On December 13, 2012, the Division of Energy, Mineral and Land Resources received your request to
rescind your coverage under Certificate of Coverage Number NCG 160002.
Based on our review of your request and the recommendation of our Washington Regional Office, your
request for rescission has been denied. Your request was denied because there are industrial materials
remaining onsite, including piles of gravel and broken concrete. These materials must be removed before
a rescission can be granted. You may resubmit a rescission request once the site has been cleared of the
remaining materials. Your Certificate of Coverage Number NCG 160002 will remain in effect, and you
must continue to comply with your NPDES stormwater permit.

I visited the Barnhill Contraction asphalt facility in New Bern (NCG160002). There was no obvious activity on site. It
looks vacant but material that was left on site is still there. After my first visit back in April of 2013 I spoke to David
Glover of Barnhill Contracting Co. and told him about piles of sand, gravel and broken concrete on site and that this
material needs to be removed prior to us rescinding the permit. He said he will do it and inform me when the cleanup is
complete. I did not hear from him again. My recommendation at this time is to deny the rescission.
I have some pictures that I can e-mail to you if you need them, but they are about: same as pictures taken in April of
2013.
Attached is the inspection report for this site visit.

I Insper led the GDS Plymouth — Republic Services site (NCG08078�on F uary 6, 2014. The condition of the site is
almost uncha ed from the time of the original inspection which performed on March 7, 2013. Some activities
have been done but n�ppaint
t affects the rescission reques !There are still some exposed containers (closed 5
gallons containers witcl what appears to be th -hydraulic oil as well as couple of closed barrels with unknown
substances in them) Some of these to tainers are dking the fluids. Some Paint containers are stored in small shed
next to the main building but shad is in suc shape that it does not provide any protection from the elements.
At this time, my recommendation would to eny the rescission request based on these findings. I'm attaching some
pictures that I took yesterday.
Please feel free to contact me ifs u have any questions.

results.

Just checking in on these two requests.
We had talked about the Republic Services site, and the last time you were there, the site was deserted but electricity
was still on. You also mentioned there were some barrels there with unknown substance in them. Have these
remaining items been cleared and would you recommend rescission?
On the Barnhill site, you were going to check that they had cleared the remaining sand and gravel products before we
would issue the rescission.

I am working on resolving a couple open rescission requests in the Washington region. I just left you a message about
one, then I came across a second one. Do you know the status of industrial activities at these facilities and if they can be
recommended for rescission now?
NCG160002 — Barnhill Contracting Company — New Bern Plant. They first requested rescission in December 2013. As of
April 2013, you had said the site still had sand and gravel products that needed to be removed.
NCG080784 — Republic Services of INC. They requested rescission in January 2013. According to their request, the
facility closed in February 2011.

Inspection Summary:
Inspection performed by Samir Dumpor of WaRO as a follow-up to rescission request inspection of April of 2013. After
the first inspection (April 2013) the permitee was informed that some materials were still on site and that before we can
rescind the permit, said materials (gravel and broken concrete piles) have to be removed. The permitee agreed at that
time to do so, however during this inspection it was discovered that said material is still on site. Recommendation is to
deny the rescission.
