The Division of Water Quality (DWQ) has the delegated authority to enforce adopted pollution control rules and regulations. On July 25, 2007, Mr. Samar Bou-Ghazale of this Office conducted a site visit as part of the permit application review process (application No.NCG 140373). During the visit Mr. Bou-Ghazale observed the construction of wastewater treatment units. A review of our files indicated that MacLeod Construction Company had not received a permit for such construction. This constitutes a violation North Carolina General Statutes 143-215.1 (a) (2) as follows: 143-215.1 (a)(2) No .person shall construct or operate any sewer system, treatment works, or disposal system within the State without first applying for and receiving a permit from the Environmental Management Commission.
