Please see the attached corrected Certificate of Coverage (COC) for NCG140427, Eagle Rock Concrete's Pristine Water
Drive site in Apex.I will mail a hard copy with the signature to Mr. Adam Loftin today, and I will send another signed
copy down to DWQ's Central Files. Because it is a correction, I have kept the original effective date.
The COC now includes only stormwater discharge and does not cover any wastewater discharges from this site. This
condition reflects the information presented in Eagle Concrete, LLC's N01 application. Groundwater standards in 15A
NCAC 02L and 02T regulations must also be met for recycle systems or any discharges to groundwater.

Hi Dale,
I'd included the process wastewater discharge on the COC because you all decided not to pursue the closed -loop recycle
system permit through APS. However, we can make the correction and include only stormwater on the NPDES permit.
This will mean that any process wastewaters that discharge, even if rarely, would be unauthorized. We recognize that's
an unlikely scenario because the system was designed to contain all wastewaters and the 25-year, 24-hour event. I will
be glad to correct the COC so it is consistent with the original application and with the other plant's COC.
I will do my best to send that correction in the next couple of days. I am working on our transition to a new Division and
electronic renewals for NCG21 the rest'of the week and will be on vacation all next week. If you don't hear from me
before then, I'll get to this as soon as I return.

To follow up my voicemail, please see the attached NCG14 permit issued for the Mt. Herman Road site. Both sites have
been designed in the same manner— separating stormwater from wastewater and storing/capturing all of the
wastewater from a 24 hr-25 yr storm event (per 15A NCAC 02L and 02T regulations) without discharging. So there is no
wastewater discharge to test, only stormwater discharge.
Please let us know what we need to do to reconcile the permits so they are in agreement.

In accordance with your application for a discharge permit received on April 26,
2013, we are forwarding herewith the subject certificate of coverage (COC) to discharge
under the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
Please note that NCG140000 contains effluent limitations for process wastewater
discharges (see Part IV, Section D), in addition to stormwater discharge requirements.
Wastewater discharges must comply with these effluent limitations. Your application
indicated that a closed -loop recycle system will be used to recycle all process wastewaters
at this site. Any discharges as a result of overflows are subject to the terms of this NPDES
discharge permit. Also, recycle systems and any discharges to groundwater must meet the
groundwater standards in 15A NCAC 02L and 02T regulations.

This certificate of coverage is not transferable except after notice to the Division of
Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.'. This permit does not affect the.legal requirements
to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, Coastal Area Management Act or any other
federal or local governmental permit that may be required.
Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage
to stream buffers, from portions of.this site that have been constructed after July 22, 1997,
must be discharged through a correctly designed level spreader or another device that
meets diffuse flow requirements per 15A NCAC 213.0233. Diffuse flow requirements are
described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

Please note that permit requirements in Part 1I, Section A, numbers 1-5, and Part II,
Section B, number 1 are no longer valid per NC Session Law 2011-394. However, note that
Part 11, Section A, number 6, and Part II, Section B, numbers 2-10 are unaffected by this
Session Law. Those sections will remain in effect for the duration of this permit term. Your
facility must notify the appropriate DWQ Regional Office at least 72 hours in advance of
operation of your wastewater treatment facility.

The Raleigh Regional Office has given approval for us to proceed on this application for coverage under the NCG
permit. I am just requesting that you submit a revised copy of Sheet 4 of the plans (two copies) with the notation about
seeking a non -discharge recycle permit removed.
Instead of a separate permit from APS, DWQ will authorize any overflow that discharges from the recycle system in rare
instances under the COC for NCG14. The fact that the design incorporates the 25-year, 24 hour storm event and
freeboard of a non -discharging system sufficiently addresses the alternatives analysis of non -discharge options for the
wastewater that will be produced here. This is an important element of our review because this permit includes
wastewater discharges under the NPDES program.
If you have any questions, let me know. If we can get that revised plan sheet from you in the next week, I'll plan to issue
this COC next week.

Hi Dale,
I am reviewing the NO1 application from Eagle Rock Concrete, LLC for the Pristine Water Drive site in Apex for coverage
under the NCG140000 Stormwater/Wastewater General Permit. I apologize for our delay in the review —we have been
down several staff positions for a while and were also very busy with our first round of electronic general permit
renewals in May and June.
I have contacted the Raleigh Regional Office for their concurrence with issuing a certificate of coverage for this site.
They may or may not conduct a site visit prior to giving their approval. I'll keep you updated on when I hear back from
their office.
Thank you for all the helpful detail on the plans. I thought they were well prepared. As I reviewed the NOI and plans, I
noticed that the company plans to build a closed -loop recycle system that will meet the 15A NCAC 2T .1000 rule criteria.
Sheet 4 of the plans also says "A Non -Discharge recycle permit will be sought from the NCDENR-DWQ." However, our
Aquifer Protection Section staff say they have not seen an application for a recycle system permit from this company
yet. Is the company still planning to pursue that?
Right now we would issue the COC for stormwater discharge only according to the application, but I want to be clear on
what the plan is.

begin in June 2013, but I'm behind on these. I'm not sure of the status of the site. They have proposed a non -discharge
recycle system for all the process wastewater, including aggregate spray down. The NOI, and plans indicate they would
pursue a non -discharge permit, but Jon Risgaard in APS says they haven't seen anything from these guys. I will follow up
with the consultant about it today or tomorrow.
The plans were prepared by Withers & Ravenel (Dale Werenko, P.E.), and they're pretty decent. I'm attaching the N01,
and I'll forward a copy of the plan sheets to the RRO (to Dave Parnell's attention, if that's okay). Please let us know if
the Raleigh Regional Office have any concerns with issuing a COC for this site.
Normally we'll plan to issue the COC if we don't hear from you in 30 days, but we wait on NCG14 and NCG02 permits
until we have confirmation from the regional office. Thanks for your help with this one.

Guys,
An update on this one. After the consultants at Withers & Ravenel looked into the permitting process for the recycle
system, some very typical things happened:
1) When investigating the application and process for an APS Recycle System Permit, they discovered there were
hardly any other concrete recycle systems permitted in the state and weren't sure how to start that process, or
why that might be. And then...
2) They read the 2T rules and thought their design met the deemed permitted requirements. The rules are not
very clear to explain "water used to removed concrete from equipment" is only drum washout water and does
not include washing the exterior of the vehicle (which vehicle washing exemption does, but that has to be
closed to precipitation inputs), and this trips a lot of people up in their interpretation. The aggregate pile spray
is also included (although, in this particular case it is settled drum washout water that drains back to the
system), and often people don't realize stockpile spray can't be an input either. [Basically, there are many
ready -mix plant "recycle systems" that really don't meet the permitted by rule option because they're capturing
several types of wastewaters in the recycle system].
3) We all agreed that while it is fantastic that they have designed a system to recycle water and hold the 25-year,
24-hour storm to prevent discharges from occurring (particularly from an engineering alternatives analysis
standpoint), it is just simpler to include authorization to discharge under the NPDES permit NCG14 in the very
rare event that it would ever overflow. I'm pretty sure this is APS's preference in most cases os well, but we
struggled with the authority to permit recycle systems under NCG14, and with our pending move to DEMLR in
August, �'m.even fuzzier on what: thisjrneons for0e NCG14 permit
So, we will just permit everything under the NCG14 permit. I'll have them resubmit revised plans so the notation that
they are pursuing a non -discharge permit is removed. Otherwise, 1 think everything looks okay, so I just need RRO's go
ahead whenever you all are ready.

SECTION .1000 — CLOSED —LOOP RECYCLE SYSTEMS
15A NCAC 02T .1001 SCOPE
This Section applies to closed --loop recycle systems in which nondomestic wastewater is repeatedly recycled back
through the process in which the waste was generated. The following systems are not regulated by this Section:
(1) the reuse or return of wastewater from a permitted animal waste lagoon facility for waste flushing
cover by Section .1300 of this Subchapter;
(2) the recycling of wastewater from groundwater remediation systems through an Injection Well or
Infiltration Gallery specifically covered by Section .1600 of this Subchapter; and
(3) the reuse of wastewater through treatment and distribution as reclaimed water specifically covered by
Section .0900 of this Subchapter.

15A NCAC 02T.1003 PERMITTING BY REGULATION
(a) The following systems are deemed permitted pursuant to Rule .0113 of this Subchapter provided the system meets
the criteria in Rule .01 13 of this Subchapter and all criteria required for the specific system in this Rule:
(1) Return of wastewater contained and under roofwithin an industrial or commercial process where there
is no anticipated release of wastewater provided the facility develops and maintains a spill control plan
in the event of a release and no earthen basins are used.
(2) Recycling of rinse water at concrete mixing facilities for concrete mix removal from equipment
provided the wastewater is contained within concrete structures, there is sufficient storage capacity to
contain the runoff from a 24-hour, 25-year storm event plus one foot freeboard and the facility
develops and maintains a spill control plan in the event of a wastewater release. The facility must
notify the appropriate Division regional office in writing noting the owner, location, and that the
design complies with the above criteria.
(3) Recycling of wash and rinse water at vehicle wash facilities provided the wastewater is contained
within concrete, steel or synthetic structures (i.e. not including earthen basins), all vehicle washing is
conducted under roofand there are no precipitation inputs (direct or indirect), and the facility develops
and maintains a spill control plan in the event of a wastewater release.
(4) The reuse or return of wastewater within the treatment works of a permitted wastewater treatment
system.
(b) The Director may determine that a system should not be deemed permitted in accordance with this Rule and Rule
.0113 of this Subchapter. This determination shall be made in accordance with Rule .01 13(e) of this Subchapter.

15A NCAC 02T.1004 APPLICATION SURMITTAL
(a) A general description including how the wastewater is generated, how the wastewater will be recycled, and
contingencies in case of system failure shall be provided to the Division.
(b) Engineering design documents. If required by G.S. 89C, a professional engineer shall prepare these documents. The
following documents shall be provided to the Division by the applicant:

The Soil Erosion and Sedimentation Control Plan (S&E) you submitted has been
reviewed and accepted. The Town of Apex (Town) hereby issues this Letter of Plan
Approval. The Town's S&E program is performance oriented, requiring protection of the
natural resources and adjoining properties. If at any time during this project it is
determined by Town staff that the approved S&E Plan is inadequate to meet the Town's
S&E ordinance, this office may require revisions to the S&E Plan and its implementation
to ensure compliance with the S&E ordinance (Section 5-154).
In accordance with Section 5-158 of the Town's S&E ordinance, you are hereby notified
that this office has the right to periodically inspect any land -disturbing activities to ensure
compliance with the approved S&E Plan and ordinance. You are to notify this office
twenty-four (24) hours before starting work. You are also required to keep the working
drawings on site.
Stormwater runoff generated from sites disturbing more than one (1) acre is permitted
pursuant to the National Pollution Discharge Elimination System (NPDES) administered in

responsible for complying with the General Permit requirements and are subject to
enforcement actions by DWQ for any viloations of the General Permit.

The Contractor will be permitted to clear only as necessary to install the required
S&E measures, Once the required S&E measures are installed, contact Public
Works staff to schedule an on -site inspection. A Certificate of Compliance will be
issued after a site inspection is completed to ensure that the S&E measures are
installed per the approved S&E Plan. Please note that a Certificate of Compliance is
required prior to receiving a grading permit From the Building Inspections Division.
The approval of an S&E Plan is conditioned on the applicant's compliance with Federal
and State water quality laws, regulation, and rules. In addition, the Town's NPDES Phase
II permit requires site contractors to control construction site wastes that may cause
adverse water quality impacts. please have your site contractor review the attached Town
Construction Site Waste Management Plan to become familiar with the requirements.
Town staff will inspect your site to ensure these water management practices are being
implemented. You will need to provide evidence of compliance, if applicable.

FROM THE NON -INDUSTRIAL AREAS. SURFACE STORMWATER/WASTEWATER IS COLLECTED VIA CONCRETE SURFACE FLUMES
AND DISCHARGES INTO A SERIES OF CONCRETE CHAMBERS DESIGNED TO SETTLE SEDIMENT AND PROVIDE STORAGE AS
REQUIRED TO MEET NCDWQ REQUIREMENTS. RECYCLE/PROCESS WATER FROM THE LAST CHAMBER WILL BE PUMPED
OUT AND RE -USED TO IRRIGATE AND HYDRATE AGGREGATE STORAGE AREAS AND RE -USED IN PROCESSED BATCH

AND DISCHARGES INTO A SERIES OF CONCRETE CHAMBERS DESIGNED TO SETTLE SEDIMENT AND PROVIDE STORAGE AS
REQUIRED TO MEET NCDWQ REQUIREMENTS. RECYCLE/PROCESS WATER FROM THE LAST CHAMBER WILL BE PUMPED

General Notes:
I. Foundations:
1. Foundation design is based on an allowable soil bearing pressure of 2000 PSF as stated in a subsurface exploration
report prepared by TM Engineering, Inc. dated August 14, 2012.
II. Structural Concrete:
1. Concrete shall have a minimum 28-day compressive strength of 3000 psi, unless noted otherwise.
2. Concrete shall be normal -weight, air entrained, and shall have a maximum unit weight of 145 pcf, unless noted
otherwise.
3. Reinforcing steel shall conform to ASTM A615, Gr60, including ties and stirrups.
4. Minimum concrete cover shall be as follows, unless noted otherwise:
a) Unformed surfaces in contact with the ground..............................................................................•-...-•__................. 3"
b) Formed surfaces exposed to earth or weather ............................ - 2"

5. Plumbing, mechanical, and electrical (PME) drawings shall be referred to for drains, sleeves, outlet boxes, conduit,
anchors, etc. The various trades arp responsible for placing their respective items.
III. Miscellaneous:
1. Structural drawings are intended to be used with architectural and PME drawings. Contractor is responsible for
coordinating such requirements into their shop drawings and work.
2. No opening shall be made in any structural member without written approval of the Structural -Engineer -of -Record.
3. No change in size or dimension of structural members shall be made without written approval of the
Structural -Engineer -of -Record.
4. Openings V-4" and less on a side are generally not shown on the structural drawings. Refer to architectural and PME
drawings for such openings.
5. The contractor is responsible for limiting the amount of construction loads applied to the structural framing. Construction
loads shall not exceed the design capacity of the framing at the time the loads are applied.
6. Fire proofing methods and materials for structural members are not shown on structural drawings, unless noted
otherwise. Refer to architectural drawings for fire proofing methods and materials.
7. Do not scale these drawings; use dimensions.
