VAN DER VAART Secrrrary, TRACY DAVIS Director Subject: General Permit No. NCG140000 S&W Ready Mix — Morehead Plant COC No. NCG140438 Carteret County In accordance with your application for an NPDES discharge permit received on August 5, 2014, and follow-up additional information required to complete the application received February 3, 2015, we are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state-NPDES general permit. The general permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007, (or as subsequently amended). Please note that general permit NCG140000 requires compliance with specific numerical effluent limitations for wastewater discharges (see Part IV, Section D). An exceedence of any of the wastewater limitations is a violation ofpermit conditions. Please note that the permit requirements in Part II, Section A, numbers 1-5, and Part II, Section B, number 1 are no longer valid per NC Session Law 2011-394. However, note that Part II, Section A, number 6, and Part Il, Section B, numbers 2-10 are unaffected by the Session Law, and remain valid requirements of general permit NCG140000. Your NPDES permit application letter requested special accommodation and NPDES permit authorization to discharge infrequent overflows from the wastewater recycle system into a grassed swale previously permitted under NC rules at 15A NCAC 02H A 000, the State Stormwater Management rules. (Our Wilmington office previously had issued a low density permit SW8140240 authorizing the construction of the new built upon area of your facility and the identified grassed swales and level spreaders). In support of your NPDES permit request you made three important representations: that the recycle system is designed to overflow only in response to a rainfall greater than the 7-yr return frequency (approximately 7" per 24 hours at this location); and that as a routine operating procedure the end -of -day excess drum contents will be chemically stabilized in the drum so as to allow reuse of the contents for the next day's batch in order to prevent any discharge of the drum contents into the wastewater recycle system; and that aggregate pile wetting will be State of North Carolina I Environmental Quality j Energy, Mineral and Land Resources 1612 Mail Service Center 1 512 North Salisbury Street I Raleigh, NC27699-1612 919 707 9200 T y accomplished by well water. All of these representations are important in our consideration of your request. First, the 7-year return frequency might generally be characterized as establishing that you will have on average an overflow discharge from the wastewater recycle system only once per seven years. Second, we anticipate that the drum contents are the highest strength wastewater on your site. We have seen pH values over pH 12 reported for this flow. Your representation that drum contents will not be discharged into the recycle system should keep this high -strength wastewater out of the recycle system. Third, you further reported that aggregate wetting will be accomplished by well water rather than by recycle water, so that subsequent aggregate pile drainage to Outfall #1 might not contain the high pH constituents potentially present in recycled wastewater, We are relying on these representations in granting permit authorization for the infrequent discharge of recycle system overflow to the grassed swale and Outfall 91 under the NPDES general permit NCG140000. Further, we have modified the usual NCG140000 COC to contain additional permit requirements with the intent offirmly establishing in practice the physical features and operating modes reported to us in your application. Please note that your COC is not transferable except upon the specific action of the Division of Energy, Mineral, and Land Resources (DEMLR). DEMLR may require modification or revocation and reissuance of the COC. This permit coverage issued today does not affect the legal requirements to obtain other permits which may be required by DEMLR, or permits required by the Coastal Area Management Act, or any other federal or local governmental permit that may be required. All discharges from Outfall 41 as identified on the permit application shall be subject to the wastewater provisions of General Permit. 3. The permittee shall record in the Stormwater Pollution Prevention Plan that the design objective and operational procedures of the wastewater recycle system are intended to allow an overflow only in response to rainfall in excess of the 7-year return frequency storm event; that mixing drum washout will not be introduced into the recycle system on a routine basis; and that aggregate wetting will be by well water, not recycled wastewater. 4. If he is not, then I'll process it now that I've thought it through below. After this long on my desk I think we should just issue the COC, but here is the history of the complications with this one: 3/27/2014— WiRO issued a low density permit for the site in Morehead City, Carteret County, SW8140210. Site not subject to SA, but consulting engineer Jimmy Fentress' calcs show a voluntary 12% BUA, rather than the 24% allowed as low density. Two Grassed Swale Supplement sheets included in permit, with swales discharging into wetlands. No problem so for with this application, and WiRO issued the SW8 permit with no unusual conditions. 8/05/2014— SPP received NCG140438 NOI for an NPDES permit. S&W's transmittal letter specifically asked us to accommodate the occasional discharge of treated wastewater into the Swale. Larry subsequently asked for Georgette's review. Larry pointed out that the site plan and application submitted with the NOI showed recycle system overflow occasionally discharging into the swale to Outfall #1. Two of the site outfalls were proposed as stormwater-only outfalls, but this one contained the occasional overflow from the proposed recycle system (not a 2T compliant recycle system, just a way to conserve water usage). Not what Georgette had permitted in March under the SW8 permit: the wastewater discharge was not shown on the SW8 application to Georgette. The idea that wastewater from a substandard recycle system might overflow (once per seven years?) into a grassed swale intended to treat stormwater, but not wastewater, is not attractive. Georgette's experience is that the facilities wind up discharging more frequently than designed. • 9/5/2014 — Larry sent an additional information letter requesting clarifications of, or modifications to, the proposed features and operation for control of wastewater and stormwater discharges. • 12/10/2014— Larry sent a follow-up email requesting a response from the applicant, as none had been received. • 2/2/2015— WiRO inspector Brian Lambe reports that the facility is operating with commingled ww/sw discharge and no NPDES permit. • 2/3/2015 — Applicant submitted add -info request in response to Larry and Ken email contact and conference call in Jan and Feb. • 2/5/2015 — Larry's last day. i have not acted on this application since then. Rationale for moving forward: The applicant's add -info response on 2/3/2015 provides essentially the following responses to our add -info letter of 9/25/2014: 1) We said: SW810210 does not authorize the proposed wastewater discharge. You didn't show that discharge on your application to WiRO. Applicant responded: There is potential in a heavy rain for the process wastewater to discharge from the retention basin, flow 200' across the site, enter the grassed Swale, be spread out by the level spreader and enter the 404 wetlands as diffuse flow. We would monitor that discharge in accordance with the A- NPDES wastewater requirements. KBP interpretation of add -info and response: First issue: the applicant proposes an occasional (rare?) untreated/partially diluted wastewater discharge into a State Stormwater Management Program BMP (grassed Swale) that may be damaged by a potentially high pH, high TSS discharge. Second issue: there are no engineering calculations or logical assurances to indicate that the receiving water (wetlands) is protected from the potentially high pH, high TSS discharge wastewater discharge, either. KBP conclusion: Consider the receiving water impact - we don't typically require prior proof via engineering review that an industrial wastewater treatment system will perform and be protective of the receiving water. That issue is not ours to evaluate per recent state law. Now consider protecting the grassed swale - applicant's retention pond is designed to accommodate the 7-yr storm before overflowing, he says. Consider that an overflow once every 7 years would be in response to approximately 7" of rain. Under those circumstances there will already be a whole bunch of runoff in the grassed swale. Unlikely that damage to the Swale will result if the system is operated in accordance with its design. On these points, let's acceet the add -info response as sufficient and rely on testing Outfall #1 under the NPDES permit provisions (most of the time as a stormwater-only discharge, but once every 7 years as a wastewater discharge, perhaps.) 2) We said: Please tell us the source of the water used for wetting the aggregate pile. If it's city water we may not be so concerned that it's entering the grassed swale untreated, but if it's recycle water we are concerned about potential high pH. The applicant responded: We will be using ground water from on on -site well. Also, the sprinklers will be on timers to prevent over saturation and excess runoff. KBP conclusion: So, the aggregate pile will be deliberately irrigated. We have previously considered this a wastewater discharge. But, a weak wastewater discharge as long as high pH recycle water is not the source. Let's have the permittee monitor discharge from Outfall #1 under the wastewater portions of NCG14 when he is actively irrigating, and under the starmwater portion when it's iust raining. 3) We said: Please show the truck washout area on your site plan: it may be the source of untreated high strength wastewater. And, it may change the BUA of your site from that stated in the SW8 application. The applicant responded: We will use admixture chemicals to stabilize the wet concrete in the drum and will not need to discharge that process water: it will be used in the drum for the next day's mix. if there ever is a need to discharge the water, it will enter the retaining basin adjacent to the truck wash down area. KBP conclusion: So, the highest strength wastewater at this site (drum washout) will not normally be discharged, they say. If drums ever are emptied they will go into the retention basin as part of the recycle system. Which might discharge once every 7 years. Let's accept the add -info response as sufficient. Give up on a revised site plan for the application, but demand it as part of the SPPP. Give up on our interest in whether the BUA increased or not: not our business in NPDES, and very unlikely to change the SW8 permit since the BUA was 12% actually vs the 24% cap for a low density permit. 4) We said: Contrary to your information submitted on our application that you would be using a 2T recycle system, your system is only designed for the 7-yr storm, not the 25-yr storm per 2T rules. On this basis we consider that the system has a discharge, and is not properly characterized as a 2T recycle system. The applicant responded: That's correct, there is a potential for discharge in heavy rainfall events. We will monitor that discharge in accordance with the NPDES permit requirements. KBP conclusions: No interest in having them correct the NOI. Add -info response is sufficient. Moving forward: consider the add -info response as sufficient and issue the COC. One final twist in my suggested approach to permitting S&W Ready Mix in Morehead City: Let's issue the COC with a minor modification authorizing the following flows: • Site stormwater • Aggregate irrigation drainage wastewater • Exterior truck and equipment rinse off wastewater • BUT excluding drum rinse out wastewaters, since the applicant doesn't expect to discharge those. History: a. 3/27/2014 WiRO issues a Low Density permit, SW8140210. No special conditions. Application does not identify a wastewater discharge, and WIRO permit does not authorize ww discharge or treatment measures. The engineer's calcs show a voluntary 12% BLIA, but the receiving water is not SA, and so a Low Density permit cap of 24% would have been allowable. Discharge is into adjacent wetlands. No problems so for. b. 8/5/2014 SPP receives NOI for NCG140438. Applicant's transmittal letter notes that operation of the facility is scheduled for November 1, 2014, and further requests accommodation in the permit of an infrequent recycle treatment system overflow (wastewater) commingled w/the stormwater discharge through Outfall #1. Recycle treatment system volume and operation are designed to overflow only in response to a 7-yr, 24-hr rain, approximately 7" in 24 hours at this location. Outfalls #2 and #3 are stormwater only. c. 8/14/2014 Applicant follows up to confirm receipt of NOI w/ KBP. KBP indicates we have received it, but need to figure out with Wilmington how the two permits (SW8 and NCG14) will have to work together in this circumstance. d. 8/13— 8/27 Larry Wade (SPP) and Georgette Scott (WiRO) exchange emails, concluding from the site plan and NO! that a ww overflow will be discharged via a grassed swale into the wetlands. The previous SW8140210 application did not report the applicant's intent to discharge ww via the grassed swale permitted for sw discharge under SW8140210. KBP currently determined to issue NCG14 coverage based on following rationale wrt the discharge of a wastewater through the State Stormwater Permit SW8140240. 2. The discharge of wastewater commingled with stormwater has been recognized as a potential snag in normal permitting by both the applicant and the SPP since before the NO] was originally submitted in August 2014. Now with information in hand we can approach a permitting rationale via the issues identified in the SPP September 2014 add -info letter. That letter identified, and the applicant's letter responded to, the following points: a. Add -info letter: SW8140210 does not authorize wastewater discharges; your application for that permit did not report a wastewater discharge via the grassed Swale and level spreader for Outfall #1. Applicant's response: There is a potential for a recycle system overflow (7-yr return frequency, or 7"). We will monitor such an event in accordance with the wastewater requirements in NCG14. KBP review: Applicant's failure to fully describe his operation in the SW8 application is not decisive wrt permitting under NCG14; but might be relevant to WIRO as they administer that permit. Further, note that if operated as designed an overflow every seven years intuitively does not seem like a significant environmental insult to the receiving waters, especially considering that the prevailing conditions at the time will be unusually high runoff and receiving water flows due to the 7" of rain. KBP conclusion: Applicant's response is sufficient to allow continued processing of the permit application. Permit action: use an augmented COC to require monitoring of every overflow from the recycle system. This permit condition may operate to remind the ermittee that he should operate the s stem so that an overflow only occurs once per seven years. b. Add -info letter: Please identify the source of aggregate wetting water since resulting drainage will flow untreated into the grassed swale. Applicant's response: We will use well water, sprinklers will be on timers to minimize over-soturation and excess drainage from the aggregate piles. KBP review: Well water and incident rainfall do not present the same high pH risk that recycled drum rinse water would. No special pH risk with this mode of aggregate wetting. KBP conclusion: Applicant's response is sufficient to allow continued processing of the permit application. c. Add -info letter: Please show the truck wash out area on your site plan. Absent a location on your site plan, we are concerned that high -strength drum rinse out flows may be discharged untreated. Was the truck wash area identified as part of the impervious area in your SW8 application? Applicant's response: Our operating procedure will be to use stabilizer chemicals inside the drum to keep the concrete plastic, in order to remove the need to rinse out the drum, so that we can reuse the residual contents in the drum for the next day's batch. Further, if there ever is a need to rinse out a drum, the rinse water will flaw into the adjacent retaining pond as part of the wastewater recycle system. KBP review: KBP judgement that applicant's failures to respond to the questions of whether the truck wash area was shown on the SW8 permit documents, and to provide a revised site plan are insufficient to delay further processing of the NCG14 application. On the more substantive point, applicant's stated operating mode is intended to result in infrequent, if any at all, introduction of the high -strength drum contents into the recycle system. Combined with a 7-yr storm design for the recycle system, the applicant intends to avoid any untreated discharges of the high -strength drum contents. KBP conclusion: Given an augmented COC that adjusts the permit conditions to require monitoring and reporting of every recycle system overflow, the ability of the permittee to control drum rinse discharges into the wetlands can be expected to be very good, if operated as reported. With this addition, proceed with processing the permit application. Permit action: Use an augmented COC to require monitoring and reporting of every recycle system overflow, in addition to the standard quarterly monitoring and reporting. d. Add -info letter: Contrary to your N01 application, your closed loop wastewater recycle system does not appear to conform to the requirements for permitting a recycle system under the 15A NCAC 2T non - discharge rules; most significantly it does not hold the 25-yr, 24-hr storm (-8.5" at this location) without discharging. Consequently, in a regulatory sense any discharge from the recycle system must be permitted as a surface water discharge. Applicant's response: The design will only hold the 7-yrstorm (Note: —7"), not the 25-yr storm. There is a potential for an overflow in large storm events. We will monitor those events according to the NPDES permit. KBP review: It's not important at this point in our permitting process that the N01 was presented with significant inaccuracies as to the regulatory status of the recycle system. And while a 2T design would hold -8.5", consider that if operated as designed the Proposed recycle system has been represented to have a capacity of —7", a substantial fraction of the 2T design, and would be expected to result in very infrequent overflows. Applicant acknowledges that monitoring of overflows should be as per the wastewater portions of the NCG14 General Permit. KBP conclusion: Applicant's N01 and add -info response establish an engineering approach that relies on the proper operation of a large rec cle system capacity 7" rain),together with site procedural constraints against washing out drum contents into the recycle system. These two aspects of engineering design attempt to control TSS and pH discharges into the receiving wetlands and into the grassed swale of Outfall #1. Applicant's response is 'ud ed sufficient to continue processing the permit. Permit action in response to all four add -info letter items: Use an augmented COC requiring wastewater monitoring at Outfall #1 for every instance of a recycle system overflow, plus quarterly. For simplification, Outfall #1 will be designated as a wastewater outfall, rather than sometimes a wastewater outfall, and sometimes a stormwater outfall. There will be a potential for storm water and process water to comingle and discharge from the retention basin, located adjacent to the truck wash down area, during a heavy rain event. Any inadvertent discharge would flow south, approximately 200 feet, into a drainage swale and then sheet flow to the level spreader located at the Southeast corner of the development. This would be considered a process water discharge covered under the NPDES permit and would be monitored as such. 2. Water from a well located on the site will be used to irrigate aggregates at the site. Sprinklers are also on timers to prevent over saturation and run-off from occurring. 3. This water will remain inside the drum and be utilized for batching concrete the next day. However, if there is a need to discharge any rinse water it will be discharged into the retaining basin located at the truck wash down area. 4. You should get it by Tuesday. We think you were absolutely justified in your concern. Specifically, look at the hand written notes identifying the outfall locations. Were they on the plan when you issued SW8140210? It appears to us there will be an untreated wastewater discharge. Also on the NQI the closed loop system he notes, does not meet the 2T requirements, and no permit has been applied for. Thanks for your awareness on this one. The one concern I have is that we approved this as a low density. The swales direct stormwater to the wetlands and this is located near SA waters. How are they proposing to keep the process wastewater out of our swales? These Ready Mix sites are notorious for allowing wastewater to drain into our swales or ponds and overflowing into the wetlands and streams. I would like to know what their pollution prevention plan says for the prevention of this. All sediment storage measures will remain on site and functional until all grading and final landscaping of the project is complete. 3. This project is not subject to SA water requirements, and so its maximum impervious area is 24%. But, it has been voluntarily designed for 12%. 2. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 3. No piping shall be allowed except those minimum amounts necessary to direct runoff beneath an impervious surface such as a road or under driveways to provide access. 4. The project shall provide and maintain a minimum 50-foot wide vegetative buffer adjacent all surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers and the mean high water line of tidal waters. All runoff directed into and through the vegetative buffer must flow through the buffer in a diffuse manner. Roof drains must terminate at the outer edge of the buffer. Stormwater runoff that is directed to flow through any wetlands shall flow into and through these wetlands at a non -erosive velocity. No person shall alter the approved stormwater management system or fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system, except for minimum driveway crossings, unless and until the permittee submits a modification to the permit and receives approval from the Division, 2. The permittee is responsible for verifying that the proposed built -upon area far the entire project does not exceed the maximum allowed by this permit. 3. Swales, vegetated areas and other vegetated conveyances shall be constructed in their entirety, vegetated, and operational for their intended use prior to the construction of any built -upon surface, per the approved plans. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. The permittee shall at all times provide and perform the operation and maintenance necessary as listed in the signed Operation and Maintenance Agreement, such that the permitted stormwater management system functions at its optimum efficiency. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina, driveways, and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. DEMLR file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Permit Expired: The permit expired on July 27, 2014. 2, PE Certification: Per Section 11(7) of your permit, the system has not been certified to have been built in substantial compliance with the permit conditions. It appears that wastewater comingles with stormwater draining to the stormwater treatment system. 3. General: Since the permit is expired and it appears that stormwater and wastewater comingle, we recommend that you request to rescind State Stormwater permit SW8 990831, and contact Jean Conway at 9 0.796.7315 to discuss compliance with NCG140277 in place of the State Stormwater permit. This will likely include increased analytical monitoring for wastewater at the outfall. The Division thinks that coverage under NCG140277 is more aligned with the site conditions because impervious areas drain to the pond. Achieving compliance with NCG140277 will negate the necessity of the State Stormwater permit. Please inform this Office in writing before August 29, 2014) of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies.
