Approval of 401 Water Quality Certification (GC3351) with Additional Conditions
Dear Ms. Emerick:
You have our approval, in accordance with the attached conditions, to place fill in 0.007 acre of coastal
wetlands in order to construct a bulkhead as described in your application received by the Division of
Water Quality (DWQ) Wetlands/401 Unit on July 12, 2004. After reviewing your application, we have
determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351
covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued
by the US Army Corps of Engineers (USACE). In addition, yoii, should get or otherwise comply with any
other federal, state and local requirements before you go ahead With your project including (but not
limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3351.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative,Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions 'are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

a man-made canal to the Pamlico Sound in Brigands Bay Subdivision, Frisco, Dare County.

Project Setting
The site is located in the Brigands Bay Subdivision at 50031 Captains Court on lots 251
and 252, in Frisco Village, Dare County. The applicant's property consists of a small pile
supported single-family residence on three lots (251 through 253) near the end of a man-
made canal. The property has approximately 175 feet of shoreline. Approximately 87 feet
of shoreline was stabilized with a wooden bulkhead over ten years ago. The applicant also
has a small dock located on lot 252 near the rear of the residence.
This lot has a level grade and an elevation of approximately 4 feet above the Normal Water
Level (NWL). The lot is vegetated entirely in upland grasses, shrubs, and trees, except for
a narrow irregular coastal wetland fringe of Juncus roemerianus and Spartina alternif/ora.
An erosion escarpment is present along most of the unstabilized portion of the shoreline of
lots 252 and 251. Portions of this shoreline are being undercut and have eroded, resulting
in some clumps of existing vegetation washing off into the canal. The application states
that 2 feet of erosion has occurred along this shoreline within the last year.
The canal connects to the Pamlico Sound and has a width of approximately 100 feet. The
water depth, at a distance of 3 feet off shore, is approximately two feet. The canal bottom
consists predominately of sand with little organic material. No areas of submerged aquatic
vegetation were observed during the site visit. The waters of this canal carry the same
water classification as the Pamlico Sound. The North Carolina Environmental Management
Commission has designated these waters as'SA' waters (suitable for shellfish propagation
and harvesting); however, the waters in this vicinity are closed to the commercial harvest of
shellfish. During the site visit, no finfish or shellfish were observed along the shoreline.
The Coastal Resources Commission (CRC) has designated these waters as Public Trust
Area and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the
designation of the CRC, the Coastal Shoreline AEC extends in a contour 75 feet landward
of the NWL. The CRC has also designated coastal wetland vegetated areas, like the one
described above, as a Coastal Wetland AEC. The North Carolina Marine Fisheries and
Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal
Waters.

Project Description
The applicant proposes to stabilize the remaining shoreline portion of lot 252 and the entire
shoreline of lot 251 with a bulkhead. The proposed bulkhead will connect to the existing
structure on lot 252 and extend west along the shoreline of lot 251. The bulkhead will end
near the property line between lots 251 and 250 with a return wall. The proposed bulkhead
alignment will extend waterward an average of 3 feet beyond the NWL. The proposed
bulkhead will be constructed of treated wood. The bulkhead tieback area will extend
approximately 10 feet landward, and be backfilled with sand from an off-site source. This
bulkhead alignment will result in the placement of approximately 8 cubic yards of fill
material below the NWL. This proposal does not include any maintenance excavation of
the adjacent canal bottom areas beyond the proposed bulkhead alignment.
Anticipated Impacts
The proposed bulkhead alignment will result in the filling of approximately 264 square feet
of water bottom and Estuarine Waters. The proposed alignment will result in the loss of
approximately 40 square feet of a small, irregular coastal wetland fringe. The overall land
disturbance within the Coastal Shoreline, associated with the tieback area, will be
approximately 880 square feet. The bulkhead structure, backfill, tieback, and grading
activity associated with the bulkhead installation will result in a total of approximately 1,184
square feet of land and water disturbance within the Estuarine System.
An inspection of mapping data on cultural resources revealed that no archaeological or
cultural resource findings had been recorded on the available maps in the immediate
vicinity of this project. However, sites have been located within the Subdivision nearby. It
is important to note that the available cultural resource maps have not been updated in at
least 10 years and the potential for the existence of cultural or historical resources is
possible.
The proposed shoreline stabilization structure and filling activity will result in an increase in
turbidity levels, at least temporarily, along this portion of this waterway. The placement of a
bulkhead structure may result in some alteration of the water bottom adjacent to the
existing shoreline. The proposed structure will reduce the erosion of the shoreline of this
lot, and in turn reduce the long-term turbidity associated with un-stabilized shorelines.

The applicant has expressed concerns during a site visit that the principle reason she
wishes to install a bulkhead along this remaining portion of her shoreline is to prevent the
loss of large existing trees that are located along the shoreline. The proposed bulkhead
structure's alignment will provide erosion protection to these trees.
