Division of Water Quality (DWQ) on July 12, 2004 and including additional information received on August 9, 2004. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3404 and 3402 (GC3404 and GC3402). The Certification(s) allows you to use Nationwide Permit(s) 14 and 39 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, and Non-discharge regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 21-1.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Diffuse Flow - All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re- concentrate before discharging into a stream as identified within 15A NCAC 2B .0233 (5). If this is not possible, it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional approval from this Office. 3. Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. 4. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre- Langdon Farms Properties, Inc. Page 3 of 3 September 28, 2004 Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 5. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 6. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification, (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. Please note that the decision by the NCEEP to accept the mitigation requirements of this project does not assure that this payment will be approved by the U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP for impacts associated with this project is appropriate. This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. Based on the information supplied by you in a letter dated July 14, 2004 the stream restoration that is necessary to satisfy the compensatory mitigation requirements for this project is summarized in the following table. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. The total acreage for the subdivision boundary is approximately 115.81 acres. The tract is made up of woodland and open areas which have been used primarily as farmland. The current ground cover is mostly short grass with trees that are present near the natural drainageways. The watercourse, including a small water hole, runs through the tract. "Open space" as required by the Johnston County Development Ordinance will be dedicated around the Neese Buffer zones. Wetlands are to be within the limits of the open space: and like the Meuse Buffer zones, they are somewhat protected by the reoorded open space that is not to be disturbed. Tile major construction activities associated with this project are due, almost entirely, to the cmisuvcdon of the roadway. Outlet ditches will be necessary to convey street runoff to the natural drainageway. The point where flow is released is necessary and is the only place where construction activities meet sensitive areas such as watercourses and buffers. However, all necessary and required measures to minimize impacts willbe addressed in the Stormwater Plan. (See section on `Existing Drainageway' ). The subdivision is not located within the Environmentally Sensitive Overlay District. (Please see attached USGS Quad Map for visual reference to much of the information contained Benin). The mudnaam allowable impervious area (IA) for residential sites that are not within the Envhmmentally Sensitive Overlay District is 15% or (115.81 acne x o.1.5) -17.37 acre allowed impecviou mess for this project. The allowable impervious area wEU noted in the restrictive covenants or may be noted on the fugal plat, as required by Johnston Cotmtry Stormwater criteria. Ptak Run& • As described in the previous won, as long as impervious areas (per lot) are less than 12.0596 peak attenuation will not be required. 'T'hese ere two separate dminageways. The primary dtainageway flows from northwest to southeast corner of the property. The primary basin consists of a number of tributaries conveying some offsite stormwater to the main drainageway. There is a secondary drainage basin located at the southwest comer which flows southeast. Bath basins are tnIxAaries to Black Creek. The open space consisting of the buffers and wetland shall be dedicated for protection. Also as mentioned in the "General information" section, outlet ditches will be neoessary to convey street runoff from proposed sweet construction to the natural draiaagewgy. The very end of this ditch must release the water into the drainageway and this is the only impact to the watercourse that is expected from construction. This ditch will be designed to dissipate velocities or shear stresses to acceptable levels before releasing the Bow into the receiving stream. Any other devices or BMP's that may be required by Johnston County Stormwater management shall be addressed in the Stormwater Management Plan. • The total "N-Loading" from this site is expected to be 2.3 lb/ae/yr. This is less than the allowable limit of 3.6 lb/ae/yr. "therefore, no nitrogen offset payment or water quality BMP will be required.. (Please see attached backup date supporting these conclusions). The proposed roadway and drainage ditches will be the main land disturbing activity for this development.
