Withers Ravenel is Eagle Rock's consultant. Adam requested a meeting with me to review the unusual circumstances in this start-up facility. • Eagle Rock will be buying the property and moving on site with their portable batch plant. • ST Wooten currently holds NCG140294 and previously had a batch plant on the site. They remain the tenant on the property owned by a third party, but Adam X. reports that STWooten has moved off site. None of their equipment remains. • Eagle Rock is concerned about the second bullet below. They want to proceed are not sure that STWooten will provide a signature for the transfer of the Certificate of Coverage NCG140294. • Adam also asked about turn -around time for the application. • I advised as follows: o Unlikely that we can deliver the CQC by Dec. 1, for example. But possibly by Jan 1 if urgent for you. o If urgent for you, please tell us that, and when, and why. o We can't transfer the permit out from under ST Wooten. I don't see anything in the scope or content of the permit text that raises a problem on this transfer. I think the relevant issues for us are these: • I am confirming again that the facility is paid up through 12/31/2015. So, the transfer should not be complicated by delinquent fees. Please advise your client to submit the Name/Ownership Change form from our website. There is no fee for the transfer. • Please note that a frequent snag in processing the transfer of a permit is the requirement to have signatures of both parties on our form, and the requirement of an executed agreement for the transfer of the ownership of the property: a deed, a sales contract, or some similar documentation of the property transfer. Generally we will not accept the simple Secretary of State registration of a corporation as evidence of the transaction. These are unusual circumstances, so please contact us if this presents difficulties for your client. • Please note that the current version of NCG14 expires on June 30, 2016. If your client wishes to continue discharging under the permit after that then the company will have to apply for renewed coverage when contacted, anticipated to be in the first quarter of 2016. • If the producer is under some contractual deadline or penalty provisions that make the timely transfer of the permit especially important, please make us aware of that at the time of submittal. • 1 am confirming again that the fact that the previous facility was a portable batch plant which has since been demobilized from the location (correct?), and the fact that the proposed operation will also be a portable facility is not relevant to the permit conditions or coverage. The text of our permit does not distinguish between portable and fixed facilities. • 1 have the following cautions for your client on the transfer of the permit coverage. o Please note that these circumstances are somewhat different from our usual transfer of permit coverage. Even though this is a transfer of permit coverage, it appears to us that these circumstances most nearly resemble the circumstances contemplated under the following paragraph of Part V Section A Paragraph 1 Compliance Schedule: "New facilities applying for permit coverage for the first time: All requirements, conditions, limitations, and controls contained in this permit become effective immediately upon_ issuance of the Certificate of Coverage. The stormwater Pollution Prevention Plan shall be developed and implemented prior to the beginning of discharges from the operation of the industrial activit and be updated thereafter on an annual basis. Secondary containment, as specified in Part III, Paragraph 2(b) of this permit shall be accomplished prior to the beginning of discharges from the operation of the industrial activity." o Please note that the General Permit imposes an obligation to conduct sampling on both stormwater discharges (2/yr) and wastewater discharges (4/yr), with numerical standards on both, Failure to sample and report the results is a violation of the permit, regardless of the numerical results. I� w o Because of the somewhat unusual circumstances of this transfer, I am going to request that the Regional Office coordinate a site inspection with the permittee shortly after the permit transfer.
