In accordance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. his permit is
expressly nditioned upon compliance with all the requirements of the appr ved Reclamation
Plan. Howev , completed performance of the approved Reclamation Pla is a separable
obligation, secu d by the bond or other security on file with the Departm nt, and may survive
the expiration, rev ation or suspension of this permit.

to achieve the purposes and requirements of the Mi Act, the Department may give the
operator written notice of its intent to modify, revoke r uspend the permit, or its intent to
modify the Reclamation Plan as incorporated in the erm The operator shall have right to a
hearing at a designated time and place on any pr osed m ification, revocation 'or
suspension by the Department. Alternatively an in addition t the above, the Department
may institute other enforcement procedures au orized by law.
Definitions
Wherever used or referred to in this per unless the context clearly indtcates otherwise,
terms shall have the same meaning as applied by the Mining Act, N.C.G. 74-49.
Modifications
March 14-2005_ A partial releas has been granted at this site reducing the permi d
acreage from 213.9 acres to 16 .9 acres and reducing the affected acreage from 13 acres to
94 acres.
June 16, 2008: This perms , issued to Barnhill Contracting Company, has been transferre in
its entirety to Cool Spring Sand and Gravel Inc.
Expiration Date
This permit shall be/6ffective from the date of its issuance until September 4, 2013.

Your facility is currently covered for stormwater discharge under General Permit NCG 170000. This permit will
expire on July 31, 2004. North Carolina General Statute 143.215.l(c) requires that an application for permit
coverage renewal be filed in a timely manner. A prior notice of renewal was sent for this site on December 1,
2003. To date, no response has been received by the Division of Water Quality (DWQ). In order to assure your
continued coverage under the general permit, you must apply to DWQ for renewal of your permit coverage.
Enclosed you will find a general permit renewal application form. The application must be completed and returned
by April 19, 2004 in order to assure continued coverage under the general permit.
Failure to request renewal by April 9, 2004 can result in a civil assessment of at least $250.00- Larger penalties
may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $10,000 per day.

In response to your renewal application for continued coverage under general permit NCG170000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general Stormwater permit NCG 170000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

In accordance with your application for discharge permit received on March 20, 1995, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
