Dear Sir or Madam:
The enclosed Addendum to an Individual Permit Application submitted in July
2004 is provided by The Dunlea Group. A new site survey map is attached to this
addendum. Please note the following changes to the original application:
• The amount of the above-referenced 9.3-acre parcel of land requested to
be filled has been adjusted down to 0.28 acre from 0.34 acre.
The Dunlea Group is requesting that you accept a mitigation plan that
would allow for 0.56 acre of uplands surrounding the remaining wetlands
on the subject site to be converted to wetlands (see proposed area of
created wetlands on enclosed site survey map). All finished wetland
creation grades will be established at adjacent wetland contours, and
acceptable species of wetland flora will be planted.
Hopefully, this 2 for 1 trade of wetlands will be acceptable to all parties involved.

SUBJECT: 401 Water Quality Certification for The Dunlea Group - New Centre
Commercial Park, New Centre Drive Extension, Wilmington, New
Hanover County, North Carolina. DWQ No. 041188.
The Wildlife Resources Commission has reviewed the project for impacts to
wildlife and fishery resources. A site visit was made on August 25, 2004. Our comments
are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401 of the Clean Water Act (as
amended), and North Carolina General Statutes (G. S. 113-131 et seq.).
The applicant is seeking authorization to fill 0.34 acre of what appear to be
headwater wetlands for commercial development. Much of the site has been cleared, but
some red maple, loblolly pine, grape, and herbaceous cover remain in the impact area. A
silt fence is in place between the wetlands to be impacted and remaining forested wetlands,
but some soil erosion has nonetheless occurred. The project area is developing rapidly
with various retail shopping establishments.
The project would further fragment wildlife habitat remaining in this rapidly
developing urban area. Loss of 0.34 acre of headwater wetlands accompanied by
increased impervious surface is expected to reduce retention and treatment of stormwater,
contributing to surface water quality decline and degradation of downstream aquatic
habitats. So far as we can tell, no mitigation is currently proposed for this wetland loss,
although payment into the Wetlands Restoration Program was made for past wetland loss
at the site. Based on these concerns, we recommend that the 0.34 acre of wetland loss be
fully mitigated so that no net loss of wetlands occurs.

On July 16, 2004, your application to impact 0.34 acres of jurisdictional wetlands for construction of the
New Centre Commercial Park was received by the N.C. Division of Water Quality. The Division will
begin to review the project for eventual decision. However, please be aware that beginning January 1,
1999 that the N.C. General Assembly passed legislation requiring payment of a fee of $200.00 for this
project. Also, applicants are required to provide to DWQ two copies of all application materials provided
to the U.S. Army Corps of Engineers. The 401 Water Quality Certification cannot be issued until this fee
is paid and the copies are provided. This project has been assigned DWQ Project No. 04-1188. Please
refer to this project number in all future correspondence. Please note that as required by 15A NCAC 2H
.0506 we will place this project on hold as incomplete until we receive this additional information. You
should also note that processing of your application cannot be completed until the Corps of Engineers'
Public Notice has been received in this Office and the Public Comment period has been completed.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not

The enclosed Individual Permit Application is provided by The Dunlea Group to request
that a 0.34-acre portion of the above-referenced 9.3-acre parcel of land be filled for the purpose
of constructing a section of a retail shopping center (See location on enclosed site survey map).
This site is highly desirable for development due to its close proximity to a Target store, located
directly across New Centre Drive.
A 0.94-acre portion of the 9.3-acre subject site was previously filled 1997-98. Also, a
storm water retention pond was constructed on about one-half of the 8.13-acre property adjacent
to the north, which is also the property of The Dunlea Group.
The following 404 permits have previously been requested for use on the subject site:
• NWP 26 (File No. CESAW-C090-D-065) on June 27, 1990. This permit was not utilized by
the applicant.
• NWP 14 & 26 (Action ID No. 199602940) on March 12, 1996. Denied by NCDENR - Division
of Water Quality (DWQ Project # 960158).
• NWP 26 (Action ID No. 199706340) on May 28, 1997, NWP 26 (Action ID No. 199706339) on
May 28, 1997, and NWP 26 (Action ID No. 199800670) on January 26, 1998. The only
action completed on the 9.3-acre subject site as a result of these permit applications was the
filling of 0.94 acres of wetlands. As mitigation for the filled land, a total of $18,000 was paid
as credits for 0.75 acres of riparian wetlands.

main limitations in the use and management of this soil.
If drained, this soil is suited to most locally grown crops.
The main crops are corn, soybeans, tobacco, and peanuts.
Minimum tillage and crop residue management aid in
maintaining organic-matter content. This soil has good
tilth and can be worked over a wide range of moisture
content, but tillage is delayed during wet seasons.
Drainage is needed for most uses. Capability subclass
IIIe; woodland group 3w.
DO-Dorovan soils. These neatly level, very poorly
drained soils are in bays and in long, hroad areas of tidal
and stream flood plains. All of the acreage is used for
woodland and as wildlife habitat. The native vegetation is
red maple, willow, tupelo, cypress, sweetgum, ash, Amer-
ican cyrilla, and greenbrier.
Typically the surface layer is black muck 4 inches thick.
The underlying layer, to it depth of 64 inches, is black or
very (lark gray muck.
Included with these soils in mapping are small areas of
Johnston soils and 'T'idal marsh. A few small areas of soils
that have thin, continuous mineral layers are also in-
eluded.
The organic-matter content in the surface layer is very
high. Permeability is very slow, available water capacity
is very high, and shrink-swell potential is low. Reaction is
very strongly acid or strongly acid throughout, unless the
soils are limed. The seasonal high water table is at or
near the surface. These soils are frequently flooded for
very long periods.
N'looding and high organic-matter content are the main
nations in the use and management of these soils. If
e soils are (trained and tilled, the organic matter
omposes and the soil subsides. Capability subclass
Iw; woodland group 4w.
JO-Johnston soils. These nearly level, very poorly
drained soils are on flood plains of the major streams.
Areas are commonly long and narrow. Most of the acre-
age is forested, and some small areas have been filled and
used for industrial and residential sites. The native
vegetation consists of pond pine, tupelo-gun?, ash,
water oak, cypress, red maple, sweetgum, American
cyrilla, waxmyrtle, and gallberry.
Typically, the surface layer is 42 inches thick. It is
black loam in the tippet- part and black sandy loam in the
lower- part. The underlying layer, to a depth of about 64
inches, is light gray sand.
Included with these soils in mapping are small areas of
Pamlico, Dorovan, and Murville soils. A few small areas of
soils that are less acid than these Johnston soils are also
included.
The organic-matter content of the surface layer is high.
Permeability is moderately rapid, available water capacity
is high, and shrink-swell potential is low. Reaction is very
strongly acid or strongly acid throughout, unless these
soils are limed. The seasonal high water table is at or
near the surface. These soils are frequently flooded for
long periods.
A seasonal high water table and flooding are the main
limitations in the use and management of these soils.
These soils subside if drained and tilled. Capability sub-
classes VIIw, where undrained, and IVw, where drained;
woodland group lw.
Ke-Kenansville fine sand, 0 to 3 percent slopes. Tliis
well drained soil is on broad smooth flats on the uplands.
Areas are commonly large in size and irregular in shape.
Most of the acreage is cultivated. The rest ?s forested or
is used for residential or industrial sites. The native
vegetation consists of longleaf and loblolly pines; white,
red, black, turkey, water, and bluejack oaks; hickory; dog-
wood; holly; and sassafras.
'T'ypically, the surface layer is grayish brown fine sand
:3 inches thick. The subsurface layer is fine sand 30 inches
thick. It is is pale brown in the tipper part and mottled
very pale brown in the lower part. The subsoil is fine
sandy loam 17 inches thick. It is strong brown in the
upper part and reddish yellow in the lower part. The un-
derlying layer, to a depth of 80 inches, is yellow loamy
fine sand.
Included with this soil in mapping are a few small areas
of Norfolk and Lakeland soils. Some small areas of soils
that are less acid throughout are also included.
The organic-?natter content of the surface layer is very
low. Permeability is moderately rapid, available water
capacity is low, and shrink-swell potential is low. Reaction
is very strongly acid or strongly acid throughout, unless
this soil is limed. The seasonal high water table is at a
depth of more than 6 feet.
beaching of plant nutrients, moderately rapid permea-
bility, droughtiness, low available water capacity, and soil
blowing are the main limitations in the use and manage-
ment of this soil. This soil is well suited to most locally
grown crops. The main crops are corn, soybeans, peanuts,
tobacco, and truck crops, such as squash, lettuce, cucum-
bers, cabbage, snapbeans, and corn. Winter cover crops,
minimum tillage, and crop residue management aid in
maintaining organic-matter content and conserving
moisture. Soil blowing is a concern in the management of
this soil. The blowing sand often causes damage to young
plants. This soil is droughty (luring periods of low rainfall.
Some supplemental irrigation, soil conditioners, and fertil-
izers are needed for lawn grasses, shrubs, and trees.
Capability subclass IN; woodland group 3s.
Kr-Kureb sand, 1 to 8 percent slopes. This excessive-
ly drained soil is on long, broad ridges on the uplands.
Areas are generally broad and long. Most of the acreage
is forested. The rest is used for residential and industrial
sites. The sparse native vegetation on the higher eleva-
tions is turkey oak, scattered longleaf pine, a few bluejack
oaks, and scattered dwarf myrtle and huckleberry. Much
of the area is barren of any vegetation, except for mosses
and lichens. On the lower slopes, the vegetation increases
in density and includes various oaks, scattered hickory,
holly, and brackenfern.
Typically, the surface layer is (lark gray sand 3 inches
thick. The subsurface layer is light gray sand 23 inches

for development. A copy of his letter is enclosed. A total of 0.50 acres will be created on site as a mitigation
factor. A total of 0.08 acres of aquatic resource will be replaced as a part of the mitigation plan.
