Sorry. The date is a typo and probably due to it being written on a day I was supposed to be on vacation or at least that's the reason I'm sticking with. The letter should have been dated on December 23rd. As for the additional maps, I was told they were being sent and have since called but have not yet received them. I will follow up with that again now. A modification to this condition is fine. The letter was sent because the 60-day period to write back with any objections etc was nearing and the engineer had just told me earlier that week that the site plan had been revised to delete the town homes and add only single family lots. I have already discussed the diffuse flow issue with the engineer (a few times) and told him that the permit condition was most likely referencing that rather than stormwater ponds etc. This latest map should provide all of that information as well as the newly configured lot layout. Your letter is dated September 9, 2004, and references the attached 401 which was issued November 4, 2004. I'm confused - it appears your request to delete the condition pre-dates the 401 itself. Is that a typo on the date on your letter (was it really written on December 9, 2004)? If your letter really was written on September 9 then I'm really lost. Also, your letter notes that additional info proving the lot layouts and impervious area will be sent under separate cover. I don't have anything more recent than your fax - has that info been sent yet? Provided that you forward the referenced info demonstrating it's below 30%, I will modify (not delete) the condition to reflect that a storm plan is not required based on the new info. I don't want them going back later and changing their mind again, conveniently forgetting there was a stormwater requirement. Also note that the condition required that the areas below 30% would most likely require demonstrate compliance with the diffuse flow requirement of the NBR. Is this diffuse flow info to be included in the transmittal that was to follow the September 9 (?) letter? In order to decrease impacts to the riparian buffers and the perennial stream that result from the required road crossing, the proposed crossing is situated on an existing gravel farm road and crosses at a perpendicular angle. The sewer line also crosses at a perpendicular angle and is located at a point where resulting wetlands impacts are minimal. Lot fill is requested for jurisdictional ditches (i.e. linear wetlands) in order to fully utilize the upland areas. Please note that following construction the site will contain less than 30% impervious surface. Because this project will contain less than 30% impervious surface, we do not believe that this project requires a pre-approved stormwater plan. Stream mitigation should not be required because resulting permanent impacts have been minimized to the maximum extent practicable and only total 67.4 linear feet. The applicant plans to cross the channel at a pgoendicular angle in order to minimize impacts to the stream and riparian buffer. Also an existing gravel farm road crossing is being utilized to further reduce permanent impacts. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to Page 5 of 8 freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed.
