PROJECT SUMMARY: The applicant proposes to develop a 10 lot subdivision including roads and utilities. Robert W. Gilbert, Scotch Bonnet Enterprises, Inc. Page Two 9. PROJECT DESCRIPTION Charles F. Riggs and Associates, Inc., on behalf of Scotch Bonnet Enterprises, Inc., has requested that the attached application be processed under the Express Permit Review Pilot Program. The applicant's project is located along N.C. State Highway 210, just north of ninth street, approximately 0.1 miles north of the Town line of Surf City and North Topsail Beach, adjacent to Stump Sound, in North Topsail Beach, Onslow County. To find the property, take Highway 17 North from Wilmington and turn right on N.C. State Highway 50 (approximately 30 miles from Wilmington). Head east on Hwy 50 and turn left onto Hwy 210 at the intersection of Hwy 210 and Hwy 50. The property is located on the western side of Hwy 210, approximately 2.5 miles from the intersection of Hwy 210 and Hwy 50. Ninth street borders the property to the south and Seaside Developers, LLC, borders the tract to the north. Scotch Bonnet is a 7.6 acre portion of a 53.0 acre tract that is dominated by both coastal wetlands and " 404" type wetlands. The high ground portion of the tract is mostly cleared of vegetation and is relatively flat with an elevation of 5.0' above Normal Low Water (NLW). Several small stands of Live Oaks (Quercus laurifolia), Southern Wax Myrtles (Merica cerifera), Yaupons (Ilex vomitoria), and Red Cedars (Juniperus virginiana) exist on the water ward side of the site, bordering the Stump Sound. There is an existing dirt road located on the southern side of the tract that enters the property from the east and continues across the high ground section approximately 450 feet towards Stump Sound. The tract has approximately 1,310 linear feet of shoreline along Stump Sound. The high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichia frutescens) and Grounsel-bush (Baccharus halimifolia). High coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Salt Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterni, flora) is the predominant species. The shoreline in this area is not bulk-headed. The proposed development averages approximately 130 feet landward of normal high water (NHW), along the western edge of the property. The waters of Stump Sound, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to maps provided by the Department of Environmental Health, Shellfish Sanitation Section, the area located within the ninth street canal is CLOSED to the harvesting of shellfish, however, the remaining waters bordering the subject property are OPEN. The subject property is located within the High Hazard Flood Area, as indicated by Zone VE (elevation 16) on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean. PROPOSED PROJECT The applicant proposes to develop a 10 lot subdivision. Development would include grading and filling approximately 3.3 acres of the property for road construction and lot preparation. Individual lots sizes would average 18,864 square feet - a density of 1.31 units/acre. Access to the lots will be provided by the construction of a single road (Scotch Bonnet Soundside). The road would provide the subdivision with one entrance and exit from Highway 210. The asphalt road would terminate in a turn around cul-de-sac at the northern end of the property. Scotch Bonnet Soundside street would consist of a 25 foot right-of-way and a 20 foot paved asphalt surface with an ABC stone sub-base. The road would be constructed with curb and gutter, utilizing curb breaks and vegetated swales to control stormwater. The applicant has submitted an Express Low Density Stormwater. Permit to the North Carolina Division of Water Quality. The Express Stormwater permit application was received on 5/17/2004 and was permitted under DWQ State Stormwater Permit No. SW8040501. According to the site drawings, the total built upon area for lots 1-5 would be 2,600 square feet, lots 6-9 would have a total built upon area allowance of 3,100 square feet and lot 10 would be allowed 6,962 square feet of impervious coverage. Page Three According to the permit application and site drawings, the applicant is proposing to install a series of ten (10) individual septic systems along the eastern property line. The systems (peat) would be located on a 39,519 square foot lot. Approximately 13,600 square feet of impervious coverage would be allowed within the area. The applicant indicate6s that he has obtained verbal approval from Onslow County for the construction of ten (10) on-site septic systems, however no plan has been approved In addition, the applicant has an approved Sedimentation and Erosion Control Plan (No.Onslo-2004-313), which was validated on 6/10/2004 by the Division of Land Quality. Municipal water would be provided to the subdivision by Onslow County Water. As proposed, no portion of the subdivision, including but not limited to the dwellings, eaves, access roads, driveways, streets and/or sidewalks will impact any portion of coastal wetlands or "404" type wetlands. The applicant has indicated that individual lot development would be handled under the CAMA minor permit program through the Town of North Topsail Beach. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 3.3 acres of high ground. The proposed dwellings, street and drives would result in the creation of approximately 62,044 square feet of impervious surface. Total impervious surface coverage within the 75' Estuarine Shoreline AEC would be 5,510 square feet. Future individual lot owners would be required to obtain CAMA Minor Development Permits from the Town of North Topsail Beach for each lot. Highway 210, lying east of the Town Line of Surf City and North Topsail Beach. The tract has a width of 602.13 feet and an average depth of 553 feet from the northern right-of-way line of N.C. Highway 210 to the normal high water line of Banks Channel. This portion of the tract served as a mobile home park, servicing approximately 18 homesites. All mobile homes have been removed to date. It is the intention of Scotch Bonnet Enterprises, Inc. to develop 10 single family lots with asphalt street, Onslow County water, private peat systems with common recreational area. Scotch Bonnet Enterprises, Inc. will construct all improvements as shown on the enclosed plan, with the exception of the single family dwellings. This application is for the construction of all the items within the proposed subdivision with the exception of the proposed single family dwellings. These dwellings will be permitted by the Minor CAMA Permit Process. All development will lie completely upon uplands. The 404 wetland delineation and coastal wetland delineation have been performed and approved by both the U. S. Army Corps of Engineers and Division of Coastal Management, respectively, and is illustrated on the plan. This property is presently zoned Manufactured Housing Residential. This allows for the construction of the plan as submitted. This plan is also consistent with the Town of North Topsail Beach Land Use Plan. This project has received preliminary approval from both the North Topsail Beach Planning Board and the North Topsail Beach Board of Alderman. Final Approval of the Project will be granted upon the State's approvals of the Water Plan, Sedimentation and Erosion Control Plan, Stormwater Plan and the CAMA Plan. This application has been submitted and approval is pending. This property is located in a High Hazard Flood Area and a properly executed AEC Hazard Notice is enclosed.
