In accordance with your application for a discharge permit received on July 29,
2013, we are forwarding herewith the subject certificate of coverage (COC) to discharge
under the subject state — NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
Please note that groundwater standards in 15A NCAC 02L and 02T regulations
must also be met for closed -loop recycle systems or any discharges to groundwater.
Please take notice that this certificate of coverage is not transferable except upon
approval of the Division of Energy, Mineral, and Land Resources. The Division of
Energy, Mineral, and Land Resources may require modification or revocation and
reissuance of the certificate of coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Energy,
Mineral, and Land Resources or permits required by the Coastal Area Management Act
or any other federal or local governmental permit that may be required.
Please note that permit requirements in Part II, Section A, numbers 1-5, and Part
11, Section B, number 1 are no longer Valid per NC Session Law 2011-394. However,
note that Part lI, Section A, number 6, and Part II, Section B, numbers 2-10 are
unaffected by this Session Law. Those sections will remain in effect for the duration of
this permit term. Please be reminded that your facility must notify the appropriate

We offer no objections for issuing the subject permit to Blue Dot. According to Mr. Kurtz, the pond was designed as
Stromwater/Wastewater pond. However, he is not sure why we are considering wetting of aggregates to be a
wastewater discharge, In a conversation with him, I found out that the aggregates are also exposed to stormwater and
not only City water. I am copying Ken Pickle for his comments. Thank you Ken!

Per our conversation I offer the following:
Plans have been submitted and approved to City of Charlotte and Mecklenburg County for the Subject project.
See the attached Letter of Approval for Grading issued by City of Charlotte. All Phase II requirements have
been met.
The detention basin is being used as a wastewater/stormwater basin. Runoff water from wetting of aggregate
stockpiles is the only water that discharges to the detention basin. No cement laden water will be discharged to
the detention basin.City water will be used to wet aggregate stockpiles. Runoff from wetting of aggregates will
flow to the stormwater detention prior to being discharged from the property. The background soil for this site
is a Cecil soil type.
Cecil soils have a high percentage of fines. 37.6% of a typical Cecil soil passes a 0.063mm (0.0025") sieve.
Sand and coarse aggregates for concrete are limited by ASTM C33 to 5% of the material passing a 200 sieve. A
200 sieve has 200 openings per inch. This equates to a 0.005" opening, which is twice the size of the 0.0025"
sieve. Typical tests on material that will be utilized at this plant have a lower percent passing the 200 sieve than
required by ASTM C33. Sand ranges between 1.8% and 2% passing the 200 sieve. Coarse aggregate is below
1% passing a 200 sieve. The runoff from the aggregate stockpiles will create a lower level of sediment load
than the stormwater traveling across the site.

Proportion aggregates, cement and flyash into truck mixers to produce concrete. Process water from
rinsing trucks and drum washout will captured in a closed loop recycle system. Well water will be
used to wet aggregates for evaporative cooling in the summer. Any runoff from wetting of aggregates
will run approximately 500' across the site to a stormwater detention basin prior to being discharged.

All applications, reports, or information submitted to the Director shall be signed and certified.
a. All notices of intent to be covered under this General Permit shall be signed as follows:
(1) For a corporation: by a responsible corporate officer. For the purpose of this permit, a responsible corporate officer means: (a) a president,
secretary, treasurer or vice president of the corporation in charge of a principal business function, or any other person who performs similar
policy or decision making functions for the corporation, or (b) the manager of one or more manufacturing production or operating facilities

employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if
authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
(2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or
(3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official.
Certification: North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of
a material fact in a rulemaking proceeding or contested case under this Article, or who falsifies, tampers with, or knowingly renders inaccurate
any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental
Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten
thousand dollars ($10,000).
