Introduction a. Background The Town of Seaboard is in Northampton County in northeastern North Carolina approximately 3.5 miles south of the Virginia border is home to approximately 600 people. The Town owns and operates its own sanitary sewer collection system and land application wastewater treatment facility. The sewer collection system is made up of approximately 29,000 LF of 6- inch, 8-inch and 10-inch diameter sewer collection pipe with approximately 100 various depth manholes. Pipe materials found in the collection system include Ductile Iron Pipe (DIP), Vitrified Clay Pipe (VCP), Polyvinyl Chloride (PVC) and Truss pipe. A substantial portion of the system has been slip -lined or lined by previous and ongoing rehabilitation projects. Most of the system that has been lined over the years is comprised of VCP with a slip -lined liner with PVC transitions at the upstream and downstream manholes. Manhole materials within the system consist of precast concrete wall material and brick wall material. A substantial portion of the original brick wall manholes have been relined or rehabbed with cementitious wall material to prevent leaks and fortify wall integrity. b. Moratorium In January of 2007, the Town was placed on sewer connection moratorium by NCDEQ. Over the past several years, the Town has worked to improve the performance of the collection system and eliminate inflow and infiltration where possible. In February 2019, the Town was notified that due to the submitted supporting evidence and recent grant funding awards, the sewer connection moratorium was being lifted. c. Special Order by Consent In May 2019, the Town was assessed a Civil Penalty for violations of the WQ0003299 permit. This violation accompanied an ongoing Special Order by Consent (SOC) request that was negotiated between the Town and the State to ensure improvements and modifications were performed at the WWTF. Several conditions of the final negotiated SOC were listed along with timelines for reporting and implementation of improvements. d. Statement of Purpose This report is meant to satisfy Item 2(a)2 of the final SOC which is included in the attached appendix due by December 31, 2019. II. Summary Report of I & I work Item 2(a)2a requires a summary report on I&I work conducted from the date of the flow moratorium through the date of the SOC effective date. For reference, the moratorium was imposed in January 2007 and the SOC was made effective in July 2019. Over the 12.5-year span between the moratorium and the SOC, many efforts and projects have been undertaken to greatly reduce inflow and infiltration (I&I) into the system. The following summary discusses the documented projects and efforts by Town staff to address the I&I issues within the Town. a. 2006 Sanitary Sewer Improvements - Town of Seaboard During the period between the event that caused the issuance of the moratorium and the actual effective date of the moratorium, the Town of Seaboard was developing a sanitary sewer rehabilitation project aimed at addressing the aging sewer infrastructure issues. Enclosed in the Appendix is a copy of the project dating back to 2006 but began construction in the latter part of 2007 (after the moratorium effective date) that replaced approximately 2,400 LF of existing VCP line with PVC material and cleaned and video inspected an additional 5,023 LF of existing main. Included in this project were several lateral renewals throughout the length of the project and a new lift station and force main meant to better serve the existing area. While the results of the inspection of the cleaning and video inspection of the 5,023LF of existing mains were not available for review, the replacement of approximately 2,400LF of VCP material within the system along with the inspected lengths of main represent approximately 25% of the Town's system that was inspected and or rehabbed as a part of this project. b. Town Efforts to eliminate interconnections The Town routinely checks storm drainage structures throughout the Town for potential clogs and maintenance issues. Over the past several years, the Department of Public Services has discovered several roof drains were tied directly to the sanitary sewer laterals of various properties. One specific location of note is the property located at Clay Street and Green Street (see Fig 1 below). This vacant property (which used to be a public school) represents one of the largest roof areas in town at approximately 20,000 sf, had its roof drains tied directly to the sanitary sewer service that serves the structure. When the Town discovered this interconnection, they removed the above ground roof drainage system downspouts and saw an immediate decrease in activity at the WWTF during rain events. Subsequent work during an ongoing sewer rehab project will remove and investigate further the potential interconnections in this area to hopefully eliminate additional interconnections. Figure 1 c. 2014 CDBG Project No. 14-1-2664 - NC 305 / Main Street In 2016, the Town received approval for a project to extend sewer service to 8 unsewered houses within its service area. While this project was serving new customers, one stipulation of the project, due to the moratorium, was that 8 subsequent inactive sewer services were required to be abandoned to allow for these new customers to come online. Abandonment of vacant sewer services as part of the project has great potential in reducing the passive inflow and baseline infiltration found in many dormant and vacant houses with "inactive" service taps on the main. While no data has been collected to isolate or identify the potential reduction from the removal of these 8 services, construction reports indicate that the existing services removed displayed poor construction quality and were suspect to groundwater infiltration due to age and integrity of material. d. 2016 CDBG Town Wide Sewer Project In May 2019, contractors began work on the 2016 CDBG Town Wide Sewer Project. This project involves the high-pressure cleaning, and TV inspection of 20,400 LF of existing sewer collection main throughout the system. The project also included the potential for relining up to 9,200 LF of existing sewer main. The cleaning and tv inspection portion represents 70.3% of the system to be reviewed and inspected during the cleaning process. Relining of up to 9,200 LF of main would represent 31.7% of the system to be potentially lined by this one project. As of the writing of this report, 5,500LF of the system has been relined while a program amendment to clean, investigate and reline additional footage is being reviewed and considered for implementation. During the cleaning and TV portions of the project, portions of the previously lined system (2006 project) were inspected for integrity and leaks. Several deficiencies were found and subsequently fixed as a part of the work involved in this project. Sanitary sewer laterals along the project area have been renewed from the main to the connection point at the right of way. These efforts should greatly reduce the overall baseline infiltration as well as eliminate the inflow being diverted into open cleanouts and broken taps at the right of way. III. Proposed New and Ongoing I&I Improvements a. Ongoing As listed above the ongoing 2016 CDBG Town Wide Sewer Project has already relined 5,500 LF of the existing system and is currently in the response period for a program amendment that will expand the cleaning and tv efforts along with potentially relining more areas within the Town. The expansion of the project area will cover more of the low to moderate income (LMI) houses that are customers within the Town. Since these LMI homes are located on the fringes of the Town, the downstream sewer will be evaluated with TV inspection and high-pressure cleaning to evaluate the need for lining in these areas. When complete, it is estimated that approximately 82.9% of the Town's collection system will be either PVC, Slip -Line or Cured in Place Pipe Liner. The ongoing efforts since the moratorium was imposed have upgraded or replaced all but approximately 4,9001f of the collection system lines. b. Proposed I&I Improvements i. Obstruction at Bar Screen The Town has recently had the flow meter at the WWTF plant's bar screen calibrated and has discovered that there is an obstruction in the line from the bar screen to the initial storage lagoon at the plant. The Town intends to as soon as funds become available, have this portion of the line jetted and cleaned in order to remove the obstruction in the segment of line. Obstructions near flow measurement points can adversely affect the data being generated. With regards to incoming flow, erroneous readings could cause mismanagement of the storage capacity of the existing plant. Part of the data reported by the Town are based on this meter and accurate readings are a must to efficiently operate the system and subsequently estimate I&I. ii. WWTP Liner The existing liner of the final storage lagoon at the WWTF has experienced a failure in the form of a trapped gas bubble decreasing the overall storage capacity of the entire system. The Town is in the process of securing funds to completely replace the liner of this lagoon and install a system to eliminate reoccurrence of such a "bubble" in the future. Restoring storage capacity in the lagoon will allow the Town more flexibility in the operation of the existing spray field. Until all I&I is eliminated, the regained storage capacity will benefit the Town greatly during rain events and other prolonged "non -spray" periods. iii. Town efforts to eliminate interconnections The Town continues to be vigilant in identifying interconnections between storm sewers and the sanitary sewer system. As these interconnections are found, they are addressed and documented to review the impact on plant flows. iv. Funds committed - Current and Proposed The Town has committed numerous resources to address its I&I issues in the sewer collection system. To date there have been several large-scale sewer rehab and relining projects that when complete, will have relined or modernized the pipe material of approximately 82.9% of the system. These improvements come with substantial costs that the Town has actively sought grant and state subsidized loan programs to fund. Below is a summary of the construction costs associated with the a few of the previous projects as well as projected estimates for some future commitments the Town is actively seeking funding for. Integrity of Existing Collection System Based on video inspections reviewed during the 2016 Town Wide Sewer Project, and the subsequent point repairs and lining efforts undertaken as part of that project, the overall condition of the Seaboard Sanitary Sewer Collection System can be assessed as good. Upon completion of the 2016 CDBG project, the pipe materials within the system will have been relined or rehabbed via slip line or CIPP process with less than 5,OOOIf left to be investigated, evaluated, and potentially upgraded. The outfall lines that convey all effluent to the WWTF have been evaluated and lined within the past 10 years and are in good condition. Point repairs have been performed on existing services and defects discovered during the tv inspection phase of the project and existing services were renewed, replaced or abandoned based on the status of the connection at the time of encounter. A review of the previous 12 months of DMR's reported by the WWTF was outside the scope of this report; however, this analysis could be used to determine the impact that these ongoing sewer improvement projects have had on the flows within the sanitary sewer system. Please be aware that if the wastewater flows to the treatment plant results in violations of the permit, OR if the deficiencies associated with the wastewater treatment plant are not corrected in a timely manner, the Division of Water Resources retains the ability to impose another sewer moratorium on the Town of Seaboard. The Division would like to assist the Town to help ensure that all wastewater permit conditions and applicable Rules are met. We are waiting for your response to the draft Special Order of Consent (SOC) for the Town of Seaboard that was emailed to Joey Barnes and Joe Dooley on January 18, 2019 that is intended to help provide a framework for the implementation of repairs to the lagoon liner and other elements of the wastewater treatment plant. S18-007 Pursuant to provisions of North Carolina General Statutes (G.S.) 143-215.2 and 143-215.67, this Special Order by Consent is entered into by the Town of Seaboard, hereinafter referred to as the Town, and the North Carolina Environmental Management Commission, an agency of the State of North Carolina created by G.S. 14313-282, and hereinafter referred to as the Commission: 1. The Town and the Commission hereby stipulate the following: (a) The Town owns a Wastewater Collection system that is subject to the requirements of 15A NCAC 02T .0403 (Permitting by Regulation). The Tracking number in DWR's database for this Collection System is WQCSD0111. The waste from this collection system is transported to the Seaboard WWTP where it is treated and spray irrigated in accordance with permit number W00003299. The Town has numerous exceedances of wastewater flow into the permitted treatment system caused by Inflow and Infiltration (hereafter referred to as 1/1). (b) On May 7, 2019, the Town was assessed a Civil Penalty (PC-2019-0031) in the amount of $2,567.28 for violations of permit number WQ0003299. (c) The Town has performed point repairs, smoke tests, camera identification and other 1/I identification and correction methods and removed several sources of 1/1. As a result, flow exceedances have lessened in number and severity but problems remain with the wastewater treatment system. Full compliance with the permit will require additional 1/1 identification, prioritization and rehabilitation work to be performed and repairs to the wastewater treatment system. (d) That noncompliance with 15A NCAC 02T .0403 and permit number W00003299 can result in and contribute to pollution of the waters of this State, and the Town is within the jurisdiction of the Commission as set forth in G.S. Chapter.143, Article 21. (e) The Town will commit financing for planning, designing, and constructing of new and/or improved sewer collection system components that will be sufficient to adequately convey wastewater to the Town's wastewater treatment plant. (f) The Town will commit financing for planning, designing, and constructing of repairs and improvements to the Town's wastewater treatment plant that will be sufficient to adequately treat and dispose of its wastewater to comply with permits WQCSD0111 and W00003299. (g) Since this Special Order is by Consent, neither party will file a petition for a contested case Town of Seaboard SOC #: S18-007 Page 2 of 4 or for judicial review concerning its terms. 2. The Town, desiring to comply with the permits identified in paragraph 1(a) above, hereby agrees to do the following: (a) Identify, Design and Construct improvements to its wastewater collection system. West Fraser and Flow meter. a. The Town will install a lift station and flow meter to measure wastewater flow from West Fraser within 90 days of the effective date of this SOC and notify the RRO within fourteen (14) days of installation documenting the installation, operation, and calibration (+/- 10%) of the flow meter and annual calibration for the duration of this SOC. 2. 1 &1 report. By December 31, 2019, the Town will deliver a final report to the Water Quality Regional Operations Section Supervisor, Raleigh Regional Office, Division of Water Resources, 1628 Mail Service Center, Raleigh, NC 27699-1628 containing the following items: a. A summary report on I&I work conducted from the date of the flow moratorium through the date of the SOC effective date. b. Provide a report on proposed new and ongoing I&I improvements, including proposed funding and timeframes. c. An assessment of the integrity of the existing collection system. 3. WWTP -Liner Re: air. Submit a plan for the repair or replacement of the irrigation lagoon liner including details on how the wastewater will be processed and disposed of during the liner repair or replacement process within 120 days of execution of this SOC. Complete irrigation lagoon liner repair by March 31, 2020. 4 Sprayfields. a. Perform an assessment of the current condition of the existing wastewater irrigation fields by an NC licensed soil scientist to determine if the existing irrigation rate is still appropriate, and make recommendations on appropriate corrective actions if the irrigation rate is determined to be inappropriate based on existing site conditions. b. Perform a soil assessment of the current permitted wastewater irrigation fields and the 40 acres of land owned by the Town that is adjacent to the wastewater treatment facility in order to determine if the fields are suitable for irrigation of the treated wastewater produced by the Town. c. Determine a safe irrigation rate of any suitable fields and provide a summary report of the soil assessment to the DWR Raleigh regional office by December 31, 2019. 5. Final Flow Evaluation Report. By February 15, 2021, the Town will evaluate the flows and irrigation rates since the inception of this Special Order and submit a final report to the Water Quality Regional Operations Section Supervisor, Raleigh Regional Office, Division of Water Resources, 1628 Mail Service Center, Raleigh, NC 27699-1628. (b) Submit quarterly progress reports detailing all work and activities undertaken and completed on the rehabilitation of the collection system and upgrades to the wastewater treatment Town of Seaboard SOC #: S18-007 Page 3 of 4 plant. These reports will detail work performed by both Town staff and by private contractors to address Ill and improve the wastewater treatment plant. The reports should specifically address the Town's progress on items 2(a) 1, 3, 4 and 5 in this Order. The reports are to be submitted to the Water Quality Regional Operations Section Supervisor, Raleigh Regional Office, Division of Water Resources, 1628 Mail Service Center, Raleigh, NC 27699-1628. The quarterly reports are no later than the thirtieth (30th) day of January, April, July, and October for the duration of this Order. (c) No later than fourteen (14) calendar days after any date identified for accomplishment of any activity listed in paragraph 2(a) above, submit to the Director of DWR written notice of compliance (including the date compliance was achieved along with supporting documentation if applicable) or noncompliance therewith. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. (d) Continue to operate the wastewater collection system as best as possible to prevent/minimize impacts. This includes the continued work by Town staff to eliminate identified sources of 1/1 in addition to larger projects the Town may bid out to contractors. 3. The Town agrees that unless excused under paragraph four (4), the Town will pay the Director of DWR, by check payable to the North Carolina Department of Environmental Quality, stipulated penalties according to the following schedule for failure to meet the deadlines set out in paragraphs 2(a), 2(b), and 2(c). Failure to meet a schedule date $500 per day up to maximum of $2,500. listed in paragraph 2(a). Failure to submit progress reports $500 for the first violation; Penalty doubles with as required by paragraph 2(b) and each subsequent assessment for late reports up 2(c). to a maximum of $2,500. 4. The Town and the Commission agree that the stipulated penalties are not due if the Town satisfies DWQ that noncompliance was caused solely by - (a) An act of God; (b) An act of war; (c) An intentional act or omission of a third party, but this defense shall not be available if the act or omission is that of an employee, agent or contractor for the Town; (d) An extraordinary event beyond the Permittee's control. Contractor delays or failure to obtain funding will not be considered as events beyond the Permittee's control; (e) Any combination of the above causes. Failure within thirty (30) days of receipt of written demand to pay the penalties, or challenge them by a contested case petition pursuant to G.S. 15013-23, will be grounds for a collection action, Town of Seaboard SOC #: S18-007 Page 4 of 4 which the Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the thirty (30) days has elapsed. 5. In accordance with the provisions of N.C.G.S. 143-215.67(b) the Commission allows the Town to accept the additional waste specified below to its waste disposal system: 6. The Division of Water Resources agrees it will not take civil assessment against the Town for permit flow exceedances caused by 1/1 during the duration of this Order. 7. This Special Order by Consent and any terms or conditions contained herein, hereby supersede any and all previous Special Orders, Enforcement Compliance Schedule Letters, terms, conditions, and limitations contained therein issued in connection with 15A NCAC 02T .0403 (WQCSD0111) and Permit Number W0000329. Noncompliance with the terms of this Special Order by Consent is subject to enforcement action in addition to the above stipulated penalties, including injunctive relief pursuant to G.S. 143-215.6.C. 8. The Town, upon signature of this Special Order by Consent, will be expected to comply with all schedule dates, terms, and conditions of this document. Director In accordance with your application received September 23, 2016, and additional information received on October 25, 2016, we are forwarding herewith Permit No. WQ0038832 dated October 28, 2016, to the Town of Seaboard (Permittee) for the construction and operation upon certification of the subject wastewater collection system extension. This permit shall be effective from the date of issuance until rescinded and shall be subject -to the conditions and limitations as specified therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein by reference. - Because the Town of Seaboard is under a flow moratorium, the Town will be required to remove sewer services from 8 existing homes prior to connecting these 8 existing homes with failing septic systems, resulting in no net increase of flow allocation to the WWTP. Please pay particular attention to the following conditions contained within this permit: Condition 1.1: Each pump station shall be clearly and conspicuously posted using a weatherproof sign with a pump station identifying name/number, 24-Hour Emergency telephone number, and name of the owner/operator of the sewer system/pump station and instructions to call the number in the event of alarm activation or other emergency. Condition 1.2: The abandonment of any existing wastewater facilities including septic systems being replaced by new sewer infrastructure shall be done in accordance with the applicable agency having compliance oversight on such facilities. Condition IIA: This permit shall not be automatically transferable; a permit modification request for a name change must first be approved by this office. Condition IIA: Requires that the wastewater collection facilities be properly operated and maintained in accordance with 15A NCAC 2T .0403 or any individual system -wide collection system permit issued to the Permittee.
