Dear Mr. O'Brien:
On June 14, 2004, we received your letter requesting confirmation that the Neuse River Buffer
Rules (15A NCAC 2B .0233) apply to two streams located on the north and east boundaries of
the subject property. Both streams (Stirrup Iron Creek and an unnamed tributary to Stirrup Iron
Creek) are depicted on the USGS topo map and the Wake County soil survey. As such both
streams are subject to the Neuse River Buffer Rules, unless determined to be "exempt" by the
DWQ based on an on-site determination. This office is not aware of any such exemption.
The DWQ has determined that the streams described within your June 14, 2004 letter are subject
to the Neuse River Buffer Rule.
This letter only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. Nor does this letter approve any activity within Waters of the United States or
Waters of the State. If you have any additional questions or require additional information

3 & 4 of G. S. 150B.

WATER QUALITY SECTION
S&ME is currently working with a developer at Trans Air Park, Lot No. 9, located on
Trans Air Drive in Morrisville, NC. Two streams flow past the site to the north and the
east. The stream to the north is an unnamed tributary to Stirrup Iron Creek, which is the
stream to the east.
S&ME personnel have verified that both streams are located approximately where they
are depicted in the USGS topographic map (Cary, NC quad) and the Soil Survey of Wake
County, and that both streams are at least intermittent. Copies of the soil survey and the
topo quad are attached, as well as a picture of Stirrup Iron Creek.
The project's surveyor will survey the top of the closest bank for each stream and will
draw a 50-foot riparian buffer horizontally from the closest bank. Can you please verify
in writing that a 50-foot Neuse River riparian buffer should be applied to each stream?
Personnel with the town of Morrisville are requesting this information for documentation.
An on-site determination is not requested since we are not contesting the streams' origins
or classifications.
