Dear Mr. Spagnolo:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0.10 acres of wetlands for the purpose of constructing a single family
residence at the subject property, as described within your application dated July 21, 2004 and received
by the N.C. Division of Water Quality (DWQ) on July 23, 2004 and additional information received
August 16, 2004. After reviewing your application, we have d?cided that the impacts are covered by
General Water Quality Certification Number(s) 3402 (GC3402), The Certification(s) allows you to use
Nationwide Permit(s) 18 when issued by the US Army Corps of'fngineers (USACE). In addition, you
should obtain or otherwise comply with any other required federM, state or local permits before you go
ahead with your project including (but not limited to) Erosion and Sediment Control, and Non-discharge.

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimexitation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind \
,
No waste, spoil, solids, or fill of any kind shall occur in Wetlands, waters, or riparian azeas beyond
the footprint of the impacts depicted in the Pre-Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, sha11 be perforxned so that no violations of state water quality
standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters
is unavoidable, they shall be removed and the natural grade restored within six months of the date
that the Division of Land Resources has released the project.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth ma.y result in revocation of this Certification and ma.y result in
criminal andlor civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of

the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a

Dear Mr. Dorney,
This letter is with reference to your letter dated August 3, 2004 requesting additional information in order
to review the wetland fill request for 7ce Spagnola, Lot 233, Section 2, Phase 2, in the Monterey Shores
Subdivision, Dare County, North Carolina
Enclosed is a revised plat that shows proposed impervious coverage's and additional parking spaces needed
for the single family residence. The impervious areas are limited to the house footprint and the concrete
portion of the driveway. The pool deck will have open siatied decking and the remaining driveway and
parking area will use turf stone to minimize the impervious coverage onsite. In addition, a copy of the
Currituck Counry Ordinances which outline the parking requirements of a singie family residence have
been included with this letter.
The proposed mitigation area has been removed because it dces not meet the 10:1 preservation requirement
of the US Army Corp of Engineers. The mitigation component of this Nationwide # 18 fill permit will be
achieved by purchasing credits from the North Carolina Ecosystem Enhancement Program (NCEEP) and
the enclosed response from NCEEP accepting the mitigation requirement for this project has been
provided.
Mr. Spagnola's initial site plan has been modified to reflect his changes in his house design and also to
show the additional parking requirements of Currituck County. Upon further review of the aforementioned
changes this office believes that impacts cannot be avoided and all efforts have been made to avoid and
mnumize impacts to the exisUing wetlands.

Section 401 Defixutions.
1. Unless otherwise specifically provided or unless clearly required by the context, the words
and phrases defined below shall have the meaning indicated when used in this Arti.cle:
(a) Circulation Area: that portion of the vehicle accommodation area used for access to
parking or loading areas or other facilities on the lot. Essentially, driveways and other

(b) Driveway: that portion of the vehicle accornmodation area that consists of a travel lane
bounded on either side by an area that is not part of the vehicle accommodation area.
(c) Gross Floor Area: the total area of a building measured by taking the outside
dimensions of the building at each floor level intended for occupancy or storage.
(d) Loading and Unloading Area: that portion of the vehicle accomrnodation area used to
satisfy the requirements of Secti.on 407.
(e) Parking Area Aisles: that portion of the vehicle accomxnodation area consisting of lanes
providing access to parking spaces.
( fl Parking Space: a portion of the vehicle accommodation area set for the parking of one
(1) vehicle.
(g) Vehicle Accommodation Area: that portion of a lot that is used by vehicles for access,
circulation, parking and loading and unloading. It comprises the total of circulation
areas, loading and unloading areas, and parking areas (spaces and aisles).
Section 402 Number of Parldng Spaces Required.
1. All developments in all Zoning Districts shall provide the number of parking spaces, as
specified in the Table of Parking Rec}uirements, to accommodate the number of vehicles
that are likely to be attracted to the development in question.
2. The presumptions esta.blished by this Article are that: (i) a development must comply with
the parking standards set forth in Subsection (5) to satisfy the requirement stated in
Subsection (1), and (ii) any development that does m.eet these standards is in compliance.
However, the Table of Parking Requirements is only intended to establish a presumption
and should be flexibly administered, as provided in Section 403.
3. Uses in the Table of Parking Requirements (Subsection (5), are indicated by a nuxnerical
reference keyed to the Table of Permissible Uses. When determination of the nuxnber of
parking spaces required by this Table results in a requirement of a fractional space, any
fraction of one-half or less may be disregarded, whil.e a fraction in excess of one-half shall
be counted as one (1) parking space.
4. The Board recognizes that the Table of Parking Reqtvrements set forth in Subsection (5)
cannot and does not cover every possible situation that may arise. Therefore, in cases not
specifically covered, the permit issuing authority is authorized to determine the parking
requirements using this Table as a guide.

Section 403 Fleaibility ia Administratioa Required.
The Board recognizes that, due to the particuiarities of any given development, the
inflexdble application of the parldng standards set forth in Section 402(5) may result in a
development either with inadequate parldng space or parldng space far in excess of its
needs. The former situation may lead to lraffic congestion or parldng violations in adjacent
streets as well as unauthorized parldng in nearby private lots. The latter situation results
in a waste of money as well as a waste of space that could more desirably be used for
valuabie development or environmentally useful open space. Therefore, as suggested in
Section 402 (5), the permit issuing authority may permit deviations from the presumptive
requirements of Section 402 (5) and may require more parldng or allow less parldng
whenever it finds that such deviations are more likely to satisfy the standard set forth in
Section 402.
2. The permit issuing authority may allow deviations from the parking requirements set forth
in Section 402(5) when it finds that:
(a) a residential development is irrevocably oriented toward the elderly; or,
(b) a business or recreational facility is primarily oriented to walk-in trade or is located
within a Planned Unit Development and is closed to the general public.
3. Whenever the permit issuing authority allows or requires a deviation from the presumptive
parking requirements set forth in Section 402(5), it shall enter on the face of the Permit the
parking requirement that it imposes and the reasons for allowing or requiring the deviation.
4. If the permit issuing authority concludes, based upon information it receives in the
consideration of a specific deveiopment proposal, that the presumption established by
Section 402 for a particular use classifieation is erroneous, it shall initiate a request for an
amendment to the Table of Parking Requirements in accordance with the procedures set
forth in Article 24.
Section 404 Parlring Space Dimeasions.
1. Subject to Subsections (2), (3), and (4) each parldng space shall contain a rectangular area
at least twenty (20) feet long and ten (10) feet wide. Lines demarcating parking spaces may
be drawn at various angles in relation to curbs or aisles, so Iong as the parldng spaces so
created contain within them the rectangular area required by this Section. Where wheel
stops or cttrbing exists, a 2' bumper overhang credit will be given provided that area is
clear from obstruction. (Amended 2/3/03)
2. In parldng areas containing ten (10) or more parldng spaces up to twenty percent (20%) of
the parking spaces need to contain a rectangular area of only seven and one-half (7 1/2)
feet in width by fifteen (15) feet in length. If such spaces are provided, they shall be
conspicuously designated as reserved for small or compact cars only.
3. Wherever parldng areas consist of spaces set aside for parallel parking, the dimensions of
such parldng spaces shall be not less than twenty-two feet by nine feet (22' x 9').
4. For single family and two family residences, located in the R01 and R02 zoning district, a
minimum parldng space shaIl be eight (8) feet in width and fifteen (15) feet in length and
served by a minimum fifteen (15) foot in width drive aisle. Parallel parldng spaces shall be
no less than eight (8) feet in width and twenty (20) feet in length and served by a minimum

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for non-riparian wetland impacts associated with the subject project. Please note that the decision by the
NCEEP to accept the mitigation requirements of this project does not assure that this payment will be approved by the
U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is the responsibility of the
applicant to contact these agencies to deternune if payment to the NCEEP for impacts associated with this project is
appropriate. Further, it is the understanding of the NCEEP that the rules of the NC Coastal Resources Commission, as
implemented by the Division of Coastal Management, allow mitigation for impacts to coastal wetlands only for projects
that will have public benefits, as deternuned by the DCM, provided that the public benefits clearly outweigh the adverse
effects of the project, and further, that all reasonable means of impact avoidance and minimization have been incorporated
into the project's design.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
Permit/401 Certification within this time frame, this acceptance will expire.
Based on the information supplied by you in a letter dated July 23, 2004, the riparian wetland that is necessary to satisfy
the compensatory mitigation requirements for this project is summarized in the following table. The maximum amount of
mitigation that the NCEEP will accept for this project is also indicated in this table.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The proposed impact was limited to a total of 0.10 acres. Wetland fill could not be avoided due to the fact that
Section "404" wetlands comprise the maLritv of this lot combined with the building setbacks makes this lot not
buildable without wetland fill. Ad,Lacent lots (232 & 234) are currently developed; existing grade on these lots were
elevated using fill material resultinp stormwater runoff diverted into Lot 233.

DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at

prohibited from performing anv of the following activities within the recorded conservation easement: Filling,
grading; excavating; earth movement of anY kind• construction of roads buildings, signs, or any other structure
(excludinQ a six foot wide area to construct a walkway to access the Currituck Sound); an a?ty that mav
alter the drainage patterns on the property or any other activity which would result in the wetlands being
adversely impacted or destroyed excluding a six foot wide elevated walkway to access the Currituck Sound.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that

On July 23, 2004, the Division of Water Quality (DWQ) received your application dated July 21, 2004 to
impact 0.01 acres of wetlands to construct the proposed residence. The DWQ has determined that your
application was incomplete andlor provided inaccurate informatibn as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive the additional inforrna:tion requested below,
we will have to move toward denial of your application as required by 15A NCAC 211.0506 and will
place this project on hold as incomplete until we receive this additional informa.tion. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
1. Plan Details
a. Please provide the location of any proposed stormwater management practices as
required by GC 3402. As it appears there is greater than 30% impervious surface in
addition to stormwater runoff from adjacent properties.
b. Please provide detail for the stormwater management practices as required by GC 3402
c. Please specify the percent of project imperviousness area based on the residential foot
print, driveway parking pad and pool deck. Please show calculations for these areas.
d. Any additional impacts to the wetland, including the proposed elevated walkway to
access Currituck sound, needs to be clearly depicted on the permit drawing.
2. Impact Justification (Avoidance and Minimization)
a. This Office believes that the pool can be eliminated to avoid the impacts. Please revise the
plans to avoid the impacts.
b. This Office believes that the home and driveway can be moved or reconfigured to minimize
the impacts and to better utilize the uplands. Please revise the plans to minimize the
impacts.

3. Mitigation
a. DWQ Requests that an independent 3rd party, such as a land trust, hold the conservation easement
for the proposed wetland mitigation site of 0.06 acres.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Tom Steffens of the DWQ Washington Regional Office. If we do not hear from you within three
weeks, we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
