(Both of which are up for renewal in 2016, and for which we would like again to talk about an expedited process between our Sections.) I'd like to make you aware of a permit application in house now from a proposed compost site, in order to see how you would like to treat it. I'd like to meet with you face to face if it is convenient for vou, but for vour backeround, here are the elements of our concern with this one: • Mecklenburg County has applied for authorization to discharge under our General Permit NCG24 for composting activities. Similar to the mining permit, NCG24 authorizes both wastewater and stormwater discharges. This site will be the new Compost Central, replacing the current Compost Central located six miles south and adjacent to the airport, and currently discharging into Coffey Creek. Old Compost Central will be shut down. The new facility will be Charlotte/Mecklenburg's main composting facility, the largest yard waste site in the state. Yard waste sites are classified as Type 1 facilities by our brothers and sisters in the Div. of Waste Management. • The discharge will be into Gum Branch, a WS-IV water that goes to Long Creek and then to Lake Wylie in the Catawba River Basin. • Your review of our intent to issue a permit authorizing a wastewater discharge is required by rule. • However, in this case the aspect that we want to be clear with you on is that all discharges from a DWM Type 1 composter (a yard waste composter) have been deemed to be stormwaters by SL 2012-200. So, our permit will have to regulate these discharges in accordance with just the stormwater provisions of NCG24. • And so, by one perspective, why um I bothering you with this? Since you are not required to review our permits for stormwater discharges. It's more along the lines of full disclosure and effective coordination between our programs. • While it is generally true that discharges from a compost site are rainfall -driven, that's not the same as assuming that the untreated runoff will be relatively innocuous, like some might assume for most stormwaters. Untreated stormwater runoff from compost facilities varies wildly wrt pollutant concentrations. There is no reliable generalized characterization available for compost site runoff. Under very bad circumstances untreated runoff can be comparable to raw sewage for many pollutants. • Our permit NCG24 requires quarterly sampling and has numerical benchmarks intended to control the pollutant content in stormwater discharges. We have benchmark values for TSS, COD, fecal, TN, TP, Cu, Pb, Zn, and pH. The exceedance of a benchmark kicks the permittee into a Tiered response action structure, with increasing management attention and actions required as the Tiers escalate to Tier 1, Tier 2, Tier 3. • The applicant has provided a partial site plan showing a rather sizable forebay and wet detention pond (nominally 500' x 200' out to out, and 10' deep) including forebay. A pretty substantial wet pond in most contexts. Maybe in this context, too. So, the stormwater discharge will not be untreated. That's enough background I think. Unlike the other issues in your uestion this is well established in the Stormwater Permitting Program's past practice, and we don't have any uncertainty on this point. • `:..have TMDLs (nutrients and turbidity ...)... a letter request for Speculative Effluent Limits" OK, this is o more detailed issue, and Mike Templeton will have to help us when the ooplication is received, or before: Some of the elements that might be involved could be as follows. - o Mike reports that the TMDL applicable in that location is an older one (-1995), and the methodology applied at that time has since evolved in other TMDLs. So, this could be a special case when we get to evaluating this new site. o There are several uncertainties involved at this point in time. _Consider that the TMDL for that watershed includes nutrient allocations for wastewater treatment facilities discharging lows measured in MGD 2417. Incorporating a sporadic roinfoll-driven flow into the overall nutrient allocation calculation presents some uncertainties, although I think that similar considerations hove been incorporated before. o A corollary to the presence of WWTP discharging in MGDs is that the nutrient contribution from the new site may fall below the significant mass: 1 mean, consider that the nutrient allocation for a WWTP discharging several MGD will probably (?) dwarf the nutrient mass from the new site, and the new nutrient load rnoyf2fl out of_the _ allocation calculation base on it being orders of magnitude smaller than the other allocations. o If the old Compost Central also discharged into the some watershed, subiect to the some TMDL, there may a regulatory_path through the observation that the new nutrient contribution is equal to or less than the contribution from the old site. i note that the airport is on the west side o f Charlotte, but I'm not certain if the two sites (old and new) actually contribute to the same TMDL area. o A beginning point might be to assemble the data available from old Compost Central and tabulate the nutrient analytical results and flows (if we have flow measurements or estimates.) I know they have some historical nutrient analyses. o As 1 understand it Lrom Mike,_ speculative effluent limits are water quality based limits. They are always more stringent than technology based limits. The four parameters contained in NCG24 are technology based limits. o If it turns out that the nutrient moss contribution from this site is significant then Mike reports that other WWTP in other TMDLs are seeing single digit concentrations (back -calculated from the mass allocation.) The phosphorus limit is more or less around 1 mq1L. The nitrogen limit is more or less around 6mg/L, all varying with the particular receiving water and other allocations. o Further, if a TMDL allocation calculation determines that this site would have a significant nutrient contribution, then we would incorporate the additional nutrient concentration permit limits in an amended Certificate of Coverage. The amended COC would essentially add nitrogen and/or phosphorus to the monitoring suite, in addition to the parameters already in place in NCG24: TSS, BOD, fecal, and pH. • It might be good to check on what if any, local restrictions would ooply based on the presence of a water supply watershed. Is this location in a WSWS? There are some constraints on new wastewater discharges into some WSWS. So, potential action items are: o I'd suggest that you tabulate the historical nutrient measurements from old Compost Central as on indicator of what could be expected from new Compost Central. Some crude flow_ measurement estimation from the new site would also be helpful in the mass calculation, I think. (Mike will hove to help us more when you're ready for that help.) o Resolve whether or not the old and new site discharge to the some TMDL area. o Let us know if the site is in a WSWS. ^ o It may be that we can reach a conclusion that the nutrient mass contribution is insignificant. But, we don't want to do that 'by observation' or by 'best Professional1udgment'. We want to do that numerically to the level of rigor that Mike helps us determine as appropriate. One says, "The Division of Water Quality shall not require water quality permitting for any Type 1 solid waste compost facility, unless required to do so by federal law." SL 2011-394 The other says, "A Type 1 solid waste compost facility shall be subject only to applicable State stormwater requirements and federal stormwater requirements established pursuant to 33 USC 1342(p)(3)(B). A Type 1 solid waste compost facility shall not be required to obtain a national Pollutant Discharge Elimination System (NPDES) permit for discharge of process wastewater based solely on the discharge of stormwater that has come into contact with feedstock, intermediate product, or final product at the facility. " SL 2012-200. (See federal definition of process wastewater at 40CFR122.2 for an interesting comparison.) We have only applied this 2012 law a few times, but exclusively for the municipal Type 1 yard waste composters. We have told them that according to Session Law they are governed only by the stormwater provisions of our General Permit, NCG24, not the wastewater provisions (NCG24 is one of our combo ww + sw General Permits that we administer.) So,,,,,,,,,,,,,,,,,,,,,,,,,,,,I think we may be moving toward avoiding any consideration of revised BOD limits in our permit for the new Compost Central facility. I mean, according to state law they are not subject to the wastewater requirements of our permit (BOD limits of 30/4S mg/L.) It only makes sense that if they're not subject to BOD limits in the General Permit, they wouldn't be subject to any revised WQBEL BOD limits in the permit, either. I think we need to know that Gum Branch is not a zero -flow stream. The rule citation is: 15A NCAC 02B .0206, and the most restrictive part of that rule is .0206(d)(2), "If the 30Q2 and 7Q10 flows are both estimated to be zero, no new or expanded (additional) discharge of oxygen consuming waste will be allowed." Note that this part of the rule applies only to new discharges —which the new Compost Central would be. And that the restriction is limited to streams where both flow statistics are zero (30Q2 and 7Q10). Other parts of the rule are less restrictive. As I understand the application of this rule, even treated wastewater is considered to be a discharge of oxygen consuming wastes, and so the rule effectively prohibits treated wastewater discharges into zero -flow streams. I mention this because while it appears that the site is not exactly on the headwaters of Gum Branch, it's not too far downstream either, according to the map I'm looking at. If this is an issue, let's face it early. The whole run of Gum Branch is sufficiently removed (several miles) from Lake Wylie to be outside of the WS-IV Critical Area, and so the treated.site wastewater discharges would be allowed, and would not be subject to the Critical Area special restrictions. Mike Templeton corrected my generalization on speculative effluent limits in my previous email below: "They are almost always more stringent than technology based limits." In this case the difference may not be significant since the wastewater limits entered into the permit are always the more stringent of technology or water quality (speculative) based limits. Further, I note that old Compost Central at the airport drains to Coffey Creek, which enters the Catawba River in South Carolina.
