This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Based on your representation , the City of Sanford Compost Facility is a Type 1 compost facility, the provisions of the recently enacted Session Law 2012-200 pertain to the facility. Consistent with the provisions of SL 2012-200, the Division of Energy Mineral and Land Resources (DEMLR) will permit all the composting discharges from your Type 1 facility under the stormwater discharge provisions of the permit, and the General Permit requirements related to process wastewater discharges do not apply to the composting discharges from your Type I facility. This permit does not affect the legal requirements to obtain other permits which may be required by DEMLR or permits required by any other federal, state, or local governmental agency. Please note that this certificate of coverage is not transferable except upon the specific action of DEMLR. In accordance with the provisions of Session Law 2012-200, the process wastewater mana eg ment requirements do not apply to the composting discharges from this Type 1 facility, and all composting operation discharges are authorized when the facility complies only with the stormwater provisions of the General Permit. To the extent any provisions may be read to impose the process wastewater standards in the General Permit to discharges from the permittee's facility, the provisions are suspended and do not apply. This Certificate of Coverage is an enforceable part of General Permit NCG240000, and shall become effective for the permittee on June 26, 2014. I have been holding the City of Sanford stormwater discharge permit for a while, waiting for their transition from a Type 3 to a Large Type 1. Have they met your requirements for that transition, yet? It makes a difference to us in that we will provide slightly different permit documentation for them depending on which Type they are. We encountered permit processing delays related to both Sanford's consideration of a Type 1 status, and our own considerations of how to deal with Type 1 facilities in light of Session Law excusing Type 1 facilities from wastewater permitting (but not from stormwater permitting). Finally after a lengthy delay in our process we are ready to act now. Donna has been sending me correspondence indicating that Sanford is almost there with you all, but we will be ready in the next couple of days (really, two days or so) to issue the permit. Based on the application status of Type 3 from 2012, we are going to issue our General Permit with our standard Certificate of Coverage (COC) for the facility. When Sanford successfully completes the transition with you, we will be happy to re -issue a new Certificate of Coverage as a Type 1 facility. It may be that we are looking at a half hour of extra work at our end, maybe. It's no big effort for us, and there won't be much of a delay in issuing.a new COC, we can turn it around within a week of receiving Sanford's request to do so based on your issuing the Type 1 permit for them. 1 have left a courtesy message for Larry Craig at Sanford alerting him to the pending issuance of his stormwater permit, and our readiness to change the COC when he indeed achieves Type 1 status through you all. Until then, he will be treated as a Type 3 facility under our stormwater permit. One new approach I'm willing to risk is to selectively skip the review loop through the ROs on some permit applications, particularly the ones that I am so far behind on. Several are in RRO. First: Well, the Raleigh Yardwaste Center was the first one, last year. You were ok on that based on RRO's past involvement in the discussions, and presumably also on my immersion in the topic and with this applicant. I'm still working with Kathy Cooper and City of Raleigh on that one. But, First this year: City of Sanford composting facility. Application NCG240001, submitted June 2012. Natalie and Tom Ascenzo visited the site to make a stream call in May 2011. The City has a layout that is a natural for very minor construction (maybe a weir and wall across the drainage Swale) to establish a single good clean discharge sampling point. They have a highly vegetated drainage flat that runs through the center of the facility, and it's likely a good bit of vegetative treatment is accomplished during low flow periods from small to medium rain events (I wouldn't necessarily think the same thing about high flow events, however.) They are a Type III -facility, so the legislation in summer 2012 excusing Type I facilities does not apply, and we can issue NCG24 without that complication. Recall that the text of the permit requires that permittees with already existing facilities must appear before RRO within 6 months of the issuance of the COC. At that time he is required to present his plan for moving forward and towards compliance with all aspects of the permit for your review and approval. On the basis of my immersion with the development of the permit; and on the basis of my past site visit to Sanford; and on the basis of RRO staff establishing that the on -site feature is not a 'waters of the state', but is an anthropogenic feature; and with the prod of my past inaction over several months, asking if you can let me skip RRO prior review in the issuance of COC #NCG240001 to Sanford. Let me know if you wish to discuss either my current request on Sanford's compost facility, or more generally my proposal to selectively skip the RO review step on some permit applications. The purpose of this work is to (1) stay within the confines of our permit by striving to eliminate sanitary sewer overflows, (2) decrease the load on the wastewater treatment plant during wet weather events, and (3) regain poorly utilized capacity at our wastewater treatment plant. To that end, the City of Sanford Ordinances (Section 38-241 b 12) prohibits the discharge of stormwater to the sanitary system. The City is also undertaking a $48 million expansion of the wastewater treatment plant to provide for the projected growth in Lee County over the next 20 years. These projections do not include the treatment of stormwater. The intentional introduction of stormwater into the sewer would be counter to the City's efforts, require millions of dollars of infrastructure upgrades to convey the stormwater, and require millions of dollars to further expand the wastewater treatment plant to treat the additional flows. Therefore, the City's wastewater treatment plant will not accept the intentional discharge of stormwater into our sanitary sewer system. Approximately sixteen cubic yards of chicken manure is added before these separate rows are combined. These rows are periodically watered, turned, and peaked to build temperatures. This process breaks the material down gradually and /can take five to seven months to produce mature compost. Samples are then taken and sent to the NCDA&CS Agronomic Division for waste analysis testing. After the results are in, the compost is then transferred to an onsite stockpile location for consumer purchase. Storm water runoff from the site is channeled through grass swales along drainage ways that existed prior to development. This process breaks the material down gradually and can take five to seven months to produce mature compost. Samples are then taken and sent to the NCDA&CS Agronomic Division for waste analysis testing. After the results are in, the compost is then transferred to an onsite stockpile location for consumer purchase. We encountered permit processing delays related to both Sanford's consideration of a Type 1 status, and our own considerations of how to deal with Type 1 facilities in light of Session Law excusing Type 1 facilities from wastewater permitting (but not from stormwater permitting). Finally after a lengthy delay in our process we are ready to act now. Donna has been sending me correspondence indicating that Sanford is almost there with you all, but we will be ready in the next couple of days (really, two days or so) to issue the permit. Based on the application status of Type 3 from 2012, we are going to issue our General Permit with our standard Certificate of Coverage (COC) for the facility. When Sanford successfully completes the transition with you, we will be happy to re -issue a new Certificate of Coverage as a Type 1 facility. ft may be that we are looking at a half hour of extra work at our end, maybe. it's no big effort for us, and there won't be much of a delay in issuing a new COC, we can turn it around within a week of receiving Sanford's request to do so based on your issuing the Type 1 permit for them. I have left a courtesy message for Larry Craig at Sanford alerting him to the pending issuance of his stormwater permit, and our readiness to change the COC when he indeed achieves Type 1 status through you all. One new approach I'm willing to risk is to selectively skip the review loop through the ROs on some permit applications, particularly the ones that I am so far behind on. Several are in RRO. I'm proposing to notify you each time I pick one up, and ask you to pass on it. Let me know if you would prefer not even to consider such an approach. First: Well, the Raleigh Yardwaste Center was the first one, last year. You were ok on that based on RRO's past involvement in the discussions, and presumably also on my immersion in the topic and with this applicant. I'm still working with Kathy Cooper and City of Raleigh on that one. But, First this year: City of Sanford comgosti Lfacility. Application NCG240001, submitted June 2012. Natalie and Tom Ascenzo visited the site to make a stream call in May 2011. The City has a layout that is a natural for very minor construction (maybe a weir and wall across the drainage swale) to establish a single good clean discharge sampling point. They have a highly vegetated drainage flat that runs through the center of the facility, and it's likely a good bit of vegetative treatment is accomplished during low flow periods from small to medium rain events (I wouldn't necessarily think the same thing about high flow events, however.) They are a Type III facility, so the legislation in summer 2012 excusing Type I facilities does not apply, and we can issue NCG24 without that complication. Recall that the text of the permit requires that permittees with already existing facilities must appear before RRO within 6 months of the issuance of the COC. At that time he is required to present his plan for moving forward and towards compliance with all aspects of the permit for your review and approval. On the basis of my immersion with the development of the permit; and on the basis of my past site visit to Sanford; and on the basis of RRO staff establishing that the on -site feature is not a 'waters of the state', but is an anthropogenic feature; and with the prod of my past inaction over several months, i asking if you can let me skip RRO prior review in the issuance of COC #NCG240001 to Sanford. Let me know if you wish to discuss either my current request on Sanford's compost facility, or more generally my proposal to selectively skip the RO review step on some permit applications. If the on - site ditch had been determined instead to be 'waters of the State', then they would have had to construct their BMPs in the otherwise spoken for composting process areas. (DWQ does NOT permit BMPs built in -stream.) (DWQ does NOT permit BMPs built in -stream.) The stream origin is located approximately 20 linear feet downstream of the facility's property line. We tied a flag at the origin and shared this information with the Town.
