only
after reviewed and written consent is provided by the U.S. Army Corps of
Engineers. This covenant is intended to ensure continued compliance
with the mitigation condition of authorizations issued by the United States
of America, U.S. Army Corps of Engineers, Wilmington District, Action ID
200401029, and therefore may be enforced by the United States of
America. This covenant is to run with the land, and shall be binding on the
Owner (Declarant), and all parties claiming under it. This paragraph
number 1 cannot be amended or modified without the express written
consent of the U.S. Army Corps of Engineers, Wilmington District.
2. Stormwater Provisions.
A. The following covenants are intended to ensure ongoing compliance
with the State Stormwater Management Permit Number
for WEST BAY SUBDIVISION, as issued by the
Division of Water Quality under NCAC 2H.1000.
B. The State of North Carolina is made a beneficiary of these
covenants to the extent necessary to maintain compliance with the
stormwater management permit.
C. These covenants are to run with the land and be binding on all
persons and parties claiming under them.
D. The covenants pertaining to stormwater may not be altered or
rescinded without the express written consent of the State of North
Carolina, Division of Water Quality.
E. Alteration of the drainage as shown on the approved plan may
not take place without the concurrence of the Division of Water Quality.
F. The maximum allowable built-upon area per lot is 6400 square
feet. This allotted amount includes any built-upon area constructed within
the lot property boundaries, and that portion of the right-of-way between
the front lot line and the edge of the pavement. Built-upon area includes,
but is not limited to, structures, asphalt, concrete, gravel, brick, stone,
slate, and coquina, but does not include raised, open wood decking, or the
water surface of swimming pools.
G. Lots within the Coastal Area Management Act's Area of
Environmental Concern may have the permitted built-upon area reduced
due to the CAMA restrictions within the AEC areas. The state of North
Carolina is a third party beneficiary to the provisions of this Paragraph and
may enforce the same through proceedings, in law or in equity.
H. The only permitted access to each lot from the subdivision
street shall be over an average width driveway or crossing or culvert
constructed over the drainage ditching and swales along the subdivision
roads. The filling in or piping of any vegetative conveyances (ditches,
swales, and the like) associated with West Bay Subdivision except for
driveway crossings, is strictly prohibited by any persons. No lot owner
shall fill in or alter any of the drainage system, ditches or swells of the
subdivision unless the same shall be first approved in writing by both the
Developer and the North Carolina Division of Water Quality or other
applicable state agency.
1. Each lot will maintain a 30-foot wide vegetated buffer between all
impervious areas and surface waters.
J. All roof drains shall terminate at least 30-feet from the mean
high water mark of surface waters.
K. No lot including those still owned by the Declarant shall be
further subdivided, or its boundary lines changed, except with the prior
written consent of the Declarant and the written approval of the Division of
Water Quality, North Carolina Department of Environment and Natural
Resources.
L. All stormwater facilities, roads, utilities, Areas of Environmental
Concern, archeological sites, common areas and other properties within
the Subdivision shall be maintained at all times in a manner consistent
with the regulations and permits issued by all State and Federal agencies,

9. Narrative Description:
The project site is a 28.17-acre tract adjacent to Westmouth Bay on the north side of
Harker's Island in Carteret County. The property is immediately west of the old ferry
landing to the island. To access the site, take Highway 70 in Carteret County east to
Harker's Island Road to Harker's Island. Take Island Road east to Old Ferry Dock Road.
The property lies on. the west side of the terminus of this road. There is an unnamed,
unimproved road that connects Old Ferry Dock Road and Johnson Road that forms the
southern boundary of this property.
This is a site of previous disturbance vegetated primarily with shrub/scrub vegetation, young
pines, and ferns. Small oaks and bays line the ± 1' escarpment. Section 404 Wetlands
occupy a large portion of the property, and have been delineated and approved by the US
Army Corps of Engineers. There is an existing unimproved roadbed that extends in a "U"
shape around the property perimeter. All of the federal wetlands lie to the interior of this
unimproved road. The property varies from 3' to 8' above msl in elevation.
The shoreline adjacent to the tract is one of very high energy that is indicated by the tree
stumps and escarpment. There is a rock groin immediately east of the property that protects
the entrance canal of a marina. This feature has also had an impact on the shoreline,
creating a very sandy substrate. There are leased shellfish gardens to the east and west of
the project site within the bay. Very little marsh vegetation exists along this shoreline, most
being on the west -end at the waterward terminus of a drainage ditch (which forms the
western property line) and a small pocket being located at the landward end of the groin to
the east.
The waters of Westmouth Bay are classified SA by the Division of Water Quality. The
Division of Marine Fisheries does not designate this area as Primary Nursery Area. The
immediate vicinity of the proposed is open to the taking of shellfish for consumption.
However, the adjacent marina is closed. The Carteret County Land Use Plan classifies this
area of the county as Limited Transition, with all AEC's classified as Conservation.
The applicant proposes to subdivide the tract into 28 lots, provide the road system, utilities,
wastewater treatment system, and shoreline stabilization. A sedimentation/erosion control
plan, a stormwater plan, and a drip irrigation waste system proposal have all been submitted
to the appropriate agencies for approval. Municipal water will be supplied by Harker's
Island.
The proposal is to utilize the existing dirt road to the extent possible for the new road. The
subdivision entrance will connect to the northern end of Old Ferry Dock Road, and will
continue in a loop road around the development. Nineteen lots will fall outside of this road,
and nine will lie internal to the road. Lots 28, 20, 21, and 22 contain a significant amount of
federal wetlands.

The road right of way is proposed at 501. The entrance blacktop will be 32', with the
remainder of the 2600' road having an 18' paved travel way. On the southwest side of the
property, the road and shoulders will require the filling of .04 acres of Section 404 Wetlands.
There are double-pipe and single-pipe culverts proposed under the roadway for stormwater
conveyance that connect to swales leading to the shoreline. Approximately 2860' of force
main is proposed within the right-of-way, and 2885' of potable water line. The wastewater
treatment plant, gravel access, and drip disposal area are proposed for the southeast corner
of the property.
Internal to the roadway, there is a 3-acre pond shown as being a "possible future" feature.
The application states that this pond will be excavated and the spoil utilized for road
construction. Therefore, it must be considered as a part of this application. The pond area
is currently all high ground.
Along the shoreline of Westmouth Bay, the applicant proposes to stabilize the shoreline with
a vinyl bulkhead wall. This structure will extend just shy of the length of the shoreline along
the normal high water contour line, terminating short of the wetlands on each end. The total
structure will be 862' in length, and will have 2 areas allowing for the discharge of
stormwater from swales carrying water from the internal lots through the culverts. These
Openings will be 12' in width and lined with rock to a point no further waterward than the
bulkhead itself.
10. Anticipated Impacts:
Approximately 9.6 acres are proposed for disturbance for site preparation. Of this, .04 acres
are Section 404 Wetlands. The applicant states that there will be a resultant 10.6%
impervious within the AEC; however, I believe this calculation was made for the entire tract
rather than the 75' covered by the Estuarine Shoreline AEC. Within the AEC itself, there is
no impervious proposed. Turbidity may be created during the installation of the bulkhead,
but this should be minimal as the proposed is a vinyl structure and will extend only to the
normal high water contour.

The West Bay development is a 28-acre residential development located on the north shore of Harkers
Island on Westmouth Bay. The site can be reached by turning north onto Old Ferry Dock from state road
1335, the main access road on the island. As shown on figure 1, the site is on the west side of Old Ferry
Dock Road before the road runs into the Bay (see sheet 2 of Application Drawings). The site is currently
undeveloped but, over time, roads and ditches have been cut into the site. Approximately 1040 feet of
the site fronts on Westmouth Bay.
PROJECT DESCRIPTION
The project consists of the following elements:
• Construction of 862 linear feet of low bulkhead to stabilize the eroding estuarine shoreline.
• Construction of the bulkhead will require removal of tree debris and general cleanup of trash
along the shoreline.
• Development of 28 acres of upland areas into 28 single family lots meeting the low density
requirements for stormwater management. The site development includes construction of a
paved road and underground utilities.
• Creation of a 3 acre pond which will have a surface water elevation generally at the groundwater
level. Soil from the pond will be used on the site for road construction and general fill.
• Wastewater will be handled by an onsite wastewater treatment with surface drip disposal of
treated effluent.
• The drip irrigation system will be supplemented by reuse of treated wastewater effluent for toilets
in residences and for lawn irrigation.
• Stormwater will be overland flow in grass lined swales except for several pipes to convey
stormwater beneath the road. A stormwater management plan will be filed concurrent with this
major CAMA permit.
• Water for drinking and fire protection will be provided by Harkers Island Electric Membership
which has existing pipelines along Old Ferry Dock Road.
EXISTING CONDITIONS
The West Bay site is located on the north shore of Harkers Island on Westmouth Bay. This includes 1040
feet of estuarine shoreline. The shore line is characterized by a narrow band of sandy beach backed by
an eroded escarpment that is scattered with fallen trees and trash that has accumulated over time. There
are small patches of unhealthy spartina patens along the sandy portions of the beach. Healthy coastal
marsh exists at the east and west ends of the shoreline. By the condition of the fallen trees and
escarpment, it is estimated that there has been an average of 10 feet of recession of the mean high
waterline in the past year. Most of this erosion can be attributed to conditions in Hurricane Isabel.
Photos 1 and 2 show the general condition of the shoreline.
The upland portions of the site are scrub with immature pine trees and live oats. The site has historically
been used as an illegal dump site for debris and household trash. The developer has cleaned the site but
much remains to be removed. A road with ditches was cut into the site by previous owners. The new

STORMWATER MANAGEMENT
Stormwater treatment will be in accordance with the rules for low density development. Conveyance will
be by grass lined ditches with outfall of excess runoff into Westmouth Bay.
METHODS OF CONSTRUCTION
Site work including grading and utilities construction will be by conventional methods. Bulkhead
construction will be land based equipment and will include a vinyl bulkhead with a timber cap. No tie back
system will be required. Fill behind the bulkhead will require approximately 3 cubic yards per linear foot
of bulkhead.
PROJECT SCHEDULE
After the required CAMA Major permit is obtained, construction of the project, including wastewater
treatment systems will require from six to nine months.
COMPLIANCE WITH COUNTY OF CARTERET ZONING AND CAMA LAND USE PLAN
The property is within the planning jurisdiction of Carteret County. There is no zoning on Harkers Island.
The site is classified "Coastal Wetlands and Limited Transitional" by the Carteret County CAMA Land Use
Plan. Development of the site is consistent with development ordinances of the County and is subject to
approval by the County Planning Department.
COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
There is no work proposed on the site that will require review under the N. C. Environmental Policy Act.
