We are in receip€ of the `Notice of Violation' dated June 30, 2016 that was issued to
The Lane Construction Corporation (Dine). The notice of violation references missing TSS
reports as well as no response action taken for TSS exceedances.
At the outset, it is important to note that one of Lane's core value is to protect and
enhance environment. As such we are con-tnitted to carrying out our operations in an
environmentally responsible manner. Further it is our intent to comply with all applicable
regulations.
In this case and alter a thorouglt evaluation of both the site and the General Permit

waters of North Carolina or separate storm sever systems..." (Etrnpltasis it) original.) .See

The Garner site inspection report dated .tune 20, 2016 by Mr. Perlmutter identifies two
out falls (SD 01 and SDO 2). The term "Stormwater Discharge 0tit fall" is defined iit the Permit
a s:
"the point of departure of stormwater from a discernible, confined,
or discrete conveyance, including but not limited to, storm sewer pipes,
drainage ditches, channels, spilhvays, or channelized collection areas, front
which stormwater flows directly or indirectly into waters of the State of
North Carolina." See Permit Part IV PgFc�l.
Neither of the areas identified as SDOI and SDO2 have any piping or type ocstructure.

retention areas as having a "Stormwater Discharge Outran".
SDO 1 is located at the northeast corner of the property and does not have a discharge
to surface waters of the State. Fitial outno%v of any stormwater is through a stone check data
within property boundary. Stormwater is thee] allowed to flow through the check darn as sheet
flow to a natural arborous and permeable area. As such, this retention pond does not meet the
definition of surface waters of the State, nor does it discharge; to surface waters of the State.
Historically, SDO 2 was originally a stock pond for horses owned by a neighbor. It is
no longer used as any type of potable water but it remains as a sediment pond that collects
intermittent stormwater from a driveway located on the property. A site evaluation performed
by Environmental Coordinator, Orcg Davis after 0.90 inches of rain on July 13, 2016
confirmed there was no discharge froin the pond. Like SDO1, this pond does not meet (lie
definition of surface waters of the State, nor does it discharge to surface waters of the State.
In regards to the violation fbr sampling and tiered response deficiencies pursuant to the
Permit, none are required. In accordance with the Permit:
"[,t]nafytical monitoring of stormtivater discharges shall be
performed as specified in Table 1 at each stortnivater outfall." (Emphasis
in original). See Permit fart lI page 4.
The "Sample Type" rioted in the permit requires that it grab sample "shall be collected
within the first 30 inintites of discliargc"; "during a nteasureable storm event". Since there is
no discharge point from these ponds, there can be no grab sample outside a sit-ople sampling
of the standing water. Such a sample is not reflective of the definition in the Permit. Given
the invalidity of the sample; the results expected of flowing water are not reliable.

Likewise:

Part JI page 7.
In addition:
"[q]ualitativc monitoring requires a visual inspection of each
stormwater outfall regardless of representative outfall status." Id.
Since there are no outfalls, there can be no proper point to perform a qualitative
monitoring test. We believe that the prior staff were simply perfot'mittg perfunctory tests. In
any event, the prior samplings taken are invalid for either analytical or qualitative monitoring.
Given the issues prescnted wish the Notice of Intent, Lane respectfitlty requests that the
Notice of Violation be rescinded along with acceptance of a Notice of Tei'mination under die
permit. As there is no coverage for the site under the Permit, is was simply mistaken for prior
staff to have filed the Notice of Intent seeking coverage under the Permit. Should you feel the

Inspection Summary:
On June 20, 2016, 1 (Gary Perlmutter, DAQ-RRO) visited Lane (Garner) for a multimedia inspection. There 1 met with Mr.
Jamie Backus, Plant Supervisor, and Mr. Greg Davis, Environmental Coordinator. We first rewiewed permit stipulations and
required records for complaince with General Stormwater Permit No. NCG160082, dated September 30, 2014. The SPPP
was found to be dated 2014, to which Mr. Davis indicated that he is currently reviewing it as one of his tasks as the
Company's new Environmental Coordinator. The SPPP was fairly well organized, however some Qualitative and Analytical
reports were found missing. Facility personnel contacted the analytical laboratory for the missing reports, of which they
were e-mailed one report for samples collected in July 2015. Reports for the second half of 2012 and the first half of 2014
were still unaccounted for. The analytical report for sampling in December 2014 showed an exceedence of 109 TSS, and
that for samples collected in December 2013 showed an exceedence of 329 mg/L TSS. Neither exceedence was followed
up with TIER ONE investigation. Mr. Backus and Mr. Davis noted that moving forward they will plan to sample for the
current Monitoring Period ending June 30, 2016, as rain is expected on Friday, June 24, 2016. During the tour all tanks
were observed with secondary containment walls, in which Mr. Backus indicated are empited via pump (no valves or
open-ended pipes were observed). Both outfall pipes were observed, and they appeared well maintained for easy sampling
access.

facility's Certificate of Coverage was observed with the recievinq waters identified as White Oak
Creek (Austin Pond). The pond is the receiving water for SDO 2 which appears to have no
outflow, but is situated above an unnamed_ intermittent stream of White Oak Creek. SDO 1 lies
above a slope that drains to White Oak. Creek., The facility has no representative outfall.

The North Carolina Division of Air Quality conducted a multimedia inspection of the LANE (Garner) on June 20,
2016. One of the objectives of this inspection is to verify that the facility is operating in compliance with the
conditions and limitations specified in NPDES SW Permit No. NCG160082. A summary of the findings and -
comments noted during the inspection are provided in the inspection report that was mailed to you separately.
The Compliance Evaluation inspection was conducted by Division of Air Quality staff from the Raleigh
Regional Office. The following violation(s) were noted during the inspection:

Gary Perlmutter with Air Quality performed and inspection for the multi -media program which is the site inspection the
NOV was issued. In that inspection it was noted that sampling/records were not up to date. Lane Constructions response
to that NOV was the letter you mentioned dated July 27, 2016 stating basically they shouldn't have been issued a NOV
because they didn't need their General Permit because they didn't have an outfall. That prompted the Rescission
request and my inspection. I inspected the facility on September 30th and found the outfall from the site, which was a
pond outlet. After researching the site and pond I found that the pond is jurisdictional which requires them to sample all
discharges into the pond. They have two discharges into the pond and that's where the additional sample point I
requested they add comes from. Their Environmental Coordinator (Greg Davis) now understands that they do indeed
have multiple outfalls, their general permit is valid and they are working on updating the site map, sample protocol and
records in response to the NOV.

Thanks so much for the follow up. All of the no exposures that you approved I went ahead and made active in RIMS.
ABF Freight did submit a rescission for the site back in July 2015. 1 will draft a rescission letter and send out and activate
the no exposure.
Also, The Lane Construction Corp had sent a rescission request back in August 2016. Looks like your inspection was in
June. They sent us a copy of the letter they sent to John Holly dated July 27, 2016 in response to the violation. Do you
have a copy of that letter?
