In 2005 we completed a $1.3 million stormwater management project that involved 312 acres, 704 residential lots, and 28 acres of delineated wetlands. The project is in the Neuse Basin, Northwest Creek watershed, classified 27-105, SB, SW, NSW. A wetland delineation map of the area entitled "Avolis Engineering C-2" is enclosed for your reference. All of the subdivided lots involving wetlands are privately owned. The majority are still undeveloped but we are seeing new development pressures particularly from speculators. Wetland areas on these lots are also functioning parts of the community's stormwater management system and are subject to 404/401 development regulations. After the stormwater management system was completed, the Property Owners Association enacted new architectural review requirements as part of our local building permit process. This was to help assure that owners and developers of wetland areas strictly follow the permit application and approval processes established by the state and the ACOE. A copy of applicable sections is enclosed. We are now finding that there may be real estate agents, developers and speculators hoping to circumvent the applicable wetland and water quality regulations and wish to alert you to this and to seek your assistance. We ask that you be especially vigilant concerning any requests for wetland determinations, or requests to impact wetlands within the Fairfield Harbour community. It is our hope and request that when your agency has jurisdictional authority, you exercise close scrutiny of the request in an effort to help our community minimize unnecessary wetland impacts. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Water Quality Certification The proposed project must comply with all of the conditions of General Water Quality Certification (GC) 3351. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. FIELD INVESTIGATION REPORT: FAIRFIELD HARBOUR PROPERTY OWNERS ASSOCIATION/CRAVEN COUNTY PAGE #2 ------------------------------- 9. NARRATIVE DESCRIPTION Project Setting Fairfield Harbour is located in Craven County on the east side of the Neuse River towards Pamlico County off NC 55. It can be reached by turning right onto SR 1600 and traveling close to the end of the road. Gondolier Peninsula is the peninsula between Northwest Creek and the Neuse River.. - The 311-acre site is a small part of a well-established and built out subdivision with multiple golf courses and marina complexes. According to the application, the site is'classified as rural and is not zoned. The existing subdivision does not have a functioning drainage system. There are over 700 "14F; - acre lots in the project area with some 28 acres of wetlands. Typical elevation of the lots ranges between 4 and 9 feet above normal water level. The project site is situated along the south side of Caracara Drive and parallel with Northwest Creek running along Plymouth Court, Bucco Reef and Trade Winds Roads. According to the plat, the USACOE has reviewed the wetland delineation and found their representation to be accurate, although they have not confirmed the wetland delineation on the maps. The same situation is true for the Coastal Wetland delineation. The Neuse River Basin Buffer Rules are applicable at the site and Zones 1 and 2 are shown on the attached plats. A Sedimentation and Erosion Control Plan and a Stormwater Permit application have both been submitted on March 24, 2004. This section of the Neuse River is classified as SC Sw NSW and is closed to shellfishing. Project Description Fairfield Harbour proposes to install ditching, seven outfalls and outlet control structures to Northwest Creek to provide a functioning draining system to the Gondolier Peninsula. The seven outfalls are shown in an overview on the attached Sheet C 1. Each specific outfall with normal water line, the Coastal Wetland line, Zone 1 line of the Neuse River Buffer, Zone 2 of the Neuse River Buffer, and the 75' CAMA Estuarine Shoreline are shown on the attached Sheet C7, C9, C12, C15 and C16. According to the application, the seven outfalls would be approximately 200' in length and 7' in width with the final project depth around 2.5'. Some existing roadside ditches would be filled as part of the project. All outfall swales would be sodded from top of bank to top of bank. Where no roadside swale exists, one would be established to the appropriate right-of-way. Similarly, no disturbance would occur outside designated drainage easements. Sheet C17 and C18 show these areas in detail. Anticipated Impacts Installation of the seven outfalls and outlet control structures would impact a total of 17,629 ft2 of high ground within the estuarine shoreline from filling, grading associated with outlet installation. This total includes 4,785 ft'-; 1,463 ft2; 2,460 ft2; 1,272 ft2; 5,337 ft2; 1,137 ft'-; and 1,175 ft2 in areas around outfalls #1 through #7. Total DWQ buffer impacts would be 8,465 ft' in Zone 1 and 4,414 ft 2 in Zone 2. A complete list of impacts can be found in table form on the attached sheets C17 and C18. According to the applicant, no excavation or filling of wetlands or waters would occur. The use of silt fencing, check dams and revegetation by sodding is proposed to prevent impacts to sedimentation. M. There is nothing to carry this water past the wetlands and shoreline or to disapate the energy of the water entering the wetland. This seems to put this well established area of shore line at risk of being washed away by the flow of this water if the water is not carried to the shore line or the energy is not disapated.. - I am also concerned about the amount of "clearing" authorized for this project. It is my wish that this project preserve the maximum number of trees possible and that the project plant trees to replace those destroyed on a 1 tree / every 2 removed basis.
