This letter is in reference to your ATC application received on July 12, 2011, for the
construction and operation of the subject wastewater treatment facilities. The Division of
Water Quality is returning your application in accordance with recent changes in
legislation. Session Law 2011-394, which became effective July 1, 2011, no longer
requires a permit to "enter into a contract for the construction, installation, or alteration
of any treatment works or disposal system or to construct, install, or alter any treatment
works or disposal system within the State when the system's or work's principle function
is to conduct, treat, equalize, neutralize, stabilize, recycle, or dispose of industrial waste
or sewage from an industrial facility and the discharge of the industrial waste or sewage
is authorized under a permit issued for the discharge of the industrial waste or sewage
into the waters of the State. Notwithstanding the .above, the permit issued for the
discharge may be modified if required by federal regulation."
Based upon our review of your application, the subject project does not require an
Authorization to Construct.
Please note that based on a cursory review, the proposed system design does not
appear to capture the 25-yr, 24-hr storm without discharging; and then recycled.
Please be advised that these legislative changes do not relieve you of any other condition
or requirement of your NPDES permit and that the construction and/or operation of
wastewater collection, treatment, and/or disposal facilities without a valid permit is a
violation of North Carolina General Statute §143-215.1 and may subject the
owner/operator to appropriate enforcement actions in accordance with North Carolina
General Statute §143-215.6A-6C. Civil penalties of up to $25,000 per day per violation
may be assessed for failure to secure a permit required by North Carolina General
Statute §143-215.1.

Additional information for Authorization to Construct a wastewater treatment system
was received by the Stormwater Permitting Unit.via email on August 9, 2011.
However, a review of that additional information showed that the application is still
incomplete. Before the ATC can finish being processed, please provide information
regarding the following:
1. You stated in your letter dated August 9, 2011, that "We will construct basin no. 6
to retain the additional storm waters between the 25 year and the 10 year storm
events." However, the calculations provided in the original ATC request only show
that the 10-yr storm will be captured (plus 1' of freeboard). Please provide
calculations to substantiate your above statement. Note that if you do capture.
and recycle the 25-yr storm (plus 1' of freeboard), then analytical monitoring is no
longer required. A water balance must be provided to show that it can be reused
within approximately 5 days.
2. If the 25-yr storm (plus 1' of freeboard) is not captured and recycled, then you
must provide settling calculations to show that the discharge will be able to meet
permit limits. The data from a single event, a narrative, and a promise to do after
construction testing to get empirical data is not acceptable to proving that these
limits will be met prior to construction.

SETTLING COMPUTATIONS FURNISHED, USING THE STOKES LAW
FORMULA, WOULD BE DISTORTED.
IN A STORM EVENT THE CONCRETE PLANT WOULD BE SHUT DOWN.
THERE WOULD BE NO WASTE WATER CREATED BY THE PLANT
OPERATION FOR THE STORM DURATION. THE WASTE WATER CREATED
WOULD COME FROM THE STOCK PILES AND THE PLANT WASH DOWN
SOURCES ONLY. DURING THE STORM DURATION THE POLLUTANTS
FROM THESE TWO SOURCES WOULD BECOME LESS AND LESS
CONCENTRATED. THE STORM WATERS WOULD BE CLEANING THESE
TWO SOURCES AS THE STORM WOULD PROGRESS.
WE THINK BY TESTING THE BASINS, AS THEY ARE CONSTRUCTED, AND
DURING LESSER RAINFALL EVENTS, WE CAN ESTABLISH AN EMPIRICLE
"SETTLING TIME" THAT IS MORE REALISTIC.
WE WILL CONSTRUCT BASIN NO. 6 TO RETAIN THE ADDITIONAL STORM
WATERS BETWEEN THE 25 YEAR AND THE 10 YEAR STORM EVENTS.

Your facility's application for Authorization to Construct a wastewater treatment system was
received by the Stormwater Permitting Unit on July 12, 2011. However, a review of the
application package showed that the application is incomplete. Betbre the ATC can finish being
processed, please provide information regarding the following:
Please provide settling calculations to show that the discharge will be ab?e to meet permit
limits. The data from a single event and narrative is not acceptable to proving that these limits
will be met. The narrative states that wastewater will be sampled before it is released, but the
system is only sized for the 10-yr, 24-hr rain event. So, rain events in excess of the 10-yr, 24-
hr event will be able to discharge, and not allow for sampling prior to release. Another
alternative to providing settling calculations is to size the system to hold the 25-hr, 24-hr rain
event plus 1 foot of freeboard.

treatment facilities. ATC requests must be submitted at least 90 days prior to construction'.

When applying for this permit, you are also applying for an authorization to construct (new
treatment facilities) or authorization to continue to operate (existing treatment facilities) as
part of the NOL For new sites, you must submit three -(3) sets of design plans and
specifications with this application and provide supporting calculations that predict
compliance of final discharge with permit limits. For existing sites, applicants should submit
three (3) sets of plans and specs for facilities as -built and provide as many design details as
possible, or submit a detailed diagram of treatment systems in place that includes information
such as tank volumes, dimensions, retention time, piping, settling basin details, etc.
Please note: If new treatment systems are planned for an existing site, an ATC will be required
prior to construction of those facilities. Plans/specs/calculations prepared by a P.E. and the
request for an ATC may be submitted with this NOI, or separately at a later date. DWO may
request the status of your plans for requesting an ATC upon issuance of the COC.

North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly
renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the
[Environmental Management) Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine
not to exceed ten thousand dollars ($10,000).
I hereby request coverage under the referenced General Permit. I understand that coverage under this permit
will constitute the permit requirements for the discharge(s) and is enforceable in the same manner as an
individual permit.

pH CONTROL SYSTEMS

pH Control Systems include:
• The Fortrans exclusive in -line carbon dioxide diffusion
and injection system (patent pending) adjusts the
pH of process water and/or storm water automatically,
on an as -needed basis. This carbon dioxide pH
adjustment system is driven by a programmable logic
controller that achieves, and then automatically
maintains a target range (usually pH 7.5 to pH 8.0),
for water stored in your detention basin. Target pH
range is adjustable. Includes pH measurement cell,
and fully automated operation. Highly reliable, and
exceptionally ecbriomical to operate.
• High efficiency stainless steel submersible pump
with stainless steel impeller, thermally protected
continuous -duty motor, and float assembly to protect
against run -dry condition. The standard system
pump yields approximately 70,000 gallons per day
from a typical 12 to 15 foot deep detention basin,
and has capacity to pump from basins or pits 20 feet
and more in depth.
• High quality pump boom, 2 feet high, with 30" boom
reach, including a manual winch.
• 1.5-inch pump connection and 1.5-inch discharge
hoses (25 feet each) with cam lock quick connect
fittings for quick and easy set-up.
• Electronic flow rate meter to indicate
that the system is operating within a normal flow

OIB READY MIX CONCRETE, LLC, IS A PERMANENT INDUSTRIAL FACILITY
THAT PRODUCES A WET MIX OF CEMENT, SAND, GRAVEL, FLY ASH AND
SOME ADMIXTURES THAT ENHANCE THE WET MIX. THE PLANT
ACTIVITIES ARE CLASSIFIED AS STANDARD INDUSTRIAL
CLASSIFICATION (SIC) CODE 3273, READY MIXED CONCRETE (RMC).
IT IS THE INTENT OF OIB READY MIX CONCRETE, LLC, TO INSTALL AND
OPERATE A PROCESS WASTEWATER RECYCLE SYSTEM FOR WASHING
OF CONCRETE DELIVERY TRUCKS. THE RECYCLE SYSTEM WILL
CONSIST OF THREE HOLDING BASINS, A RECYCLE BASIN, A WASH
DOWN BASIN AND A DETENTION BASIN. DURING NORMAL OPERATIONS,
THE RECYCLE SYSTEM WILL OPERATE AS A CLOSED SYSTEM WITH NO
DISCHARGE. DURING RAIN EVENTS THE HOLDING BASINS WILL OVER
FLOW INTO THE DETENSION BASIN WHERE SUSPENDED PARTICLES
WILL SETTLE AND THE PH FACTOR MONITORED AND ADJUSTED WITH A
FORTANS SYSTEM TO ALLOW THE DISCHARGE WASTEWATER TO
COMPLY WITH THE MANDATORY REQUIREMENTS OF 30 MGIL FOR
TOTAL SUSPENDED SOLIDS (TSS), 5 MGIL FOR SETTLEABLE SOLIDS
(SS), AND 6-9 SU FOR PH.
THE OIB READY MIX CONCRETE, LLC, OPERATIONS IS LOCATED ON A
3.99 ACRE TRACT OF PROPERTY IN BRUNSWICK COUNTY, NORTH
CAROLINA. THE SITE IS THE LOCATION WHERE A PREVIOUS READY MIX
CONCRETE COMPANY OPERATED FOR A CONSIDERABLE NUMBER OF
YEARS. THE GEOGRAPHICAL LOCATION IS LATITUDE 33 DEGREES 54
MINUTES 20 SECONDS N AND LONGITUDE 78 DEGREES, 27 MINUTES, 39
SECONDS W.
ENCLOSED, HEREWITH, IS DRAWING SHEET W-1 WHICH IS A SURVEY OF
THE PROPERTY WHERE THE READY MIX PLANT IS LOCATED. ALSO
ENCLOSED, HEREWITH, IS DRAWING SHEET W-2 WHICH IS A SITE PLAN
FOR THE PROPERTY THAT INCLUDES A TOPO.
THE PROPERTY IS RELATIVELY FLAT. RAINFALL SHEETDRAINS ACROSS
THE PROPERTY TO THE NORTHERN PROPERTY LINE. THERE ARE OPEN
DRAINAGE DITCHES THAT PARALLEL THE SOUTHERN AND WESTERN
PROPERTY LINES. THERE IS ALSO AN OPEN DRAINAGE DITCH THAT
PARALLELS THE EASTERN PROPERTY LINE. THESE DITCHES FLOW
WATER OFF THE NORTHERN PROPERTY. THERE IS SOME FLOW OF
WATER IN THESE DITCHES MOST OF THE TIME ALTHOUGH THE FLOW IS
RELATIVE LOW.
ALL WATERS DRAIN NORTHWARD TO ITS RECEIVING STREAM, UT TO
JINNYS BRANCH WHICH IS ABOUT Y2 MILE FROM THE PLANT SITE. THE
STREAM IS CLASSIFIED C: SwAND IS IN SUB -BASIN 03-07-59 (LUMBER
RIVER BASIN).
THE ABOVE REFERENCED READY MIX CONCRETE PLANT IS A LOW
PRODUCTION CONCRETE PLANT. IT PRODUCES APPROXIMATELY 15,000
CUBIC YARDS OF CONCRETE MIX PER YEAR. FOR A FIVE DAY WORK
WEEK AND 50 WEEKS PER YEAR THIS IS APPROXIMATELY 60 C.Y. OF
CONCRETE MIX PER DAY. USING 10 C.Y. MIXER TRUCKS TO DELIVER
THE PRODUCT TO JOB SITES, APPROXIMATELY 10 MIXER TRUCK LOADS
PER DAY ARE BATCHED.
MIXER TRUCK OIL CHANGES AND REPAIRS ARE "OUT SOURCED" TO
PRIVATE BUSINESSES. MIXER TRUCKS ARE FUELED "ON SITE" DAILY.
MIXER TRUCKS REQUIRE THEIR MIXER DRUMS TO BE WASHED A
MINIMUM OF ONCE PER DAY. AN ADDITIONAL WASH OF APPROXIMATELY
ONE PER DAY IS REQUIRED DUE TO THE OCCASIONAL RETURNED OF
UNUSED MIX MATERIAL FROM THE JOB SITE, APPROXIMATELY 250
GALLONS OF WATER IS REQUIRED FOR EACH WASH DOWN. THIS
GENERATES APPROXIMATELY (250 GALLIONS PER WASH)(TWICE PER
DAY)(10 TRUCK LOADS) 5,000 GALLONS OF WASTE WASH WATER EACH
DAY.
THE CONCRETE MIX MATERIALS CONSIST OF SAND, CRUSHED STONE,
CEMENT, FLY ASH, LIQUID ADMIXTURES AND WATER. THE SAND AND
STONE ARE MATERIALS THAT HAVE BEEN PRE -WASHED BEFORE
DELIVER TO THE PLANT SITE. -
THE CEMENT AND FLY ASH ARE STORED IN METAL SILOS. THE
ADMIXTURES AND WATER ARE STORED IN CLOSED METAL OR PLASTIC
CONTAINERS. THE SAND AND CRUSHED STONE ARE STORED IN THREE
SIDED OPEN STORAGE BINS. ALSO STORED ON SITE, IN OTHER OPEN
STORAGE BINS, ARE RIP RAP, CRUSHER RUN MATERIAL AND RECYCLED
WASTE CONCRETE PRODUCT.
THE RIP RAP, CRUSHER RUN MATERIAL AND THE RECYCLED WASTE
CONCRETE PRODUCT ARE NOT A COMPONENT OF THE READY MIXED
CONCRETE MATERIAL. THEY ARE MATERIALS SOLD TO ENHANCE THE
SERVICES OF THE READY MIX CONCRETE OPERATIONS,
THERE ARE NO HAZARDOUS WASTE MATERIALS USED NOR STORED
ON THIS SITE.

OPERATIONS NARRATIVE
DURING NORMAL PLANT OPERATIONS WASTE WATER WILL BE CREATED
WHEN THE STOCK PILES ARE SPRAYED TO CONTROL DUST AND MOISTURE
CONTENT OF THE SAND AND STONE. THIS IS WASTE WATER AREA #1 AS
SHOWN ON SHEET W-4.
THE AMOUNT OF WASTE WATER CREATED FROM THIS OPERATION WILL BE
LESS THAN 1,000 GALLONS PER DAY. THIS WASTE WATER WILL BE
COLLECTED IN THE Y2 ROUND DRAINAGE PIPE AND EMPTIED INTO HOLDING
BASIN #1.
WASTE WATER CREATED FROM THE DAILY PLANT OPERATIONS AND
SHOWN ON SHEET W-4 AS WASTE WATER AREA #2 WILL APPROXIMATE
1,500 GALLONS.
THE WASTE WATER CREATED FROM THE TRUCK WASH AREA WILL BE
APPROXIMATELY 5,000 GALLONS PER DAY. THIS WATER IS DEPOSITED
DIRECTLY INTO WASH DOWN BASIN # 4.
APPROXIMATELY 2,500 GALLONS OF WASTE WATER WILL BE CREATED
DAILY IN EXCESS OF THE WASTE WATER THAT IS RECYCLED. ONE HOLDING
BASIN HAS THE CAPACITY TO STORE THIS WASTE WATER OVER TWO
WEEKS BEFORE IT WOULD FLOW INTO THE RETENTION BASIN.
DURING THE 10 YEAR, 24 HOUR STORM, FOR THIS PLANT'S LOCATION, THE
AREA WILL RECEIVE APPROXIMATELY 6.94 INCHES OF RAIN. WHEN THIS
EVENT OCCURS, THE NORMAL PLANT OPERATIONS WOULD BE SHUT DOWN
BECAUSE THERE WOULD BE NO DEMAND FOR CONCRETE DURING A
STORM EVENT. HOWEVER, THIS RAIN EVENT, WITHOUT ANY
INTERPOLATION, WILL CREATE 103,985 GALLONS OF WASTE WATER FROM
THE STOCK PILES, PLANT AND HOLDING BASINS WHERE WASTE WATER IS
STORED.
HOLDING BASIN #2 AND THE RETENTION BASIN #6 HAS A CAPACITY OF
112,500 GALLONS WITH A 12 INCH FREE BOARD. THE CAPACITY OF THESE
TWO BASINS CAN HOLD THE 103,985 GALLONS OF WASTE WATER CREATED
BY THE ABOVE REFERENCED 10 YEAR STORM.
THE PH FACTOR OF THE WASTE WATER CAN BE MONITORED AND_
ADJUSTED BY THE FORTANS PH CONTROL AND MONITORING SYSTEM
BEFORE ANY RELEASE OF THE STORM WATERS IS ALLOWED.
THE SETTLEABLE SOLIDS (SS) AND THE TOTAL SUSPENDED SOLIDS (TSS)
WILL BE TESTED FOR THE ALLOWABLE LIMITS BY "MERITECH" LAB BEFORE
ANY RELEASE OF THE STORM WATER IS ALLOWED.
FROM THE PREVIOUS TESTING PERFORMED BY MERITECH, INC - II, THE
DETENTION TIME NEEDED FOR THE "SS" AND "TSS' TO COMPLY WITH THE
ALLOWABLE LIMITS SHOULD BE LESS THAT 48 HOURS.
BY SIZING BASINS, THAT WILL CONTAIN THE PRESCRIBED WASTE WATERS,
ACCURATE DETENTION TIMES CAN BE ESTABLISHED AND VERIFIED BY
ACTUAL TEST RESULTS BEFORE ANY STORM WATERS ARE RELEASED.
ALL BASINS, DRAINAGE PIPE, SILT FENCE AND ROCK DAMS 1 DITCHES WILL
BE INSPECTED WEEKLY AND MAINTAINED AS NECESSARY.
AT A MINIMUM, ALL BASINS WILL HAVE THE SETTLED FINES REMOVED
WHEN THEY ARE 20% FULL. THE TRUCK WASH BASIN WILL REQUIRE THE
RECLAIMABLE MATERIALS TO BE REMOVED TWICE YEARLY OR AS
REQUIRED.
ALL BASINS WILL BE PIPED AND VALVED TO FACILITATE_ CLEANING WHEN
REQUIRED.
THE REQUIRED DATA WILL BE MONITORED AND THE REQUIRED REPORTS
AND LOGS MAINTAINED FOLLOWING ANY STORM EVENT THAT RECORDS A
Y2 INCH RAINFALL.
AN ON SITE RAIN GAGE WILL BE MONITORED AND A LOG BOOK FOR RAIN
EVENTS WILL BE RECORDED DAILY.

Authorization to Construct a wastewater treatment system (associated with permit NCG140403).
After review of the submitted material, we must return your application as it is deficient in
significant supporting information. Please ask your engineer to contact me for an explanation of
minimum submittal requirements.
The submittal is deficient in the following particulars (although this is not necessarily an
exhaustive list as a complete review of your application was not able to be performed):
1. Inadequate Design Basis and Site Plans: You have applied for an Authorization to Construct
treatment or recycle facilities. North Carolina rules require DWQ to conduct an engineering
review of your application.
In reviewing any permit we evaluate engineering calculations to predict compliance with
permit limits. The following issues were present:
a. You have not included sufficient design calculations or technical narrative in your
submittal. Your engineer must provide sufficient calculations and technical narrative
details to show how your site wastewater treatment system will adequately treat
wastewater from your site to acceptable Ievels, in order to meet permit limits. Please
include these on separate sheets from the site plans. Necessary details are (but are not
limited to): method of determination of storm and storm sizing, rainfall design storm,
treatment cell sizing, reason for choosing design storm size, dimensions for calculation
of treatment cells, description of runoff coefficients assumptions, and if discharging,
the settling calculations (including assumptions, methodology, equations and
variables). If the permittee is not planning to discharge, include a clear narrative and

equations to demonstrate how holding cells and recycling shall take place to
sufficiently contain and control all discharge.
b. No grading, topographical elevations or lines (or their relationship of the elevation of
the treatment cells to the surrounding area) outlines of stormwater and wastewater
drainage areas, location of stormwater drainage areas and outfalls, runoff conveyance
structures were shown on site plans. In order to verify calculations showing the
amount of water flowing to your wastewater treatment facility, stormwater outfalls
and off -site, these items must be added to your site plan. Please include them in all
future submittals.
c. No detailed diagrams of treatment systems were included. To verify treatment system
size and design, a detailed diagram must be included in future submittals. In these
details, the engineer must include show flow path, freeboard, side view and all other
adequate and complete details to show the construction and design of the treatment
system (this is not an exhaustive list). Please specify the material (e.g., cement, liner,
compacted earthen basin, or other?) for the construction of wastewater treatment cells
and include additional storage depths for settled solids that would accumulate in cells.
Describe these details in the narrative to be included in the next submittal.
d. Stormwater and wastewater outfalls are not shown on site plans and are not
numbered. Please include in your next submittal.
e. Adequate stormwater topographical features are not properly shown, nor how those
features affect drainage. There are no topographical features shown delineating sub -
drainage areas (for instance sub -drainage areas 2 and 3), such as break-points at
physical areas on the site.
2. Incomplete Submittal:
a. The legal name of your site appears to be "OIB Ready Mixed Concrete, LLC". Please
include your exact company name on submittals as it is registered in North Carolina.
DWQ must have this name as it appears in the company registration to the North
Carolina Department of the Secretary of the State.
b. You must include documentation of your submittal for an Erosion and Sedimentation
Control Plan application to the NC Division of Land Resources.
Because of the above deficiencies, DWQ must return your application submitted as such. An
exhaustive list was not able to be produced, however, please review the above deficiencies and
have your engineer review contact me regarding submittal requirements.

2010, we are forwarding herewith the subject certificate of coverage (COC) to discharge under
the subject state NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated October 15, 2007.(or as
subsequently amended).
The Division acknowledges that temporary wastewater measures have been installed at
this existing facility until a properly designed wastewater treatment facility can be designed,
approved, and installed. The proposed future construction, installation, or modification of
wastewater treatment facilities (including process wastewater recycle systems) will require ad
Authorization to Construct (ATC) prior to construction per 15A NCAC 2H .0138 & .0139. The
design information must demonstrate that the proposed treatment system will be able to meet
permit conditions and effluent limits as required in the permit. You must submit, in triplicate,
plans/specifications and design calculations, stamped and sealed by a professional engineer,
with a letter requesting an ATC to the Stormwater Permitting Unit, 1617 Mail Service Center,
Raleigh, NC 27699-1617. Also, a design narrative must be included that tells us specifically
how the stormwater and wastewater flows will be generated, collected, conveyed, treated, and
discharged. This requested information should be received by this Office prior to April 4,
2011.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality, The Division of Water Quality may require modification or

For new plant sites that will discharge or recycle process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to Construct (ATC) wastewater
treatment facilities. ATC requests must be submitted at least 90 days prior to construction'.
For existing plant sites discharging or recycling process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to continue to operate wastewater
treatment facilities in place. Construction, modification, or installation of any new treatment components
at an existing site requires an ATC.
Treatment facilities used to treat or recycle process wastewater (including stormwater BMP structures
treating process wastewater flows commingled with stormwater).require an ATC prior to construction
per 15A NCAC 2H .0138. The authorization to construct or continue to operate will be issued at the
same time as the Certificate of Coverage (COC) for the NCG 14 permit. Design of treatment facilities
must comply with requirements of 15A NCAC 21-1.0138 & .0139.
Construction of wastewater treatment facilities (this includes recycle systems) at new or existing plant
sites requires submission of three (3) sets of plans and specifications signed and sealed by a
Professional Engineer (P.E.) or qualified staff along with this application. A copy of the design .
calculations should be included. Please see questions 14 & 15.

I have spoken with Linda Willis of NCDENR to obtain
information regarding what areas must be incorporated into
the calculations for design of our retention/recycling basins on
site.
Our intent witl be to contain and recycle 100% of the waste
water on site -once they are in place.
1 have also contacted a registered engineer, Grady Simmons
Jr., who has been retained to assist me in the design and
calculations of the retention basins.

diligently working on creating plans and specifications for our
